Da gennemførelsen af projektet kunne få negative følger for miljøet i to nærliggende områder, som i henhold til Rådets direktiv 92/43/EØF om bevaring af naturtyper er klassificeret som "lokaliteter af fællesskabsbetydning", blev Kommissionen anmodet om at afgive en formel udtalelse i sagen, som blev offentliggjort den 6. november Udtalelsen tog dog ikke højde for de oplysninger om alternative lokaliteter, som klageren havde vedlagt ved indgivelsen af klagerne til Kommissionen (reference 2002/5081 og 2003/4260). Han indgav følgelig en klage til Ombudsmanden, hvori han gjorde gældende, at Kommissionen havde set bort fra de oplysninger, han havde fremlagt, og at institutionen ikke havde besvaret hans brev af 20. februar 2007, hvori han havde anfægtet Kommissionens hensigt om at afslutte de klagesager, han havde indgivet. Ombudsmanden gennemgik i sin undersøgelse indholdet af de forskellige brevvekslinger og konstaterede, at de spørgsmål, som klageren havde gjort Kommissionen opmærksom på, nemlig den nuværende situation hvad angår den nærliggende havn i Santa Cruz ("nulløsning"), de alternative løsningers egnethed og de alternative lokaliteter, var blevet behandlet i Kommissionens udtalelse og var blevet grundigt analyseret. Ombudsmanden tilføjede, at Kommissionen efter hans mening havde givet en detaljeret redegørelse for de årsager, der førte til konklusionen om, at havneprojektet i Granadilla på visse betingelser kunne igangsættes på grund af den altovervejende offentlige interesse. Med hensyn til klagerens brev konstaterede Ombudsmanden, at Kommissionen ikke havde besvaret det. 2 Strasbourg, 26 August 2008 Dear Mr M., On 26 March 2007, acting on behalf of different environmental NGOs, including "Ecologistas en Acción", "Greenpeace", "SEO/BirdLife" and "WWF/Adena", you submitted a complaint to the European Ombudsman against the European Commission. The complaint concerned the construction of a port in the city of Granadilla, on the island of Tenerife (Spain). On 21 June 2007, I informed the President of the Commission of your complaint and asked him to submit an opinion on it by 30 September On 1 October 2007, the Commission sent its opinion in English. On 15 October 2007, it sent a translation of the opinion in Spanish, which was forwarded to you on 25 October 2007, with an invitation to make observations, if you so wished. On 21 November 2007, you requested an extension of the deadline to reply. By letter of 12 December 2007, I granted your request allowing you to submit your observations until 31 January On 12 January 2008, you submitted your observations on the Commission's opinion. I am writing now to let you know the results of the inquiries that have been made. THE COMPLAINT Complaint 3514/2006/JMA: On 15 November 2006, the complainant lodged a first complaint with the European Ombudsman, which was registered under reference 3514/2004/JMA. The complaint related to the Commission's position as regards the development by the Spanish authorities of an industrial harbour in the city of Granadilla, on the island of Tenerife (Spain). The complainant explained that he had submitted a number of complaints to the Commission concerning this project (reference 2002/5081 and 2003/4260), in which he had argued that it did not respect Article 6(4) of Council Directive 92/43/EEC of 21 May 1992 on the conservation of natural habitats and of wild fauna and flora (1) ( the Habitats Directive ) because, in his view, its implementation would have a negative environmental impact on two neighbouring natural areas which had been classified as protected sites. This provision states that, for special areas of conservation, any project likely to have a significant effect thereon, must be subject to appropriate assessment of its implications for the site, in view of the site's conservation objectives. If that assessment is negative, the responsible authorities can only carry it out for imperative reasons of overriding public interest and in the absence of alternative solutions. Since he considered that there were possible alternatives to the project, the complainant argued that its development would contravene EU law. In December 2005, therefore, the complainant submitted a study to the Commission which, in his view, showed that there were at least seven alternatives to the construction of a port in Granadilla, including the enlargement of the existing nearby port of Santa Cruz. On 15 April 2006, the complainant sent the Commission a new report which spelled out how these alternatives could be implemented. The report referred to such matters as the available land and quarry materials for an eventual extension of the port of Santa Cruz, its effects upon the nearby population and an assessment of the potential growth of that port. On 13 July 2006, the complainant repeated his request by letter to Commissioner Dimas, which was replied to by the responsible services on 11 October

3 In its reply, the Commission underlined that it had not yet taken a decision on the matter. The complainant noted that, on 6 November 2006, the Commission issued its formal opinion on the project of Granadilla, pursuant to Article 6(4) of the Habitats Directive. In this opinion, the Commission concluded that the construction of a new port in Granadilla appeared to respond to imperative reasons of overriding public interest and that, in its view, there appeared to be no feasible alternatives to the project. In his complaint to the Ombudsman, the complainant alleged, (i) that the Commission had not given him access to the documents used in the drafting of its opinion, and that (ii) it had not taken into account the information he had submitted, in particular his arguments in support of feasible alternatives to the project. As regards the first allegation, the Ombudsman decided to start an inquiry. The Ombudsman concluded his inquiry into this aspect of the case by decision dated 13 May 2008 (2). In connection with the second allegation the Ombudsman considered that the complainant had not made any appropriate approaches to the Commission as regards this aspect of the problem. The complainant alleged that the Commission had not, as promised to the Ombudsman in its reply to his own initiative inquiry OI/2/2006/JMA, thoroughly considered the potential alternatives the complainant had described in his correspondence with the institution. He went on to explain in detail the different options he had suggested and insisted that the Commission had not made any reference to them in its opinion of 6 November The complainant noted that the Commission's analysis had taken, as a starting point, the so-called "zero option", identifying it with a situation of no increase of actual harbour capacity. The complainant pointed out that such a point of departure was inaccurate since, even if the project for the construction of a port in Granadilla were to be cancelled, the nearby port of Santa Cruz would have seen its capacity increased as a result of expansion plans currently under way. The complainant further noted that these plans, which had been already approved, should result in the future expansion of both the East and Fish docks of the Santa Cruz port. He therefore concluded that the Commission had been unable to give any explanation as regards why it did not take these expansion plans into account for its baseline position. The complainant then examined the possible alternatives which had in fact been taken into consideration by the Commission. The first alternative was the expansion of the existing port of Santa Cruz. The Spanish authorities had not retained that alternative on the grounds that: (a) it would have had a negative impact on the residents of the nearly town of Santa Cruz de Tenerife; (b) there were no nearby quarries to provide the necessary materials; (c) no land was suitable for such extension; and (d) it would lead to an increasing imbalance between the North and South parts of the island. In its opinion, the Commission concluded that the arguments of the Spanish authorities appeared to be reasonable. The complainant believed, however, that these reasons were not grounded, since the planned extension of the port of Santa Cruz would take place in a sector of the harbour involving heavy loading which, by no 3

4 means would have had any effect on the local population. He also added that there were a number of buildings near the port, whose materials could have been used for any eventual extension. He further noted that the maps of the existing port of Santa Cruz show that there were tracts of land available, which could have provided sufficient space for any extension. Lastly, the complainant argued that a greater imbalance between the North and South parts of the island would result instead from the development of the port of Granadilla. On the basis of a number of studies which have been sent to the Commission, the complainant argued that the justification for the Granadilla port was the perceived need for increased growth in harbour capacity, whereas, in his view, the expansion of the existing facilities in Santa Cruz would have sufficed to cater for future maritime needs. The complainant noted that, in the event that the construction of a new port were the preferred option, he had informed the Commission of a number of alternative, more suitable locations than the Granadilla area. These alternative locations had, in his view, not been considered by the Commission. From the available information, however, it did not appear that the complainant had made any appropriate approaches to the institution, in order to contest the contents of the Commission's opinion of 6 November Since this aspect of the complaint had not, as required by Article 2(4) of his Statute, been preceded by the appropriate administrative approaches towards the responsible institution, the Ombudsman declared it inadmissible by letter of 31 January In his letter to the complainant, the Ombudsman advised him to write to the Commission regarding this aspect of the case, and to request information on the reasons why the arguments laid down in his complaint had not been taken into account. The complainant was informed that, if he considered that the Commission's reply was unsatisfactory, he could consider submitting a new complaint to the Ombudsman. Complaint 885/2007/JMA: On 26 March 2007, the complainant lodged a new complaint with the Ombudsman, which was registered under reference 885/2007/JMA. In this complaint, the complainant explained that, following the Ombudsman's advice, he had contacted the responsible Commission on 20 February 2007, requesting an explanation of the reasons why the information pertaining to his complaints (reference 2002/5081 and 2003/4260), which he had sent to the Commission, had not been taken into consideration in the latter's opinion of 6 November The complainant restated in this letter the arguments against the project of port in Granadilla which, in the context of his prior complaints, he had already made in his previous exchanges with the Commission. The complainant's letter of 20 February 2007 had not been replied to. Taking into consideration the new evidence, the Ombudsman decided to register the complainant's letter as a new complaint and to start an inquiry. The allegations on which the Ombudsman asked the Commission to submit an opinion were the following: The complainant alleges, in summary, that the Commission failed to: - take into account the information which, pursuant to Article 6(4) of the Habitats Directive, 4

5 he submitted concerning the existence of alternatives to the construction of a port in Granadilla in its opinion of 6 November 2006; - reply to his letter of 20 February 2007, in which he requested an explanation for the shortcomings of the above Commission's opinion on the port of Granadilla. THE INQUIRY The Commission's opinion In its opinion, the Commission first described the background to the case. It explained that the project for the construction of a new port in Granadilla, on the island of Tenerife, had been challenged by several environmental NGOs and citizens' organizations, including the complainant's association, which lodged complaints 2002/5081 and 2003/4260. In these complaints, the complainant alleged that the project of Granadilla would breach a number of Community rules, including Directive 85/337/EEC 2 on the assessment of the effects of certain public and private projects on the environment and Directive 92/43/EEC on the conservation of natural habitats and of wild fauna and flora. The Commission explained that the project was likely to adversely affect the nearby Natura 2000 Sites of " Sebadales del Sur de Tenerife " and " Montana Roja " and therefore, pursuant to Article 6, paragraphs 3 and 4 of the Habitats Directive, it had to be made subject to an environmental assessment which should have taken into account the possibilities for alternatives, mitigation measures and eventually compensation. On 7 November 2005, the Commission received a request from the Spanish authorities seeking an opinion pursuant to Article 6(4) of the Habitats Directive regarding the absence of alternative solutions and invoking imperative reasons of overriding public interest (3). The Commission adopted its opinion on 6 November 2006, which was posted on its website. A copy of the document was annexed to its opinion to the Ombudsman. In its opinion on the project for the port of Granadilla, the Commission concluded that the project, as described in the documents submitted by the Spanish authorities, could proceed for reasons of overriding public interest, on condition that all necessary compensatory measures to ensure overall protection of the coherence of the Natura 2000 sites were taken in good time. The Commission then addressed each of the complainant's allegations. As regards its alleged failure to take into account the complainant's arguments concerning the existence of alternatives, the Commission explained that it had been considering the project since 2002, when it started an inquiry on the matter in connection with complaint number 2002/5081. The Commission underlined that, before adopting its opinion, it had fully taken into account all available information from different sources, including that provided by the complainant and other environmental NGOs and citizens opposed to this project. In this context, the Commission held numerous meetings with public authorities and with NGOs, including the complainant's, in order to listen to opinions and to collect new evidence. The Commission analysed all available information in relation to the alternatives to the construction of the port of Granadilla. In fact, the information provided by the complainant early on allowed the Commission to reach the conclusion that the project would significantly affect two "sites of Community Importance". The Commission added that its opinion on the project of Granadilla was adopted after 5

6 having considered all the different views presented by the different parties. The Commission recognized however that its conclusion differed from that of the complainant although, it stressed, it had fully taken the latter's views into consideration. Given the rift between supporters and opponents of the project, the Commission considered that it was unrealistic to expect that its final opinion would be shared by all interested parties. In connection with its alleged failure to reply to a letter from the complainant, the Commission noted that it had no trace of having received a letter dated 20 February 2007 but assumed that the complainant referred in fact to his letter of 15 February 2007, which had been registered by the Commission services on 22 February In the Commission's view, the complainant had not requested a reply, as the communication was a simple transmission letter with complementary information to be incorporated into complaints 2002/5081 and 2003/4260. The Commission further noted that, in accordance with the Commission Communication on relations with the complainant in respect of infringements of Community Law, complainants are informed in writing "after each Commission decision". The Commission nevertheless regretted that it had not acknowledged receipt of the letter in question. It underlined, however, that the concerns and questions on the alternatives raised in the letter had been addressed in the Commission's opinion of 6 November The complainant's observations In his observations of 7 June 2007, the complainant repeated his allegations. He underlined that the Commission had not taken into account the information he had provided and had therefore adopted an administrative act without proper reasoning. He underlined that his arguments had been summarised in his letter of 15 February 2007, to which the Commission had given no reply. The complainant explained that the document was not merely for information, but rather to persuade the Commission that his complaints were well-reasoned and that they should not be closed. The complainant underlined that the Commission had been reviewing potential alternatives to the project of port in Granadilla on the basis of different studies prepared by its services to which he had not had access. THE DECISION 1 Background: the Ombudsman s previous inquiry into the port of Granadilla: OI/2/2006/JMA 1.1 The Ombudsman has already had the opportunity to review the project for the construction of a port in Granadilla, in the context of an own initiative inquiry (reference OI/2/2006/JMA), which he opened on 27 January 2006, after having received a large number of complaints on this matter. According to those complainants, the Commission had closed a number of Article 226 complaints concerning the port of Granadilla on the grounds that the development of an industrial harbour in that town would not be contrary to Community rules. The complainants argued, in very general terms, that the Commission had failed to consider the existence of possible alternative solutions to the proposed project. In its reply to the Ombudsman, the Commission argued that, at that time, it had not yet taken a decision with regard to existing complaints on this matter, as its services were still assessing the project. It explained that the presence or absence of alternatives to the project was a relevant issue that should be dealt with in a formal opinion on the matter that its services were due to issue pursuant to Article 6(4) of the Council Directive 92/43/EEC of 21 6

7 May 1992 on the conservation of natural habitats and of wild fauna and flora ( the Habitats Directive ) (4). The Commission assured the Ombudsman that, in its future opinion, it would thoroughly assess the ecological values likely to be affected by the project, as well as the relevance of the imperative reasons invoked, and the balance of these two opposed interests. It added that it would also undertake an evaluation of compensation measures. 1.2 As the Commission had not yet taken a decision on the matter, and in view of its undertakings, the Ombudsman concluded that no further inquiries were needed at that point and decided to close his own initiative inquiry on 24 October 2006 (5). The Ombudsman pointed out however that, once the Commission had issued its opinion, citizens and residents would have the opportunity to submit complaints to him, if they considered that there had been maladministration by the Commission. 2 Alleged failure on the part of the Commission to take into consideration the information submitted by the complainant 2.1 The complainant alleges that, in its opinion of 6 November 2006, submitted pursuant to Article 6(4) of the Habitats Directive, the Commission failed to take into account information he had submitted concerning the existence of alternatives to the construction of a port in Granadilla, notwithstanding the commitments the institution had made in its reply to the Ombudsman s own initiative inquiry OI/2/2006/JMA. The complainant submitted that information in his complaints to the Commission (reference 2002/5081 and 2003/4260), in which he alleged that the project did not respect the Habitats Directive. In his view, the implementation of the project would result in a negative environmental impact on two neighbouring natural areas which had been classified as "sites of Community Importance", even though alternatives options to the project were available. According to the information which the complainant submitted to the Commission in December 2005 and 15 April 2006, and which he resubmitted on 15 February 2007, it was inadequate to consider that the situation existing before the development of the project, the so-called "option zero", would have led to an impasse of actual harbour capacity for the port of Santa Cruz, since a number of plans to increase its capacity had already been approved and were in the process of being implemented at that time. The complainant argued that a further expansion of the port of Santa Cruz should be considered as an alternative to the project of Granadilla. The complainant acknowledged that the Spanish authorities had refused such options on the grounds that (a) they would have a negative impact on the residents of the nearby town of Santa Cruz de Tenerife; (b) there were no nearby quarries to provide the necessary materials; (c) no land was suitable for the extension; and (d) they would lead to an increasing imbalance between the North and South parts of the island. He nevertheless argued that these reasons were not grounded. In his exchanges with the Commission, the complainant argued that (a) the planned extension of the port of Santa Cruz would take place in a sector of the harbour involving heavy loading ("Dársena Pesquera") and would not, therefore, have any negative effects on the local population; (b) there was a nearby quarry ("La Jurada") whose materials could have been used for any eventual extension of the port of Santa Cruz; (c) adjacent old buildings present at the port could also have been decommissioned in order to obtain additional materials for that extension; (d) the maps of the existing port showed that there were tracts 7

8 of land available, which could provide sufficient space for any potential extension; and, lastly, (e) a greater imbalance between the North and South parts of the island would instead result from the development of the port of Granadilla. On the basis of reports submitted to the Commission, the complainant argued that the expansion of the existing facilities of the Santa Cruz port would be sufficient to cater for future trade demands, making it unnecessary to develop new facilities. Nevertheless, if a new port were to be chosen, the complainant made a number of suggestions regarding alternative locations. In his observations, the complainant pointed out that the Commission had been reviewing potential alternatives to the project concerning the port in Granadilla, which were based on different studies prepared by its services to which he had not had access. 2.2 The Commission argues that it has followed this matter since 2002, when it started an investigation on the potential construction of a port in Granadilla. The Commission underlines that, before adopting its opinion on 6 November 2006, it had considered all available information from different sources, including that provided by the complainant and other environmental NGOs and citizens opposed to this project. The Commission points out that it had analysed all available information concerning alternatives and that its opinion had been adopted after fully taking into consideration all the different views. The Commission recognizes, however, that the conclusion it had reached in its opinion was different from that of the complainant although, it stresses, it fully took the latter's views into consideration. Given the rift between supporters and opponents of the project, the Commission considers that it was unrealistic to expect that its final opinion would be shared by all interested parties. 2.3 In order to assess whether or not the Commission took proper account of the information submitted by the complainant, the Ombudsman finds it necessary to review the content of the different exchanges between the complainant and the Commission, as well as the reasoning of the Commission's opinion of 6 November The Ombudsman notes that the complainant sent information to the Commission concerning the subject matter of his complaints (reference 2002/5081 and 2003/4260), in December 2005 and on 15 April In his letters, the complainant included a number of reports. In the complainant's view, the detailed information contained in these reports questioned the need for a new port in Granadilla and provided arguments in support of potential alternatives. The Ombudsman notes that the main issues raised in these reports are as follows: Zero-option : As regards the continuation of the existing situation, namely, the so-called "zero option", the Ombudsman notes that, in his exchanges of December 2005 and 15 April 2006, the complainant explained that such an option did not imply an impasse as regards actual harbour capacity of the port of Santa Cruz, since a number of plans to increase this port's capacity had already been approved and were in the process of being implemented at the time. 8

9 Alternative options : The Ombudsman notes that, in his exchanges of December 2005 and 15 April 2006, the complainant argued in favour of a further expansion of the port of Santa Cruz as the main alternative to that in Granadilla. In the different documents annexed to his report of 15 April 2006, the complainant argued that the expansion of the Santa Cruz port would not have a negative impact on the residents of the near town of Santa Cruz de Tenerife, since the works should take place in a sector of the harbour involving heavy loading ("Dársena Pesquera") which would not result in negative effects on the local population. The complainant further added that these works could be carried out by using materials from a nearby quarry ("La Jurada"), as well as from adjacent old buildings which could be decommissioned. Along with his report, the complainant enclosed maps of the Santa Cruz port, which showed that several tracts of land were available and could provide sufficient space for any potential extension. This option would not, in the complainant's view, disrupt the transport balance between the North and South parts of the island, in contrast to the situation which would result from the development of the port in Granadilla. Alternative sites : The Ombudsman notes that, in his report of 15 April 2006, the complainant argued that, the expansion of the Santa Cruz port would be sufficient to cater for future trade demands. However, if a new port were to be chosen, he made a number of suggestions as regards alternative locations. 2.5 The Ombudsman notes that, in reply to the above information, the Commission replied to the complainant on 13 July In its letter of 13 July 2006, the Commission informed the complainant that the institution had: " [N]ot taken a decision pursuant to Article 6(4) of the Habitats Directive, but that the referred decision would cover the assessment of the ecological values which are likely to be affected by the plan or project, the relevance of the invoked imperative reasons and the balance of these two opposed interests, as well as an evaluation of the compensation measures. " 2.6 The Ombudsman notes that on 6 November 2006, the Commission issued an opinion pursuant to Article 6(4) of the Habitats Directive concerning the port of Granadilla. Section VI of the opinion was devoted to the analysis of alternative solutions. In that section of the document, the Commission underlined that its services had analysed all available information in relation to the alternative solutions, including information presented in the context of complaints received. In the light of that analysis, the Commission concluded as follows: "Zero Option" : " [T]he conclusion of the Commission services is that the existing port facilities will not be able to handle the expected increase in maritime traffic and that additional facilities and increased port capacity is [sic] necessary for the economic development of the island. " Alternative options : " With regard to the alternatives which involve an expansion of the existing port facilities in Santa Cruz the Commission services consider that the Spanish authorities have provided adequate 9

10 justification for rejecting these options in particular as; It (the expansion of the existing port facilities) would have a negative impact on the inhabitants of Santa Cruz de Tenerife, both during the construction and once the enlarged port becomes operational; It would not have a quarry in the surroundings thus creating problems during construction; It would not have the necessary land available for development of the associated industrial and logistical support facilities in the adjoining areas. It would further increase the North to South transport imbalance of the island transport system. It would compromise the plan to develop a natural gas storage terminal on the island thereby diversifying the energy mix available to the local economy. Due to the proximity of the current port to the town of Santa Cruz, developing such a facility on the existing site would not be possible. " Alternative sites : " [T]he Commission has assessed the authorities' opinion that Granadilla is the only appropriate site for the new port in Tenerife. This opinion is based on different technical reasons that have to be considered when identifying a site for the construction of a new port. These include factors such as the depth of the seabed at shore, the presence or not of a quarry close enough to the envisaged site, the availability of free adjacent land surface for handling and logistic operations, the adequacy of the transport connections with the hinterland and the proximity to port users. " 2.7 Before addressing the allegations made by the complainant, the Ombudsman points out that his review of the Commission's actions has been limited to verifying whether the Commission provided a coherent and sufficient explanation in relation to the specific arguments submitted by the complainant. The Ombudsman is mindful of the fact that, in its explanation as regards why the project for the port in Granadilla did not contravene Article 6(4) of the Habitats Directive, the Commission made a number of additional arguments which were not dealt with by the complainant. In particular, the Commission pointed out that no viable alternatives to the Granadilla port were available because, (i) a gas importation terminal could not be built in the port of Santa Cruz (given that the port of Santa Cruz was near an urban area), and (ii) the other proposed sites did not have sufficient deep water access. The Ombudsman has not assessed these arguments, given that this aspect of the problem was not part of the allegation made by the complainant and was therefore not included within the scope of the present inquiry. 2.8 Having reviewed the information submitted by the complainant in the light of the Commission's opinion of 6 November 2006, the Ombudsman finds that the issues of concern for the complainant which he had brought to the Commission's attention, namely, the existing situation of the Santa Cruz port ("zero option"), the suitability of alternative options, and the alternative sites, had, in fact, been addressed in the Commission's opinion, and they had been subject therein to a detailed analysis. 10

11 The Ombudsman further notes that the complainant has acknowledged that the Commission had undertaken a review of these issues, albeit on the basis of different studies prepared by its services to which he had not had access. Taking into consideration the above findings, the Ombudsman considers that, in its opinion on the project of port in Granadilla pursuant to Article 6(4) of the Habitats Directive, the Commission did in fact take account of the issues raised by the complainant in his correspondence. The Ombudsman also finds that, in that text, the Commission gave a detailed explanation of the reasons which had led it to conclude that, subject to certain conditions, the project of port in Granadilla could proceed for reasons of overriding public interest. The Ombudsman therefore considers that there appears to be no instance of maladministration as regards this aspect of the case. 3 Commission s alleged failure to reply to a letter from the complainant 3.1 The complainant alleges that the Commission failed to reply to his letter of 20 February 2007, in which he requested an explanation for the shortcomings of the Commission's opinion of 6 November 2006 on the port of Granadilla. 3.2 The Commission argues that it had no trace of having received a letter dated 20 February 2007, but assumes that the complainant referred in fact to the complainant's letter of 15 February 2007, which had been registered by the Commission services on 22 February 2007 (6). In the Commission's view, the complainant had not requested a reply to that letter. The Commission further considered that the letter was a simple "transmission letter" providing complementary information to be incorporated into complaints 2002/5081 and 2003/4260. The Commission adds that, in accordance with the Commission Communication on relations with the complainant in respect of infringements of Community Law, complainants are informed in writing only after each Commission decision. The Commission nevertheless regrets that it did not acknowledge receipt of the letter in question. It underlines, however, that the concerns and questions raised in the letter had been addressed by the Commission. 3.3 In his observations, the complainant adds that the letter in question was not merely for information, but was rather intended to persuade the Commission that his complaints were well-reasoned and should not be closed. 3.4 The Ombudsman notes that the procedural rules to be followed by the Commission in its handling of complaints are set out in a Communication to the European Parliament and the European Ombudsman on relations with the complainant in respect of infringements of Community law (7). In Article 10 of its Annex ("Closure of the case"), the Communication establishes the following: "[W] here a Commission department intends to propose that no further action be taken on a 11

12 complaint, it will give the complainant prior notice thereof in a letter setting out the grounds on which it is proposing that the case be closed and inviting the complainant to submit any comments within a period of four weeks " The letter of 2 February 2007 contained such an invitation to submit comments. In his response of 20 February 2007 to this invitation, the complainant put forward arguments why he considered that the Commission would be wrong to close the cases. 3.5 The Commission did not respond to the letter of 20 February The Ombudsman does not accept that the Commission was correct not to respond to this letter. This is all the more so, given that the Communication establishes in Article 7 of the Annex ("Communications with the complainants") that: The Commission departments will contact the complainants in writing, after each Commission decision (formal notice, reasoned opinion, referral to the Court or closure of the case), of the steps taken in response to their complaint. " According to the above provision, the Commission is required to contact the complainant by letter after a decision on the complaint has been adopted. Furthermore, the Ombudsman is of the view that a letter informing a complainant of the definitive closure of an Article 226 case should, where necessary, deal with any outstanding issues that are raised by a complainant subsequent to the invitation to submit comments. 3.6 The Ombudsman notes that, in the present case, the Commission did not comply with that obligation. The Commission thus failed to provide the complainant with individual reasoning in support of its decision to close the Article 226 complaints the complainant had submitted (references 2002/5081 and 2003/4260). This constitutes a breach of Article 18 of the European Code of Good Administrative Behaviour (8). In particular, the Commission did not take the opportunity to adequately respond to the specific arguments made by the complainant in his letter of 20 February 2007 as regards the following arguments: - the continuation of the existing situation, namely, the so-called "zero option", would not result in an impasse as regards the capacity of the port of Santa Cruz to deal with the expected increase in maritime traffic, given that plans to increase the capacity of the port of Santa Cruz had already been approved and were in the process of being implemented; - the further expansion of the port of Santa Cruz could be a viable alternative to the development of the port at Granadilla, since the Santa Cruz option: - would not have a negative impact on the residents of the nearby town of Santa Cruz de Tenerife, as the expansion works would take place in an isolated sector of the harbour reserved for heavy loading, namely, the "Dársena Pesquera" (thereby ensuring that there would be no negative effects on the local population); - could be carried out with materials from a nearby quarry ("La Jurada"), as well as materials from adjacent old buildings which could be decommissioned; - could be placed on tracts of available land, specifically on land identified by the complaint as being available; and, - would be less disruptive than the development of a port in Granadilla from the point of view of the transport balance between the North and South parts of the island. 12

13 The Ombudsman is of the view that some of the above aspects can be classified as "outstanding issues" and that they cannot be dealt with by a mere cross reference to the opinion of the Commission of 6 November It would, instead, have been appropriate for the Commission to deal with these issues in a further letter informing the complainant of the definitive closure of the case. 3.7 The Ombudsman considers that, as laid down in Article 18 of the European Code of Good Administrative Behaviour, the Commission, when replying to citizens in matters which affect their rights and/or interest, (as is the case of complaints made pursuant to Article 226 EC), should respond with individual reasoning which properly addresses the arguments made, and without basing its reply on brief or vague grounds. The Ombudsman considers, therefore, that, by not replying to the complainant's letter of 20 February 2007, the Commission failed to comply with the above-outlined obligation. This constitutes a case of maladministration for which he will address a critical remark below. 4 Conclusion On the basis of the Ombudsman's inquiries into this complaint, it appears necessary to make the following critical remark: The Ombudsman notes that the Commission failed to respond to the letter of 20 February 2007 in which the complainant contested the Commission's intention to close the Article 226 complaints the complainant had submitted (references 2002/5081 and 2003/4260). The Commission also failed to inform the complainant of the formal closure of the complaints. The Ombudsman is mindful of the fact that the Commission failed to provide the complainant with an individual reasoning in support of its decision to close the Article 226 complaints the complainant had submitted. Given that these aspects of the case concern procedures relating to specific events in the past, it is not appropriate to pursue a friendly settlement of the matter. Where the site concerned hosts a priority natural habitat type and/or a priority species, the only considerations which may be raised are those relating to human health or public safety, to beneficial consequences of primary importance for the environment or, further to an opinion from the Commission, to other imperative reasons of overriding public interest.
