7 velkommen Da Bruun Rasmussen Kunstauktioner for få år siden besluttede at sætte mere fokus på våben, blev det mødt med en del skepsis i branchen. Mange var i tvivl om, hvorvidt danskere overhovedet var interesserede i at købe og sælge våben på auktion. Denne skepsis har i dag vist sig at være uberettiget, for på våbenauktionen i december har vi fornøjelsen af at kunne udbyde et meget stort antal eksklusive jagtvåben og antikke våben fra hele verden. Blandt de antikke våben præsenterer vi en udsøgt hirschfænger i sølv og elfenben udført af zarens våbensmed i Sankt Petersborg. Desuden er der et par fine pistoler i kasse fra Lepage a Paris samt et fornemt udvalg af militære våben herunder en uhyre sjælden underofficersriffel af N. Løbnitz med tilhørende bajonet, der kun er fremstillet i ca. 30 eksemplarer. Udover fine flintlåsgeværer og pistoler af H. Kappel udbydes også et par tidlige hjullåsgeværer, der formentlig er udført i Tyskland. Engelske jagtvåben er også rigt repræsenteret. Herfra skal særligt nævnes fire sæt parbøsser, alle fra nogle af de bedste producenter i London. Det første sæt stammer fra Thomas Boss, er sjældent udbudt og har såkaldt round body action. To af sættene er singletriggers fra Holland & Holland, mens det fjerde sæt er fra Watson Brothers. Dertil kommer flere engelske våben bl.a. en sjælden pinless Churchill O/U. Fra Orienten kan vi præsentere et fint udvalg af osmanniske og kaukasiske dolke og sværd udført i fornemt sølvarbejde, hvor nogle er besat med røde koraller. Ligeledes vil man i den japanske afdeling kunne finde et fint udvalg af sværd fra det århundrede. Vi glæder os til at byde Dem velkommen til våbenauktion i Bredgade den 14. december 2006.

8 For further information and english translations please visit: A fine French Officers Sabre for the Guard of Paris c with a gilted brass hilt with rich decorations, decorated with the City Arms of Paris and text: VAINCER.OU MOURIR - Victory or death! The fine pommel is in the form of an antique warriors helmet with a lions head decoration at the front and the wire in the grip is fine. The 73 cm. long single edged blade with a single fuller is decorated with some slight scroll on the upper part. Total length 92 cm. Blankvåbentilladelse påkrævet Russian officers sabre with a German type lion pommeled brass hilt with the crossed cannons in silver on the langet indicating use by a high ranking officer of artillery, The open mouthed lion with red stone eyes swallows the knuckle bow. The back strap is decorated with cast flowers and the guard ends in a lioness or panthers head. The 78 cm. long single edged blade with a double fuller carries the crowned cypher of Nicolai II on one side and the crowned double headed Russian eagle on the other with a few Russian letters on the back. The sabre is in a traditional Russian schaska scabbard wrapped in black leather with 3 brass mounts. Total length in scabbard 93.5 cm. 9 online weapon auctions every fourth tuesday of the month at A British pattern 1796 infantry officers sword with a blade by J. J. Runkel in Solingen. The gilt on the brass hilt is still present to a large degree and the silver thread binding is fine but is a little loose. The 82,5 cm. long blade bear the royal cypher of George III on one side and the garter on the other. John Runkel was a major importer of German blades for the British Army during the Napoleonic Wars and this sword is of better than usual quality. Blankvåbentilladelse påkrævet A pair of good quality Belgian iron mounted target-pistols by Lassence-Ronge a Liege c with gothic half stocks, flat lock plates laid flute with the stock and marked LASSENCE-RONGE A LIEGE held to the stocks with a single screw. The 25 cm. long octagonal barrels in twist damask is marked DAMAS TURC in silver and have fixed back sights and adjustable fore sights. The calibre of the barrels are c. 14 mm. The butt caps, trigger guards, hammers and barrel tangs are engraved with simple scroll. The stocks are good with normal use marks BRUUN RASMUSSEN weapon AUCTION 767 7

Stålfæste med nedadbøjet parerplade dekoreret med liggende hjort. Parerstang med bukkefødder samt flad knap med to hunde. Hvidt bengreb med udskåret ørn. Tveægget klinge med bred hulslibning og ætsede dekorationer og skriftbånd med: J.Herazcek i Kiøbenhavn. Længde 64 cm. klinge 54,5 cm. Blankvåbentilladelse påkrævet Dansk landkadetsabel M/1802 i skede med stort nederste skedebeslag og mindre øverste beslag - begge stregdekorerede. fæstet har godt ibenholtgreb og den ene af de to hjerteformede skedefjedre er mærket FJ i skriveskrift. De små kolbekapper er som resten af messingen fint eftergraverede med rocailler, aftrækkerbøjlerne når ned til kolbekapperne, låseblikkene er hvælvede og skåret med bladranker bag hanerne og mærkede DAVID METZGER A RENDSBURG i 3 linier, de 21 cm. lange piber er skåret om krudtkammeret og har flade rygge forsynede med indstilleligt sigtekorn og kærv på svansskruebladene. Skæfterne er fornemt skåret med bladranker om svansskruebladene og bag spidsrørkerne. Pistolerne er perkussionerede med påskruede knaster og hanerne dekorerede med vilddyr. Pistolerne er af fin kvalitet og låsene går stramt og præcist. David Metzger ? arbejdede i Rendsborg fra ca Et par fuldskæftede messingmonterede danske officerspistoler med ringhane af J.C. Haugaard. ca Skæfterne i nøddetræ med husariske kolber er lig dansk ringhanepistol M/1848 Liege, mens de fulde forskæfter viser tilbage til ældre pistoler. De flade låseblikke er mærkede J.C.HAUGAARD KJØBENHAVN. De små sideblikke for den enkelte skrue, der fastholder piben til skæftet har nærmest karakter af underlagsskiver. Pistolerne har flade ringhaner uden dekoration og de bagtil ottekantede fortil runde piber i kaliber c. 16,5 mm. er ca. 23,5 cm. lange - mærket henholdsvis 1 og 2 på svansskruebladet - og fastholdt til piberne med engelsk skyder i messing. Den ene påloddede knast er fornyet og det samme gælder den ene stålladestok. Kolben på nr. 2 flækket ved låsen og har ilagt lus samme sted. Pistolerne er med al sandsynlighed et par private officerspistoler for en officer ved et af kavalleriregimenterne. Kalibret er en anelse for lille til at anvende de reglementerede patroner, hvad der må have voldt officeren problemer! Jens Christian Haugaard ( ) var bl. a. bøssemager ved Københavns Tøjhus og i 1838 regimentbøssemager ved 1. Jydske Infanteriregiment. 12 For further information and english translations please visit: A North Indian or Afghani Pesh-Kabz or as it is also called a Karud dagger with a thick hilt in horn, c. 24 cm. long blade with a pronounced T spine tapering to an acute tip. The wooden scabbard is covered with well preserved black leather and ends in a large steel mount. The grip is in classical "I" shape which is typical to the Kurds Jambiya. The scabbard is wood covered with heavy silver with filigree work. Blankvåbentilladelse påkrævet A Jambiya dagger properly from Kurdistan with a good c. 19 cm. long curved double edged wootz? blade with pronounced middle rib. The rather thick grip is in classical "I" shape which is typical of the Kurds Jambiya. The scabbard is wood covered with leather and have two iron mounts decorated in silver. 13 online weapon auctions every fourth tuesday of the month at A large good quality Ottoman kindjal dagger early 19th century with a grip in gilded silver set with corals on three sides, a c. 44 cm. long tapering double edged blade with two fullers on each side slightly decorated with silver koftgari work by the ricasso. The scabbard in pressed silver sheet decorated with flowers and scroll is set with corals at the top and bottom on one side. Total length 67 cm. Blankvåbentilladelse påkrævet A short Indian Tulwar with a hilt decorated with gold. The small iron hilt of classical form is almost completely covered with gilded decorations in the form of flowers. The 58 cm. long bright blade with yelman is quite light and flexible. The wooden scabbard is covered with blue cloth decorated with gold-woven ornaments. Total length 70 cm. 15 online weapon auctions every fourth tuesday of the month at A Passau rapier c with a good broad blade marked with the running wolf mark of Passau - the famous German centre for producing swords. The hilt confirms to A. V. B. Norman's type 43 and has a pair of quillions supporting a side-ring and arms for the smaller side-ring. The pommmel is almost round and the binding on the grip is in twisted and plaited iron. The good double edged blade tapering to an acute point is almost 93,5 cm. long with a deep fuller on the upper quarter. The fuller is marked with the running wolf mark on both sides and the ricasso has two identical marks. The sword is in very good condition with a some what pitted cleaned blade. A rare 12-bore "Premiere" single trigger over and under pinless sidelock ejector gun no inch sleeved barrels with 2 3/4 inch chambers and ca. full choke borings. The lightly -bolstered action with carved fences, pinless lockplates, gold inlaid cocking indicators, non-selective single trigger, double rolled-over triggerguard. Profusely engraved with fine scrollwork and "THE PREMIERE QUALITY" inlaid in gold on the underside. Retaining much case colour hardening and finish. 15 inch wellfigured stock with pistol grip, semi-monte carlo comb and engraved steel pistol grip cap and with 7/8 inch rubber recoil pad. Blankvåbentilladelse påkrævet A good German brass mounted flint lock hunting pistol by Wass in Bamberg with a pronounced curved butt and a butt cap decorated with the bust of an antique warrior and military trophies. The two-stage 37 cm. long barrels in calibre c. 13 mm. Rifled barrels with the original browning is marked WASS IN BAMBERG in silver and the number 2 on the tang. The fine dark brown stock is carved around the metal and ends in horn like the wooden ramrod with a bullet screw A fine brass mounted hunting flint lock pistol by Johan Jacob Kuchenreuter c.1740 with a curved butt. The butt cap is excellent and decorated with an antique warrior standing on military trophies beneath a good grotesque mask. The butt has a crowned blank escutcheon with flags and drums. The sheet side plate is carved with deer and dogs and the trigger guard ending in a flowerpot has a good figure of a hunter with his gun. The flat lock plate is signed JOH. JAC. KUCHENREUTER in four lines behind the hammer and is finely carved with a resting hunter and his dog. The damask barrel with a flat back and a silver adjustable fore sight is 29 cm. long. The stock ends in horn like the ramrod and has been restored. The fore stock has been expertly replaced and a 5.5 cm. long shiver of wood is replaced in front of the lock and another by the front screw. Johann Jacob Kuchenreuter worked in Steinweg as court gunmaker to the von Thurn und Taxis family A fine Austrian flint lock hunting pistol by Caspar Zellner in Wienn with cast and gilded? brass mounts. The butt cap has a good grotesque mask and decorated like the rest of the mounts with hunting scenes. The butt has a pronounced curve and the flat lock plate is carved with mounted warriors in battle and signed CASPER ZELLNER beneath the pan and IN WIENN behind the hammer. The 28,5 cm. long barrel with a flat back is Turkish with a mark in gold and leaves in silver above the powder chamber. The side plate is decorated with hounds and game, while the trigger guard has a shooting match scene. The light brown walnut stock ends like the wooden ramrod in horn and is carved around the metal. The boldt with side safety catch, magazine with hinged baseplate, recoil stud, the half length highly-figured stock with pistol grip and trap including a spare front sight, cheeck piece and rubber recoil pad sling eyes and 13 inch pull. 26 For further information and english translations please visit: A fine Ottoman silver hilted jambya in a silver scabbard. The "I" shaped black wooden grip is lined with 6 bands of silver between to rings of niello inlaid silver decorated with flowers. The 28 cm. long slightly curved double edged blade is in Turkish wootz and the wooden scabbard is completely covered with thick engraved silver plates decorated with flowers on a niello background and with 2 medallions showing an Ottoman town on one side and military motifs beneath a sunburst on the other. Blankvåbentilladelse påkrævet A good 19th century or earlier Kard knife from Turkmenistan with a Rhino? hilt decorated by the blade with turquoise set in silver. The fine single edged blade is c. 20,5 cm. long and the wooden scabbard covered in red velvet has two large mounts in silver pressed with flowers - the upper mounts is ringed by turquoise like the grip. 27 online weapon auctions every fourth tuesday of the month at A brass mounted Flint lock pistol with a barrel by Giovanni Battista Francino and a lock "alla fiorentina" signed Carlo Fondrino in Brescia on the rim. The pistol has been restocked in the middle east and has a small brass butt cap, a rather crude trigger guard and side plate in sheet carved with sparse scroll. The lock is fine and typical of early 17th century Italian type finely carved with flowers and scroll with a plain middle part. The hammer is excellent with carved monsters and scroll. The two stage 34,5 cm. long barrel marked Gio. Batt. Francino has a fluted back part and a round plain fore part with no sight. The dark brown polished stock is carved around the metal and ends in brass. Giovanni Battista Francino worked in the Gardone Val Trompia Brescia and is considered as on of the bast makers of the large Francino family. Carlo Fondrino c worked - like the Francino family - in Brescia A good silvermounted flint lock pistol marked Janzig on the barrel and a Forcheim on the lock. The butt cap in heavy silver has a carved rather naive grotesque mask. The butt has an escutcheon of military trophy type and a decoration of flowers in silver thread and brass flowers. The same type of decoration is on the lower part of the forestock. The flat banana shaped lock with a fine steel carved grotesque mask behind the hammer is marked A. FORCHEIM. The solid silver sideplate has a leaves decoration at both ends and the triggerguard final is a variation of the flowerpot type. The 34 cm. barrel in calibre 15.5 mm. is carved above the powder chamber and held to the full stock by silver wire. There is no provision for a ramrod. This pistol might or might not have been sent to the near eastern market as it is, but was probably restocked there by an expert craftman, as all silver mounts carries Ottoman marks and the decoration is definitely not Germanic in type. 36 For further information and english translations please visit: An extremely fine and rare European early 18th century iron mounted hunting gun with a French stock with chin rest completely covered with bone inlays in the form of animals, scrolls and pellets all sitting within segmental lines and bone bands. On the left side near the butt cap is a hunter with his gun. The bone decoration continues in front of the flat lock-plate until the rear ramrod pine. The 110 cm. long round barrel with a flat back has pointilistic engravings on its entire surface in the form of flowers scrolls and leaves with the same decorations on the butt cap, side-plate and trigger-guard. Underneath the barrel is latched a 58 cm. long bayonet with a flat head c. 16 cm. long and a round rod intended for hunting wild boar. The bayonet is not connected to a spring and needs to be pulled by the hand. Because of the bayonet the ramrod is placed on the left hand side of the fore-stock and is held by 3 ramrod pipes. The leave decorated butt caps are large and the butts have unfilled crowned escutcheons. The banana shaped locks are flat and signed M. DELINCE. The fine sideplate are pierced and decorated with leaves. The two flat-topped smooth bored barrels are c. 31,5 cm. long i calibre c. 14 mm stamped three times with the royal emblem of protection and strength - the rampant lion in brass as well as MD. The brass tipped ramrods are held to the stock by 2 octagonal ramrod pipes and the stocks are finely carved behind the back pipes and by the tangs. The two barrels are fired by only one lock and one alternates between the barrels by means of a sliding pan. Because of this the pistols are surprisingly light and can easily be carried or used. This method of obtaining a second shot is quite rare and these pistols are well preserved. The maker M. The lock is round and slightly banana shaped with a punched decoration along the edge. The hammer screw has a fine carved head and is held to the lock with a nut from the inside. Both barrel and lock are unsigned An 18th century wheel lock hunting gun for a child with a classical German stock inlaid with bone around the edges and decorated with a squirrel on the butt. The patch-lock cover in bone is decorated with a dragon and the lock with rounded wheel cover is plain. The two stage barrel is c. 79 cm. long in calibre c. 16,5 mm. The fore stock is decorated with a few round pieces of bone and the stock ends in carved bone. The bone tipped ramrod is newer and held to the stock without ramrod pipes A fine german short sporting wheellock gun dated 1672 on the octagonal slightly swamped barrel with a blade fore-sight and a standard rear-sight. The flat lockplate in bright iron has a brass wheelcover decorated with raised leaves covering the external wheel. The sliding pan cover is operated by a small button in the shape of a maltese cross and the rather large hammer is operated by a decorated spring. The barrel is marked PW (Stockel 4395) and dated The full stock in varnished wood is inlaid with a stag on the butt and is lined by strips of bone. The cased set was bought by the royal Danish envoy M. C. J. T Clan in Russia just after the revolution in 1917 and has been in the property of the same family since then. The half stocked pistols are iron mounted and carved with fine oak leaves round the butt-plate. The butts are finely chequered and the half stocks ends in good wood carved mussel shells. The flat locks laid flute with the stock are marked LE PAGE A PARIS in gold and decorated with military trophies behind the lock, some slight scroll at the front and lightning bolts in front of the hammers. The hammers are flat with carved eagles heads and thunderbolts. The spurred trigger guard finals are decorated with a knight's helmet and the guards have finely executed military trophies. The highly polished walnut stock of the pistol marked 1 is marked 3135 on the inside and the same number can be found beneath both barrels. The browned tip-up octagonal rifled barrels in twist damask in calibre 13 mm. are 23,2 cm. long and marked LE PAGE ARQer DU ROI in gold as well as either 1 or 2 - also in gold. The patent breeches have platinum bushed vents and the adjustable fore sights are in German silver. The case is in highly figured hazel wood is framed with brass and lined with now faded velvet in good condition. In the case a bullet mould also marked number 3135, an iron octagonal oil flask, a small brass powder measure, a cleaning rod, an iron ramrod and a fine hardwood hammer. The case also have two empty compartments for bullets and percussion caps. The screw driver and powder flask are missing. These fine set trigger pistols are the work of (Jean André Prosper) Henry Lepage ( ), who took over his father's (Jean Lepage) business in 1822 and worked at gunmaker to the French court under 3 kings - Louis XVIII, Charles X and Louis Philippe. The part of the hilt which extend onto the blade is in filigree work and the blade has an inscription in 4 boxes between decorations - proably from the Koran. The part of the hilt which extend onto the blade is in filigree work. The hilt has been repaired with pewter and 5 of the corals have been replaced in the same material. Blankvåbentilladelse påkrævet A good Malayan 3,5 cm. calibre Lantaka cannon on a stand. The lenght is c. 104 cm. making this one of the larger swivel guns made in Malaya after a 16th century Portuguese model with a tube at the breech by which to train the gun. The triangular decoration with leaves are native and the cannon have no swivel and pin. They were used in Borneo as one of the principal forms of wealth and as currency. This cannon seems never to have been bored through and can for this reason not be used as a gun A good Indian chain mail shirt and a Kulah Khud helmet. The riveted chain is thicker at the shoulders and arms than at the legs, where the rings are small and fine. The breast and back are protected by plate - the two front plates are engraved with native writings and have rings for attachment. For similar chain shirts see H. The bulbous butt shows the guns late 17th century date and so does the extremely long barrel, which is almost 128 cm. long in calibre c. 18 mm. The good stack is slightly carved around the trigger guard, the tang and the back ramrod pipe. The bright lock-plate is signed H.KAPPELL KOBENHAGEN and has a sliding safety. The swan-necked hammer has a fine and sparse steel cut scroll and the battery has a pronounced "bomb".the raised side plate is a double S with slight decoration. The four stage barrel has an octagonal back, a fluted part in front and two round parts divided by a ring. On the barrel a large V type back sight and a small bead fore sight in silver. The barrel has been cleaned and has a somewhat pitted appearance. The long ramrod with a thread for a bullet screw is held by three round iron pipes. Henrich Kappel worked as a gunmaker in Copenhagen and became gunmaker to the Danish Court in 1699 and many of the guns in the Royal collection are by him. He is considered as one of the best 17th century gunmakers in Europe with many guns in the best collections. The silver pommel is in the shape of a crown and the solid silver quillion is cast with a wolf at one end and a tiger? on the other with the head of a wild boar in the middle. The backside has the traditional oak and acorn design. The bright double edged blade with 3 deep fullers is c. 44 cm. long and ends in an acute point. On the front of the blade the Russian imperial coat of arms with the double headed eagle and Saint George The Victor in the centre. On the other side the name J. LADERET ARQer DE L'EMPEREUR A ST PETER- BOURG. The impressive balck leather covered scabbard has two fine cast silver mounts. The upper is lined with oak leaves and has a dogs head frog button and a left turned grouse beneath a bush. The lower mount is also lined with oak leaves and has a raised bear's head over a gun and hunting spear with a horn and powder flask beneath. The workmanship is impressive as one would expect from a gunmaker to the Russian imperial house, but not much is know of Jean Laderet, who worked as gunmaker to the czars in St. Petersburg c He probably originated from Liege or St. Etienne in France? Russian imperial hunting weapons were of the highest quality as could be seen from the fine exhibition held at the Danish Forestry and Hunting Museum in The czars Nicholas I and Alexander II both took a keen interest in hunting and this resulted in the production of the finest quality weapons made anywhere in the world in the later part of the 19th century - this superb hunting hanger belongs to these. The wooden ramrod ends in horn and is held to the stock with two octagonal ramrod pipes decorated with gilded flowers. The highly figured stock is carved around the metal and has at one time been cracked before the lock, but has been professionally repaired. At one time this pistol was very flashy with probably blue metal with the gilded decorations standing proud. Today the metal is in the grey and the gilt missing on perhaps 40 per cent of the surface, but the pistol is still fine and very interesting A pair of English saw handle half stocked target or duelling percussion by Drury & Wilde with cross hatched butts, a lock with sliding safety laid flute with the stock and decorated with fine foliate as is the flat hammer. The octagonal barrels are c. 23,5 cm. long and smooth bored. The thin chob of the butt has a chinrest in leather, stuffed with horse hair. The round lock with a brass pan is faintly marked MIC?? PYI?D A S?OHC?NNC? a name not found in Stöckel. The two-stage barrel is c. 83 cm. long with a slender ramrod in wood tipped with horn and held to the barrel with two pipes. Beneath the barrel is a mark with leaves and A C (Stöckel St. Etienne) as well as TORDU. With the gun is a small bayonet with a c. 8 cm. long blade and a zig-zag holding it to the barrel. The bayonet, when not in use, is kept in the butt behind the butt plate, covered by a small hinged plate. The metal is all salt and pepper, and the gun has seen much use as the carved roses behind the barrel tang and behind the back ramrod pipe is quite soft. Any person bidding on behalf of a third party shall be liable in surety for completion of the sale. At the request of Bruun Rasmussen Kunstauktioner (hereinafter called Bruun Rasmussen), all bidders, whether they wish to make bids in person at the place of auction or commission bids by letter or fax or direct telephone bids, should be able to document their ability to pay and be able to provide proof of identity at any time. Bruun Rasmussen is entitled to refuse to accept a bid if, when requested, adequate security or adequate payment on account has not been rendered. Bids should be made by the bidder in person at the place of auction or by written commission. Telephone bidding is possible within certain conditions made out by Bruun Rasmussen. Bruun Rasmussen is not to be held responsible for any errors that may occur using this service. The auctioneer shall have absolute discretion as to the increment of the bids. The auctioneer will also make decisions in all cases of doubt regarding the bidding. 2. Payment The purchase price is the hammer price plus 25% in buyer s premium, including VAT, for lots sold subject to the special VAT scheme for sales of Works of Art, Collectors items and Antiques, and secondhand goods by Public Auction (hereinafter called Special VAT). Certain lots are sold in accordance with specific rules on normal VAT arrangement (hereinafter called normal VAT), so that the purchase price is the hammer price plus an additional 20% in buyer s premium and VAT of 25% levied on both the hammer price and the buyer s premium. The lots subject to Full VAT are indicated as such in the catalogue with an asterix (*). Danish VAT registered buyers shall provide us with documentation of their SE-/CVR-number (VAT No.) as this has to be quoted on the invoice for goods bought at full VAT. For some foreign buyers, specific VAT-exemption rules apply (cf. Article 3). VAT-exemption does not apply to private buyers from the EU who are considered as Danish buyers (cf. current Danish legislation on Special VAT Scheme for Sales of Works of Art, Collectors items and Antiques by Public Auction). The purchase price falls due for payment when the goods have been knocked down. Payment may be made in cash up to DKK 100,000, by Dankort, banker s cheque, traveller s cheque, Visa-, Master-, Diners Club- or Eurocard. Personal foreign cheques may only be used for payment by prior arrangement. Payment may be made during or immediately after the auction. Under all circumstances payment must be made no later than eight days from the date of the invoice. Should the purchase price not be paid by the due date, interest at 1.5 % per new month will be charged. If the purchase price and interest are not paid within eight days after Bruun Rasmussen has sent its demand to the buyer, Bruun Rasmussen shall be entitled to rescind the sale and resell the goods at a Bruun Rasmussen auction or privately, and to demand reimbursement of any related losses from the defaulting buyer. Any further profit on the sale shall be payable to the person who had deposited the goods for sale by auction. If the defaulting buyer is entitled to proceeds from a sale of goods by Bruun Rasmussen, Bruun Rasmussen shall be entitled to set off its receivables against its payables to the defaulting buyer. If the defaulting buyer has deposited other goods for sale, Bruun Rasmussen shall be entitled to sell such goods at a Bruun Rasmussen auction without being bound by the reserve stipulated by the defaulting buyer. The defautling buyer shall not be entitled to demand the surrender of goods deposited for sale as long as the debt payable to Bruun Rasmussen has not been discharged, regardless of whether the value of such goods may be deemed to exceed the debt payable. Bruun Rasmussen shall be entitled to refuse a bid made by a buyer who is in default in respect to his payment obligations to Bruun Rasmussen, as well as a bid made by a third party on behalf of such a defaulting buyer. Bruun Rasmussen shall further be entitled to demand a deposit as a condition of accepting any future bids from such a purchaser. 3. Exemption from VAT Foreign buyers who fulfil the conditions stated below shall pay 20% of the hammer price in buyer s premium and shall not be subject to Danish taxes and duties: A. Buyers residing in another EU Member State: Buyers are exempt from paying Danish VAT as long as they have provided Bruun Rasmussen with documentation of their VAT registration. The VAT number will then be quoted on Bruun Rasmussen s invoice. B. Buyers residing outside the EU: 1 Dispatch through forwarding agent: Lots exported through a forwarding agent approved by Bruun Rasmussen are exempt from VAT. 2 Export as personal luggage: Goods may be exempt from Danish VAT when the buyer personally takes the goods out of the country as luggage, provided the following conditions have been met: The invoice must have been paid and the Danish duty of 25% of the invoice amount must have been deposited with Bruun Rasmussen. a Buyers residing in Norway will be refunded the Danish VAT as soon as the invoice of sale has been returned to Bruun Rasmussen endorsed by the customs authorities of the country in question or by any other authority with jurisdiction over matters of purchase tax with respect to official imports of goods into the country in question if the purchase price exceeds DKK 1,200. b Buyers residing in other countries outside the EU will be refunded the Danish VAT after the goods have been presented for customs clearance in connection with the departure of the buyer from the EU. The exporter s form should be returned to Bruun Rasmussen after being endorsed with the customs authorities export certificate if the purchase price exceeds DKK 300 This also applies to the Faroe Islands and Greenland. 4. Payment of taxes and duties A. Buyers with VAT-registration in other EU member states who do not wish to make use of Article 3 may instead choose to purchase items subject to Special VAT/Normal VAT in the same manner as private buyers. Bruun Rasmussen must be notified of this before 10 a.m. on the following auction day. B. Buyers with VAT-registration in Denmark may choose to purchase subject to Normal VAT at 25% of the hammer price plus premium. Bruun Rasmussen must be notified of this before 10 a.m. on the following auction day. 5. Collection of purchases The purchase price must be paid in full before the purchased lot can be passed over to the buyer. From the time of the lot being knocked down to the buyer, until its collection, the purchased lot will be held at the buyer s own expense and risk. A storage fee will be charged for lots which have not been collected within 14 days after the time of the lot being knocked down. 141 6. Dispatch Should Bruun Rasmussen undertake the packaging and forwarding of purchased goods, this shall be done at the buyer s own expense and risk. Bruun Rasmussen shall thus not be held liable neither for any damage caused to purchased goods during dispatch nor for any missing consignments. 7. Droit de Suite Pursuant to current Danish legislation on Copyright, an artistic royalty shall be collected on works of modern art by all Danish and some foreign artists. Bruun Rasmussen will from the buyer collect the royalties required on behalf of the artists organisation Copy-Dan for any work of art subject to this law. These works are identified in the catalogue by for CD Copy-Dan, marked beside each relevant lot number. The artistic royalty will be calculated as follows for each work of art, when the hammerprice exceeds DKK 1,863: 5% of the part of the hammerprice ranging from DKK 0 to DKK 310,567 plus the buyer s premium (20% excl. VAT) 3% of the part of the hammerprice ranging from DKK 310,567 to DKK 1,242,267 plus the buyer s premium (20% excl. VAT) 1% of the part of the hammerprice ranging from DKK 1,242,267 to DKK 2,173,967 plus the buyer s premium (20% excl. VAT) 0.5% of the part of the hammerprice ranging from DKK 2,173,967 to DKK 3,105,667 plus the buyer s premium (20% excl. VAT) 0.25% of the part of the hammerprice lying above DKK 3,105,667 plus the buyer s premium (20% excl. VAT) The artistic royalty cannot exceed DKK 93,170 for each work of art. 8. Export licence Applications for an export licence must be made to the Danish Cultural Assets Committee when required in accordance with current Danish legislation on the protection and preservation of cultural assets in Denmark. Where such a licence has not been obtained, the foreign buyer will be informed thereof immediately after the lot has been knocked down to the buyer. Another application will subsequently be sent to the Danish Cultural Assets Committee by Bruun Rasmussen on behalf of the buyer, now that the price is known. Should an export licence not be granted, the Danish Cultural Assets Committee would be obliged to acquire the purchased lot at the purchase price, and the buyer would thus not be bound to the purchase. 9. Cataloguing All lots are sold in the condition in which they are found when knocked down and as described in the catalogue with subsequently published changes and modifications. Cataloguing is done according to the best of Bruun Rasmussen s knowledge and on the cataloguing principles stated. The lots auctioned are often of some age or of a kind which makes it possible that they may contain defects, deficiencies, or may have been subject to restoration or damage not necessarily stated in the catalogue. Catalogue pictures are for identification only and cannot be used for an evaluation of the condition of the goods. Any person who wishes to bid at an auction should therefore satisfy himself of the condition of the lots for which he intends to bid by personal inspection at the preview held prior to the auction. The catalogue description is an indication of the prevailing oppinion of scholars and expert at the time of the printing of the catalogue. If any doubts should arise after the purchase regarding the genuineness of the purchased lot or its conformance with the catalogue description, Bruun Rasmussen should immediately be informed thereof. Should the purchased lot be proved to be a forgery, or if the catalogue description contains material errors which lead to a considerably higher hammer price than that which a correct catalogue description would presumably result in, the * buyer shall be entitled to cancel the purchase, after which the buyer shall be reimbursed for the total purchase price paid, up till a maximum amount of the highest estimated price stated in the catalogue plus buyer's premium and VAT, when applicable. For material errors in the catalogue description in respect to measurements or weight, compensation shall only be paid on a percentage basis in proportion to the difference. The right of cancellation of a purchase in pursuance of the present conditions can only be exercised by the party who has bought the lot in question at Bruun Rasmussen and shall be subject to the presentation of a claim for cancellation in writing to Bruun Rasmussen within 2 years of the purchase date and to the purchased lot being returned to Bruun Rasmussen in the same condition in any and all respects which the purchased lot was in at the time of the lot being knocked down to the buyer. In the event of cancellation the buyer shall not be entitled to claim payment of interest on the purchase price nor shall the buyer be entitled to claim compensation for any other expenses or loss incurred, including any possible loss of profit in connection with reselling. It shall not be possible to state cancellation of a purchase in pursuance of the above provisions if: a the catalogue description on the day the lot was knocked down to the buyer was in accordance with the then generally accepted opinion of scholars and experts; b the only way of establishing whether the lot was a forgery at the time of the publication of the catalogue was the implementation of scientific processes, the validity of which was only acknowledged after the time of publication of the catalogue, or which would have required a disproportionate amount of cost, or which would have been impossible to carry out without damaging the lot in question.
