Hvorfor vedligeholdes? Krav i direktivet - State of art I direktivet: Bilag II Indledende bemærkninger. a) Der skal tages hensyn til den tekniske viden, som kan udvikle sig hurtigt, og den skal hurtigst muligt tages i anvendelse. Afsnit 1.2.1 Materiel skal konstrueres og fremstilles under hensyn til den tekniske udvikling, således det kan fungere sikkert under hele den forventede levetid.
Harmoniseret standarder Harmoniseret standarder giver formodningsret om, at de Væsentligste Sikkerhedsmæssige Krav (eng. EHSR) er opfyldt, (for materiel, der er omfattet af scopet i standarderne). Hvad skal man gøre? se ExNB/09/347/CS Equipment certified to earlier standards where there is only minor and editorial changes, not considered to be a relevant modification to state of the art. 1. Minor and editorial changes: Clarification Decrease of technical requirements Minor technical change Editorial corrections Case 1: The manufacturer continues to use his existing certificate. It is still considered to demonstrate compliance with the EHSRs of the Directive. The EC Type Examination Certificate and the marking of equipment are not modified. it is necessary for the manufacturer to record the correct (changed) status of the standards in his Declaration of Conformity. Justification for fulfilling the EHSR is required.
ExNB/09/347/CS Equipment certified to earlier standards where there is extension of requirement considered to be a relevant modification to state of the art. 1. Extension: Addition of technical options These are changes which add new or modify existing technical requirements, in a way that new options are given, but without increasing requirements for equipment that was fully compliant with the previous standard. Therefore, these will not have to be considered for products in conformity with the preceding edition. Case2 a: The manufacturer can continue to use the existing EC- Type Examination Certificate without modification as the basis for a Declaration of Conformity, because the extension of requirement do not contract the former requirement but provide additional options.
ExNB/09/347/CS Case 2 b: If conformity with the extension of requirement is presumed, the manufacturer engages a Notified Body to carry out all examination and tests according to the revised standards which are different from the standards mentioned on the existing EC-Type Examination Certificate. Upon confirming compliance, the Notified Body issues a statement or supplement to the existing EC-Type Examination Certificate, confirming compliance with the new harmonized standards. The marking may change from EEx to Ex. The EC declaration of conformity, the instructions and the marking are updated to show compliance with the new harmonized standards.
ExNB/09/347/CS Case 3: Equipment certified to earlier standards where there is substantial change regarding EHSR s considered to be a substantial relevant modification to state of the art. 1. Major technical changes: addition of technical requirements increase of technical requirements These are changes to technical requirements (addition, increase of the level or removal) made in a way that a product in conformity with the preceding edition will not always be able to fulfil the requirements given in the later edition. These changes have to be considered for products in conformity with the preceding edition. For these changes additional information is provided in clause B) below. Note These changes represent current technological knowledge. However, these changes should not normally have an influence on equipment already placed on the market.

The manufacturer engages a Notified Body to carry out all examination and tests according to the revised standards which are different from the standards mentioned on the existing EC-Type Examination Certificate. Upon confirming compliance, the Notified Body issues a supplement to the existing or a new EC-Type Examination Certificate, confirming compliance with the new harmonized standards. The EC Declaration of Conformity, the instructions and the marking shall be updated to refer only to the new standards and the new EC-Type Examination Certificate.
Bud på en tekst i overensstemmelseserklæringen: For example, when the EN 60079-0:2006 is mentioned in the EC declaration of conformity the following statement may be used in addition: A review against EN 60079-0:2009, shows no changes relevant to this equipment. The equipment designed in accordance with EN 60079-0:2006 continues to be in compliance with the EHSR of the ATEX Directive 94/9/EC.
