9 Julen nærmer sig, og vi åbner dørene til årets sidste og mest omfangsrige auktion i Bredgade. Vanen tro indleder vi med ældre malerier, og et af de mest stemningsfulde værker er Otto Baches kendte optrin med heste og folkeliv foran Lindenborg Kro ved Roskilde fra En større version af værket blev udstillet på Charlottenborg i 1878 og samme år erhvervet af kongehuset. I anledning af frimærkeudstillingen Hafnia i 1976 kom skildringen til at udgøre motivet på et frimærkeark, hvilket gjorde det kendt i brede kredse (kat.nr. 74). Det er en stor ære denne gang at kunne præsentere en af landets fineste private samlinger af dansk barok- og rokokosølv samlet gennem en lang årrække af Mærsk Mc-Kinney Møller (kat.nr ). I anledning af 400-året for Romanov-dynastiet, der regerede Rusland frem til revolutionen i 1917, er en del af auktionen dedikeret til russisk kunst. Et af synonymerne med landet er uden tvivl Fabergé, der blev grundlagt i Skt. Petersborg i 1842 og siden har fremstillet overdådige juvelerarbejder heriblandt den udbudte bordklokke og seks skjorteknapper, der blev givet i gave af kejserinde Dagmar til medlemmer af det danske kongehus (kat.nr. 233 og 232). Vi byder sågar på hemmelige militære oplysninger fra 1697 skrevet med usynligt blæk i et brev signeret af den russiske zar, Peter den Store (kat.nr. 206). Blandt de europæiske antikviteter finder man et par rokokokommoder fra den nordtyske by Altona, hvis snedkerværksteder var blandt de førende inden for møbelproduktion i 1700-tallet (kat.nr. 340). Auktionens store Louis XVI prismekrone stammer fra samme periode, hvor den blev til på det legendariske værksted Werner og Mieth i Berlin, der gennem tiden var leverandører til alverdens prominente residenser (kat.nr. 379). Vi tager også turen til Østen med 90 effekter fra primært Kina, heriblandt et udvalg af silkescrolls med fortællende motiver, hvor mennesker, dyr og natur optræder i skøn forening. De æstetiske scrolls er en kombination af kunst og kalligrafiske inskriptioner, og gennem tiden har deres ejere anvendt dem ved særlige lejligheder til beundring og diskussion af de skildrede legender en tradition, der går helt tilbage til Han-dynastiet (kat.nr ). 10 Christmas is fast approaching and we re opening the doors to the last and most extensive auction of the year at Bredgade. True to form, we ll be starting with fine art. One of the most evocative works featured is Otto Bache s famous scene depicting horses and street life in front of Lindenborg Kro near Roskilde from A larger version of the work was exhibited at Charlottenborg in 1878 and acquired by the court that same year. On the occasion of the Hafnia stamp exhibition in 1976, the painting was used as the motif on a sheet of postage stamps, making it widely known (cat. no. 74). It is a great honour this time to be able to present one of Denmark s finest private collections of Danish Baroque and Rococo silver, collected over a great many years by Mærsk Mc-Kinney Møller (cat. no ). To mark the 400th anniversary of the Romanov dynasty, which ruled Russia until the revolution in 1917, part of the auction is dedicated to Russian art. A name synonymous with Russia is without a doubt Fabergé, which was founded in St. Petersburg in 1842, and which has produced opulent jeweller s work ever since including the bell push and six shirt buttons up for auction, given as a gift by Empress Dagmar to members of the Danish royal family (Cat. No. 233 and 232). We are even offering military secrets written in invisible ink in a letter signed by the Russian Tsar Peter the Great! (cat. no. 206) Among the European antiques is a pair of Rococo commodes from the north German town of Altona, whose joinery workshops were among the leaders in 18th century furniture production (cat. no. 340). The auction s large Louis XVI chandelier dates from the same period, and was made at the legendary Werner and Mieth workshop in Berlin, supplier to eminent residences the world over (cat. no. 379). We also take a trip to the Orient with 90 items, primarily from China, including a selection of silk scrolls with narrative motifs, beautifully depicting people, animals and nature. The aesthetic scrolls are a combination of art and calligraphic inscriptions, and over the years, their owners have used them on special occasions for admiration and discussion of the legends depicted a tradition dating right back to the Han Dynasty (cat. no ). There is also ample opportunity to get started on your Christmas shopping when we swing the hammer over jewellery and wristwatches. One of the highlights here is a rare pink sapphire from Burma, which is an exponent of some of the world s finest gems of this type (cat. no. 719). Most men would undoubtedly be delighted to find one of the watches up for auction from distinguished brands such as Rolex, Audemars Piguet or Patek Philippe under the Christmas tree (cat. no. 887, 896, 895). 15 The 400th anniversary of the coronation of Tsar Mikhail Feodorovich Romanov in 1613 This autumn we commemorate the 400th anniversary of the coronation in 1613 of Tsar Mikhail Feodorovich Romanov, whose descendants ruled Russia until the revolution in At this auction, we will be offering Russian art and antiques with Imperial, Royal and private provenance. The first formal connections between Russia and Denmark were established between King Hans of Denmark and Grand Duke Ivan III of Moscow in With the Romanov dynasty on the Russian throne from 1613, the relations intensified. During the Great Northern War, for example, the Danish-Russian alliance was strengthened by a visit to Copenhagen in 1716 by Tsar Peter the Great. Danish-Russian trade also increased during the late 18th century, and in the 19th century, Danish artists and officers worked in Russia. Danish-Russian relations were further boosted in 1866, when Princess Dagmar of Denmark married the heir to the Russian throne, the future Tsar Alexander III of Russia. Tsaritsa Maria Feodorovna, as she was known from 1881, introduced the Danish business community to Russia, with companies such as Store Nordiske Telegrafselskab (the Great Northern Telegraph Company) and ØK (the East Asiatic Company). Trade routes and interests also went the other way: From , Alexander Nevsky Church was built at Bredgade in Copenhagen, and Russia participated at the Nordic Exhibition of Industry, Agriculture and Art in Copenhagen in The Russian Imperial yacht Standart was also built by B&W in Copenhagen from The connections with Russia were further strengthened by the marriage of Princess Alexandrine of Mecklenburg-Schwerin and Prince Christian (X) of Denmark in Princess Alexandrine was the daughter of Grand Duchess Anastasia of Russia, who, incidentally, was the cousin of Tsar Alexander III. In 1919, following the Russian revolution, Tsaritsa Maria Feodorovna took up residence at Hvidøre Castle, north of Copenhagen, and in 1920 she was joined by her daughter, Grand Duchess Olga, and Olga s husband and two sons. The Empress became a natural figurehead for Russian emigrants, and her funeral in 1928 marked the end of an era dating right back to Grand Duchess Olga and her family lived in Denmark until 1948, when they emigrated to Canada. Following negotiations between the Danish and Russian governments, the Empress was reburied in St. Petersburg in 2006, a move regarded as a symbol of the continuing relations between Denmark and Russia. Gouache on paper. Visible size 27 x 42 cm. (2). The Gatchina Palace was built by Antonio Rinaldi for Count Grigori Grigorivich Orlov, Catherine II the Great of Russia's favorite. The palace was later dowager residence for Alexander I of Russia's mother and later main residence for Tsar Alexander III and his wife, Tsaritsa Maria Feodorovna. Elagin Palace on Elagin Island was reconstructed in 1818 by Carlo Rossi and named after the former proprietor, Ivan Elagin ( ). In the early 19th century the owner was Grigori Vladimirovich Orlov, a nephew of Grigori Grigorivich Orlov, who earlier owned the Gatchina Palace. Therefore, Elagin Island was for a short period called "Orlowski Island" or in French "Isle d'orlowski", named after the owner. Elagin Palace was bought in 1817 by Tsar Alexander I as residence for his mother. Johann Wilhelm G. Dated Riga, April 8 [1697]. First leaf addressed to Vinius is written in ink, in clear Russian. Second leaf is written in invisible ink and has later been treated with contemporary liquid chemicals and flames to make the writing visible. On a long strip mounted to the invisible letter the Tsar has written a clear instruction for the receiver, Vinius, to indicate that the enclosed invisible letter, probably to general Ivanovich, is enclosed and has to be deciphered. First leaf annotated "#23" in upper right corner. Second leaf with a cut that causes minor lack of text, but no loss of meaning. Both sheets are expertly repaired and preserved and each sheet framed, both with double museum glass. All housed in modern, special designed cloth box of birch by conservator Per M. Laursen, Humlebæk, Denmark. Enclosed letter by professor Hans Bagger from the institute of Slavonic and East European Studies, University of Copenhagen. Dated The letter contains Hans Bagger's expert analysis which establishes that the letter is of the greatest importance, historically, philologically and in a broad antiquarian sense. + Typewritten transcription by Hans Bagger and one of his colleagues of the Russian wording of the letter in an up-to-date Russian typography. Further information and/or transcription/translation in Russian, English and Danish available upon request. This important signed letter is written under Peter the Great s great journey to Europe and is one of the most important contemporary sources to his stay in Riga in In March 1697 he travelled incognito to Western Europe on an 18-month journey with a large Russian delegation of 250 people - the so-called Grand Embassy only few members of the delegacy knew about his real identity. During Easter the delegation visited the Swedish city of Riga. The Swedish governor in Riga was no less than Erik Dahlbergh ( ) who later became a national arch-enemy of the state of Denmark and a key operative in the Great Northern war. Before leaving Russia, Peter made no secret of the fact that he was travelling to observe and to learn, as well as to recruit foreign experts for Russia. He also made preparations for transferring his military observations to central figures in the Russian army. This could be accomplished by writing messages in invisible ink. Originally it was planned that the Embassy should continue the voyage from Riga, but a spring thaw set in and the delegation was forced to stay for some time in the city. Peter passed the time acting a military spy studying the ramparts and fortifications around the city of Riga, established under the guidance by the Swedes. On 8 April 1697 he wrote this very illustrious letter about his experiences in Riga, the main contemporary source to his impressions from his stay in Riga which turned out to be very influential later on. The stay was not at all what Peter had expected. In the letter he describes his disappointment with the unwelcoming behaviour the Swedes showed him and his delegation. Today historians regard Peter the Great s unwelcome stay in Riga as a focal point in history. 38 The Riga-letter is not only famous for its unique documentation from quite a unique event in world history. The fact that the ruler of a great empire - Peter the Great - gave up power for a longer period and travelled abroad to get acquainted with a completely different culture than his own, had never been seen before. This uniqe and important document tells us about this journey and contains the main source of information about Peter s impressions from his stay in Riga. It documents and describes his spying on western countries and his use and exchange of secret information important to the state of Russia - both military information about Riga and also the rumours about the Swedish King Carl XII s political ambitions. Thus the double-letter is one of the most important contemporary source to document the history of Peter the Great and his encounters in Riga at this particular historical period and is of invaluable historical importance. First leaf: Vinius, Today we started from here towards Mitau. We have been living on the other side of the river which broke up on Easter Day itself. [Sunday after Palm Sunday fell 1697 on 4 April according to the old style]. There we lived like slaves and could only satiate ourselves through the eyes. The merchants here are clad in mantles and they have a very honourable appearance but they cursed and sweared profusely for every kopek when our coach drivers began selling the sledges and they demanded triple prices themselves. In other respects there is no news at all. Having left you to the care of God we ask you to make your bows dutifully to our friends and to our entourage. From Riga, 8, April. Pieter. Second leaf: Will you be so kind as to implore the general [the general is probably A.M. Golovin ] that he shall stand guard by our cottage. [Code-word that says that the following is written in invisible ink]. [Pasted note]: Show this letter to Gavriil Ivanovic (Golovkin) [Leader of the Russian Foreign Office]. [Written in invisible ink]: By all accounts there should be 2780 soldiers. We went through the city and the fortress where the soldiers are posted in five different localities, all in all less than 1000 men and this is said to be the grand total. The city is well fortified but not completed. They are very uneasy and they slip nobody in, neither in the city nor elsewhere, not even under surveillance. They are anything but agreeable. The soldiers have their pay once a year, the corporals each twelve times, the sergeants each 24, and all are in receipt of three barrels of grain. On my way to this place, in an inn before Riga, a drunken [Swedish] nobleman said: Our King will proclaim his son King of Poland and with that purpose troops are clandestinely being equipped under pretext of intending to send them against the Danes and money has been sent to Poland. Inform the Magnates [in Poland] so that they can be on their guard as soon as possible and prevent this, either through the Resident [a Russian diplomat in Poland of the lowest rank] or through a special ambassador. The pyx was designed to hold collunion wafers conserated during the mass. Early pyxes are often small box-shaped objects with tightly fitting lids to avoid any accident to the communion wafers. This pyx is decorated with the letters IHS the first "Jesus in Greek. Known as the Sacred Monogram it has been used as a symbol for Christ since the 6th century. Enamelling was used in the medieval periode to emnellish the most revered object such as those used by royalty or by the church. 109 THOMAS MUDGE & WILLIAM DUTTON A rare George II clock in later mahogany case, square brass dial ornamented with cherup and engrave border, silvered chapter ring, two openwork blue steel hands. Dial and movement signed Mudge & Dutton, 148 Fleet St. London, Anno Domini 1759, GR 11. No England, mid 18th century. H. 41 cm. W. 31,5 cm. D. 17 cm. William Dutton served his apprenticeship under the famous George Graham in 1738 and finished his apprenticeship in 1746 when he became a Freeman of the Worshipful Company of Clockmakers. In circa 1750 he became a partner to the famous Thomas Mudge, another apprentice of George Graham, at 148 Fleet Street, London. This address was used by the Dutton family for several generations. William and Thomas Mudge were two of the developers of the Lever Escapement which is the forerunner of the escapement to be found in almost all the watches and in most small travelling clocks today. Their production was manly watches and made one for Queen Charlotte, wife of George III. But also some long case clocks by Mudge & Dutton of which one is in The Ilbert Collection of Clocks & Watches today in the British Museum. Furniture of this design incorporating walnut and scrolling pierced giltwood elements is generally associated with Altona, one of the leading centres of furniture production in 18th century Northern Europe. The present pair of commodes is a masterpiece of the transition from Rococo to Neoclassicism from the Altona workshop of the celebrated ébénist Johann Friedrich Köster, who were known for making high quality mirrors and commodes in pairs. Such representative and costly pieces were commissioned by the North German and Danish aristocracy not only to furnish the palaces in Schleswig-Holstein, but also as a symbol of status. 136 A 'Copenhagen' Louis XVI mahogany bureau in the manner of C.F Harsdorff, upper part with openwork gallery and clockwork with white enamel dial and Roman and Arabic numerals, under which three doors, hinged fall front enclosing fitted interior and hidden compartment, the lower with three large drawers. Late 18th century, restored. Gallery later. H. 223 cm. W. 130 cm. D. 59 cm. The architect Caspar Frederik Harsdorff represented the simple Neo-Classicist style which followed the Rococo. Two of the best examples of his work are his own house Kongens Nytorv 3-5 (built in 1780) and Erichsens Palace - also on Kongens Nytorv (built 1799). He was ready to put his architectural skills to the service of interior decoration and furniture design. Because of his obvious talent Harsdorff was appointed Court architect and professor. He had numerous pupils, including his friend and colleague C.F. Hansen. Many cabinet-makers were inspired by Harsdorff's stylistic direction - inspiration which is clearly apparent in this bureau. 140 379 WERNER & MIETH MANUFACTURE An impressiv Prussian ormolu and crystal twelve-light pagoda chandelier with a pagoda roof adorned with tassels, the star form waist with cobalt blue glass and pierced palmette frieze and cast rosettes, scrolled twin candle arms and six palm shaped ornaments linked by bridges, richly suspending faceted drops and needle hung conicle cutcrystal, tapered bottom with pine cone final. Berlin, c H. 160 cm. Diam. 80 cm. Similar chandelier was 24th January 1797 delivered to Schloss Charlottenburg in Berlin by Wierner & Mieth, to Frederick II's winter apartment. Today it is displayed in the Gelbe Atlas chamber and is illustrated in Käthe Klappenbach, Kronleuchter mit Behang aus Bergkristall und Glas sowie Glasarmkronleuchter bis 1810, Berlin, 2001, p et p. 334, cat. V 35. Werner & Mieth was founded in Berlin in 1792 by Christian Gottlob Werner, Gottfried Mieth and Friedrich Luckau the younger. They became suppliers to the royal court in 1794 and delivered chandeliers to the finest houses and castles around Berlin, including the Japanese Palace, Sans-Souci in Potsdam, Schloss Monbijou. Werner & Mieth traveled to France, England and Holland to improve and develop their technical skills and seek inspiration for their design. In 1797 the company employed 29 people. They worked in gold, silver, bronze, glass, copper, crystal and mercury was also the year when Frederick William II came with a larger order on chandeliers to the Charlottenburg Palace, six of which were for the winter apartments and six to the royal summer residence. In 1810 they had a large export of chandeliers to the largest cities in Europe such as Paris, London, Hamburg, Stockholm, St. Petersburg, Copenhagen and even Constantinople. The activity war, however, slowed down during the Napolian war, but was soon after in progress and in cooperation with Karl Friedrich Schinkel under the name Werner & Neffen. Joseph Revel is recorded in Tardy as working at La Fidelite in 1774 and in 1775, when he moved to Vieille rue du Temple, he acquired the title of Master. From 1775 to 1783 he was at the Palais Royale and from 1787 to 1790 at the Galerie de Valois. In 1800 he was at the Galerie de Pierre du Palais Egalite and the last record of him is at the Palais Tribunat, from A beautifully enamelled striking watch by him is in the Musee du Petit Palais. This clock by Joseph Revel is typical of the kind of elaborate exotic time-piece made in Paris for export to the East in the late 18th century and early 19th century. Arc de Triomphe du Carrousel was built in honour of Napoleon Bonaparte between 1807 and 1809th. The monument is located in front of the Musée du Louvre in the Tuileries. The monument is designed by Charles Percier and Pierre-François-Léonard Fontaine and is decorated with reliefs showing the celebration of the victory at Austerlitz in On top of the arc is figures of soldiers from the military forces that participated in the battle, including a Carabinier like this made by Joseph Chinard. Joseph Chinard is well known for his marble sculptures and accurate person rendering, especially the bust of Juliette Recamier. His work is presented in various museum collections, among which are the Louvre, the Musée des Beaux-Arts de Lyon, the Metropolitan Museum of Art and the National Gallery of Art, Washington. På opfordring fra bruun rasmussen kunstauktioner (herefter benævnt bruun rasmussen), skal alle bydere, hvadenten de ønsker at afgive et bud ved personligt fremmøde på auktionsstedet eller afgive en kommission pr. brev, fax eller hjemmeside eller byde direkte pr. telefon eller hjemmeside, kunne dokumentere deres betalingsdygtighed samt til enhver tid identificere sig. bruun rasmussen er altid berettiget til at nægte at acceptere et bud, hvis på forlangende ikke tilstrækkelig sikkerhed er stillet eller en passende à conto betaling har fundet sted. bud afgives af byderen ved personligt fremmøde på auktionsstedet eller ved skriftlig kommission enten pr. brev, fax eller hjemmeside. På online-auktioner afgives bud direkte fra hjemmesiden. (moms-nr.), da dette skal anføres på de fakturaer, hvor varen købes i fuld moms. for visse udenlandske købere gælder der særlige regler for afgiftsfritagelse jvf. 4. Afgiftsfritagelse omfatter ikke eu private købere, som ligestilles med danske købere jvf. gældende dansk lovgivning om handel med brugte varer, kunstgenstande, samlerobjekter og antikviteter. købesummen forfalder til betaling ved tilslaget. der kan betales kontant op til dkk eller med dankort, banknoteret check, rejsechecks, visa-, master-, diners club- eller eurocard. Personlige udenlandske checks kan kun anvendes efter forudgående aftale. betaling kan finde sted under eller umiddelbart efter auktionen og under alle omstændigheder skal betaling finde sted senest 8 dage efter fakturadatoen. På online auktioner trækkes købesummen på de af byderen oplyste kort- og kontooplysninger i forbindelse med at det købte emne udtages til transport (ca. 12 timer efter dagens salg). Samtidig tilsendes køber faktura og transportoplysninger. betales købesummen ikke rettidigt, skal der svares rente heraf med 1,5% pr. påbegyndt måned. betales købesum og renter ikke inden 8 dage efter at bruun rasmussen har afsendt påkrav herom til køber, er bruun rasmussen berettiget til at annullere købet og bortsælge det købte på ny auktion hos bruun rasmussen eller underhånden og afkræve køber ethvert herved opstået tab. et eventuelt overskud tilfalder den, der har indleveret det købte til auktion. har den misligholdende køber tilgodehavender fra salg af effekter hos bruun rasmussen, er bruun rasmussen berettiget til at berigtige ethvert tilgodehavende hos køber ved modregning. har den misligholdende køber indleveret andre effekter til salg, er bruun rasmussen berettiget til at bortsælge sådanne effekter på auktion hos bruun rasmussen uden at være bundet af en af den misligholdende køber fastsat mindstepris. den misligholdende køber er ikke berettiget til at kræve udlevering af effekter indleveret til salg, så længe forfalden gæld til bruun rasmussen ikke er betalt, uanset om værdien af sådanne effekter må anses at overstige forfalden gæld. bruun rasmussen er berettiget til at afvise bud afgivet af en køber, der er i misligholdelse med sine betalingsforpligtelser over for bruun rasmussen eller et bud afgivet af en anden på den pågældendes vegne, ligesom bruun rasmussen er berettiget til at kræve et depositum som betingelse for accept af fremtidige bud. 3. FOrTrydeLsesreT for privatkøb af emner på en online-auktion gælder loven om fjernsalg, herunder også 14 dages fortrydelsesret. eventuelle omkostninger forbundet med transport af købte emner retur fra køber, betales af køber selv. Såfremt køber benytter sig af sin fortrydelsesret, refunderer bruun rasmussen betalingen umiddelbart efter, at varen er sendt retur og modtaget af bruun rasmussen. bruun rasmussen gør opmærksom på, at det herefter er op til bankerne/kreditkortselskaberne, hvornår refusionen indgår på købers konto. 4. afgiftsfritagelse udenlandske købere, der opfylder nedennævnte betingelser, betaler henholdsvis 24% i auktionsomkostninger af hammerslaget på traditional auktion og 20% i auktionsomkostninger af hammerslaget på net-auktion, og bliver ikke belastet af danske afgifter. A. købere med bopæl i et andet eu-land: købere, som er momsregistreret i et andet eu-land, fritages for at betale dansk moms, når momsregistreringen dokumenteres over for bruun rasmussen, som skal påføre momsnummeret på fakturaen. b. købere med bopæl uden for eu: 1. forsendelse gennem speditør: effekter, der eksporteres gennem en af bruun rasmussen godkendt speditør, fritages for afgift. 2. udførsel som rejsegods: der kan ske fritagelse for dansk afgift, når køberen selv medtager det købte under forudsætning af, at følgende betingelser er opfyldt: fakturaen skal være betalt, og den danske afgift på 25% af fakturabeløbet skal være deponeret hos bruun rasmussen. a. købere med fast bopæl i Norge vil få den danske moms refunderet, så snart bruun rasmussen har modtaget købsfakturaen retur med påtegning om officiel indførsel fra det endelige lands toldmyndighed eller anden på omsætnings-afgiftsområdet kompetent myndighed, hvis købet overstiger dkk b. købere med fast bopæl andre steder uden for eu vil få den danske moms refunderet, efter at effekterne har været forevist til toldbehandling i forbindelse med køberens udrejse fra eu. eksportørblanketten returneres til bruun rasmussen efter at være forsynet med et toldvæsens attest for udførslen, hvis købet overstiger dkk 300. dette gælder også for færøerne og Grønland. 5. afgiftsbetaling A. momsregistrerede i andre eu-lande, der ikke ønsker at gøre brug af 4, kan i stedet vælge at handle til brugtmoms/fuldmoms på lige fod med private købere. dette skal meddeles bruun rasmussen inden kl. 10 den følgende auktionsdag. b. momsregistrerede i danmark kan vælge at købe til fuldmoms med 25% af både hammerslag og auktionsomkostninger. dette skal meddeles inden kl. 10 den følgende auktionsdag. 530 BRUUN RASMUSSEN BREdgAdE AUcTION 842

180 6. udlevering købesummen skal være betalt, inden det købte kan udleveres til køberen. det købte henligger fra hammerslaget for købers regning og risiko. for varer, der ikke afhentes ifølge aftale efter hammerslaget, vil blive kørt på fjernlager på købers regning og risiko. købte varer, der er betalt, men ikke afhentet, vil efter 1 år blive videresolgt for købers regning ved auktion eller underhånden. 7. FOrsendeLse Såfremt bruun rasmussen påtager sig at emballere og fremsende købte varer, sker dette på købers regning og risiko. bruun rasmussen kan således ikke drages til ansvar for skader forvoldt på købte varer under forsendelse eller for forsvundne forsendelser. 8. KunsTneraFGiFT TiL COPy-dan cd Ifølge gældende dansk lovgivning om ophavsret skal der opkræves følgeretsvederlag for værker af nyere danske og visse udenlandske kunstnere, som enten er nulevende eller ikke har været døde i mere end 70 år. følgeretsvederlaget opkræves af bruun rasmussen på vegne af kunstnernes organisation copydan. disse værker er mærket (cd) for copydan ud for katalognummeret. den såkaldte copydan-afgift tillægges hammerslagsprisen inkl. salær, når beløbet overstiger 300. copydan-afgiften er: 5% af den del af hammerslagsprisen og salæret (ekskl. moms), der udgør indtil % af den del af hammerslagsprisen og salæret (ekskl. moms), der ligger mellem og % af den del af hammerslagsprisen og salæret (ekskl. moms), der ligger mellem og ,5% af den del af hammerslagsslagsprisen (ekskl. moms), der ligger mellem og ,25% af den del af hammerslagsprisen (ekskl. moms), der ligger over copydan-afgiften kan ikke overstige for det enkelte kunstværk. euro-kursen er fastsat af copydan i 2013 til kurs 746,02 pr eksporttilladelse kulturværdiudvalget er blevet ansøgt om eksporttilladelse, hvor dette kræves iflg. gældende dansk lovgivning om sikring af kulturværdier i danmark. foreligger en sådan ikke, vil dette blive meddelt den udenlandske køber umiddelbart efter hammerslaget. derefter vil bruun rasmussen igen ansøge kulturværdiudvalget på købers vegne, nu hvor prisen kendes. Gives eksporttilladelse ikke, er kulturværdiudvalget forpligtet til at overtage det købte til den opnåede pris, hvilket betyder at købet bliver hævet for køber. 10. BesKriVeLse af emner Alt sælges i den stand, hvori det ved hammerslaget er at forefinde og som beskrevet i katalog eller hjemmeside med senere offentliggjorte ændringer og modifikationer. beskrivelsen er foretaget efter bedste overbevisning og under anvendelse af de anførte katalogiseringsprincipper. de solgte effekter er ofte af en alder eller af en art, der bevirker, at de kan være behæftet med fejl, mangler, restaurering eller beskadigelser, der ikke nødvendigvis angives i katalog eller på hjemmesiden. Afbildninger i katalog eller på hjemmesiden er blot til identifikation og kan ikke anvendes til vurdering af effekternes stand. enhver der ønsker at byde på auktion, bør derfor ved selvsyn på de før auktionen afholdte eftersyn forvisse sig om de ønskede effekters stand. beskrivelsen er udtryk for den på salgstidspunktet blandt lærde og eksperter herskende opfattelse. Skulle der efter købet opstå tvivl om det købtes ægthed eller dettes overensstemmelse med beskrivelsen, skal dette straks meddeles til bruun rasmussen. Såfremt det må erkendes, at det købte er en forfalskning, eller såfremt beskrivelsen har været behæftet med væsentlige fejl, der har medført en væsentlig højere hammerslagspris, end en korrekt beskrivelse må antages at ville have resulteret i, er køber berettiget til at annullere købet, hvorefter den samlede erlagte købesum tillagt auktionsomkostninger og evt. moms, vil blive refunderet køber. væsentlige fejl i beskrivelsen relateret til mål eller vægt erstattes kun procentuelt i forhold til differencen. retten til under de her anførte betingelser at annullere et køb kan kun udøves af den, der købte den pågældende effekt hos bruun rasmussen og er betinget af, at krav om annullering fremsættes skriftligt over for bruun rasmussen inden 2 år efter købsdagen, og af at det købte inden samme frist returneres til bruun rasmussen i den samme stand i enhver henseende, som det købte var i på hammerslagstidspunktet. køber kan i tilfælde af annullering ikke gøre krav på betaling af renter af købesummen og er ej heller berettiget til at kræve anden udgift eller tab, herunder eventuel mistet videresalgsfortjeneste, dækket. et køb kan ikke kræves annulleret efter ovenstående bestemmelser, såfremt: a. beskrivelsen i katalog eller på hjemmesiden på hammerslagsdagen var i overensstemmelse med den på dette tidspunkt gældende opfattelse blandt lærde og eksperter. b. den eneste måde til på salgstidspunktet at få fastslået et falskneri var iværksættelsen af videnskabelige processer, hvis gyldighed først blev anerkendt efter salgstidspunktet, eller som ville have været uforholdsmæssigt omkostningskrævende eller uigennemførlige uden beskadigelse af den pågældende effekt. I tillæg til ovenstående frist gælder de almindelige forældelsesregler i forældelsesloven, efter hvilke køber ikke under nogen omstændigheder kan gøre noget krav gældende over for bruun rasmussen, når der er forløbet mere end 5 år fra købsdagen. 181 COndiT i O ns OF P urc hase 1. BiddinG The buyer shall be the highest bidder at the hammer price. Any person bidding on behalf of a third party shall be liable in surety for completion of the sale. At the request of bruun rasmussen kunstauktioner (hereinafter called bruun rasmussen), all bidders, whether they wish to make bids in person at the place of auction or commission bids by letter, fax or the homepage direct telephone bids or the homepage, should be able to document their ability to pay and be able to provide proof of identity at any time. bruun rasmussen is entitled to refuse to accept a bid if, when requested, adequate security or adequate payment on account has not been rendered. bids should be made by the bidder in person at the place of auction or by written commission by letter, fax or the homepage. for online auctions alle bids are submitted via the homepage. Telephone bidding is possible within certain conditions made out by bruun rasmussen. bruun rasmussen is not to be held responsible for any errors that may occur using this service. The auctioneer shall have absolute discretion as to the increment of the bids. The auctioneer will also make decisions in all cases of doubt regarding the bidding. credit/debit card information must be registered with bruun Rasmussen before bids can be submitted. 2. PayMenT Purchases made at all bruun rasmussen online auctions are subject to a 25% fee, which covers 20% buyer s premium and vat of the premium. Purchases made at all bruun rasmussen traditional salesroom auctions are subject to a 30% fee (for wines, coins and stamps 25%), which covers 24% buyer s premium plus vat of the premium. certain lots are sold in accordance with specific rules on normal vat arrangement (hereinafter called normal vat), so that the purchase price is the hammer price plus an additional 24% (for online auctions, wines, coins and stamps 20%) in buyer s premium and vat of 25% levied on both the hammer price and the buyer s premium. The lots subject to full vat are indicated as such in the catalogue and on the homepage with an asterisk (*). danish vat registered buyers shall provide bruun rasmussen with documentation of their Se-/cvr -number (vat No.) as this has to be quoted on the invoice for goods bought at full vat. for some foreign buyers, specific vat-exemption rules apply (cf. Article 3). vat-exemption does not apply to private buyers from the EU who are considered as danish buyers (cf. current danish legislation on Special vat Scheme for Sales of works of Art, collectors items and Antiques by Public Auction). The purchase price falls due for payment when the goods have been knocked down. Payment may be made in cash up to dkk 50,000, by dankort, banker s cheque, traveller s cheque, visa-, master-, diners club- or eurocard. Personal foreign cheques may only be used for payment by prior arrangement. Payment may be made during or immediately after the auction. under all circumstances payment must be made no later than eight days from the date of the invoice. with online auctions, payment takes place when the items are prepared for dispatch (circa 12 hours after the purchase has been made) using the banking details (credit/debit card and bank account) submitted by the purchaser. At the same time an invoice and dispatch information will be sent to the purchaser. Should the purchase price not be paid by the due date, interest at 1.5 % per new month will be charged. If the purchase price and interest are not paid within eight days after bruun rasmussen has sent its demand to the buyer, bruun rasmussen shall be entitled to rescind the sale and resell the goods at a bruun rasmussen auction or privately, and to demand reimbursement of any related losses from the defaulting buyer. Any further profit on the sale shall be payable to the person who had deposited the goods for sale by auction. If the defaulting buyer is entitled to proceeds from a sale of goods by bruun rasmussen, bruun rasmussen shall be entitled to set off its receivables against its payables to the defaulting buyer. If the defaulting buyer has deposited other goods for sale, bruun rasmussen shall be entitled to sell such goods at a bruun rasmussen auction without being bound by the reserve stipulated by the defaulting buyer. The defautling buyer shall not be entitled to demand the surrender of goods deposited for sale as long as the debt payable to bruun rasmussen has not been discharged, regardless of whether the value of such goods may be deemed to exceed the debt payable. bruun rasmussen shall be entitled to refuse a bid made by a buyer who is in default in respect to his payment obligations to bruun rasmussen, as well as a bid made by a third party on behalf of such a defaulting buyer. bruun rasmussen shall further be entitled to demand a deposit as a condition of accepting any future bids from such a purchaserr. 3. MOney-BaCK GuaranTee Online purchase of items by private individuals is subject to danish consumer law, which extends 14 days of money-back guarantee. COLLeCTiOn OF PurChases The purchase price must be paid in full before the purchased lot can be passed over to the buyer. from the time of the lot being knocked down to the buyer, until its collection, the purchased lot will be held at the buyer s own expense and risk. A storage fee will be charged for lots which have not been collected according to agreement. lots which have been paid for but not collected will be storaged at buyers expense. lots not collected within 1 year will be resold at auction or privately at the buyer s expense. 7. dispatch Should bruun rasmussen undertake the packaging and forwarding of purchased goods, this shall be done at the buyer s own expense and risk. bruun rasmussen shall thus not be held liable neither for any damage caused to purchased goods during dispatch nor for any missing consignments. 8. droit de suite In accordance with danish copyright law, an additional royalty fee is to be paid for the purchase of works by contemporary danish artist and some international artists who are either still alive or who have been dead for less than 70 years. Another application will subsequently be sent to the danish cultural Assets committee by bruun rasmussen on behalf of the buyer, now that the price is known. Should an export licence not be granted, the danish cultural Assets committee would be obliged to acquire the purchased lot at the purchase price, and the buyer would thus not be bound to the purchase. 10. description OF LOTs All lots are sold in the condition in which they are found when knocked down and as described in the catalogue and on the homepage with subsequently published changes and modifications. description is done according to the best of bruun rasmussen s knowledge and on the cataloguing principles stated. The lots auctioned are often of some age or of a kind which makes it possible that they may contain defects, deficiencies, or may have been subject to restoration or damage not necessarily stated in the catalogue and on the homepage. Pictures are for identification only and cannot be used for an evaluation of the condition of the goods. Any person who wishes to bid at an auction should therefore satisfy himself of the condition of the lots for which he intends to bid by personal inspection at the preview held prior to the auction. The description is an indication of the prevailing opinion of scholars and expert at the time of the sale. If any doubts should arise after the purchase regarding the genuineness of the purchased lot or its conformance with the description, bruun rasmussen should immediately be informed thereof.
