Compliance with hours of rest In order to avoid non-conformities and detentions at PSC, hours of work and rest must be thoroughly planned so that breaches are avoided. It is a good idea to follow the advice and regulations given below:
The table of shipboard working arrangements should be posted in a place that all crew members frequent/have easy access to. On ships with a 2 shift watch, for example a 5/7 watch system is recommended rather than a 6/6 watch system since some countries do not find it possible to comply with the regulations through 6/6 shift systems due to the time spent handing over duties.
The minimum safe manning document and the certificates/documents of the crew members prescribed will be thoroughly scrutinized. Be prepared to present these documents. The ship will be detained if the safe manning is not in accordance with the safe manning document.
According to some safe manning documents, the ship is permitted to have on board fewer crew members under certain conditions such as a rather small trading area/day voyages. The master must be able to give the PSC officer a precise account of these conditions.
If the ship has been approved for voyages with unmanned machinery spaces (UMS), the certificates/documents containing this permit must also be available at the PSC inspection. If the ship is of more than 3,000 kw, an engineer officer must also be on call when the ship is berthed (in case there is only one engineer officer on board, he must not disembark).
Records of hours of rest must be kept for all crew members. The record should be kept on a daily basis. The record is to be signed at least every month by the master and the relevant crew member and be handed over to him or her.
If the ship has been permitted by the Danish Maritime Authority to keep the records of hours of rest electronically, the permit must be available during the PSC inspection. The records are to be printed, signed and handed over at least once a month. All electronic hours of rest systems must have been approved by the Danish Maritime Authority.
Records of hours of rest must be filled in correctly and in accordance with the actual hours of rest. The recordings made in the records of hours of rest and the recordings made in the various ship logs must be in accordance with each other as well as with any recordings of overtime. Special attention must be paid to ensure that arrival/departure, pilot embarkation, drills, calling in standby personnel, machinery space controls, etc. are recorded correctly.
In addition to the requirement for a daily period of rest, attention must be paid to the requirement for the periods of rest during the recent seven days.
When planning the voyage, it must be ensured that the provisions on hours of rest are also observed during the first watches after departure. It must be possible to document this at a PSC inspection. This can, for example, be done by presenting a voyage plan where the time of departure has been set so that the provisions on hours of rest are observed during the subsequent watches. If the ship does not ensure this, it will be detained until the watch-keeping crew have been sufficiently rested.
It must be possible to document that crew members on call receive compensating hours of rest if they have been called in for a watch.
It must be evident from the records of hours of rest and the ship s log that a dedicated look-out has had the watch in accordance with the provisions of the STCW Convention, i.e. during the night, in reduced visibility, in dense traffic, etc. Denmark accepts that there is no dedicated look-out on board small fishing vessels and other rather small vessels where it is not possible to have a dedicated look-out such as vessels operated by one person. There is no guarantee that other countries will accept this Danish exemption.
There must be a procedure for what to do in case the provisions on hours of rest are breached. In case of breaches, the company must be informed. The company must subsequently take measures to prevent future breaches. It must be possible to present the procedure, the report to the company and any follow-up actions taken by the company at a PSC inspection. If this is not done, the ship risks being detained or being given an ISM non-conformity (which counts as five non-conformities in this case).
DMA PSC Task Force The Danish Maritime Authority has informed that, during the period from 1 September to 30 November 2014, a special DMA PSC Task Force will be established to assist ships and companies in case a groundless detention seems to be imminent during a PSC inspection. Overholdelse af hviletid For at undgå fejl og tilbageholdelser ved PSC skal arbejds- og hviletid planlægges grundigt, så overtrædelser undgås. Det er en god ide at følge nedenstående råd og regler.
Vagtskemaet ophænges et sted, hvor hele besætningen færdes/har let adgang. På skibe, hvor der gås 2-skifte vagt anbefales fx 5/7-vagt i stedet for 6/6-vagt, da visse lande ikke mener reglerne kan opfyldes ved 6/6-vagt pga. tiden der bruges til overlevering.
Bemandingsfastsættelse (Minimum Safe Manning dokument) og sønæringsbeviser/kvalifikationsbeviser for de foreskrevne besætningsmedlemmer, vil blive gransket nøje. Vær parat til at fremvise disse dokumenter. Skibet vil blive tilbageholdt, hvis bemandingen ikke er i overensstemmelse med fastsættelsen.
På nogle bemandingsfastsættelser kan skibet sejle med færre besætningsmedlemmer under visse betingelser - fx mindre fartsområde/dagsejlads. Skibsføreren skal kunne redegøre præcist for disse betingelser overfor PSC inspektøren.
Hvis skibet er godkendt til at sejle med vagtfrit maskinrum (UMS), skal de certifikater/dokumenter, hvoraf tilladelsen fremgår, fremvises ved PSC kontrollen. Hvis skibet er over 3.000 kw skal der også være en maskinmester på tilkaldevagt, når skibet ligger langs kaj (hvis der kun er en maskinmester om bord, kan han ikke gå i land).
Der skal føres hviletidsskemaer for alle besætningsmedlemmer. Skemaet bør føres dagligt. Skemaet underskrives mindst hver måned af føreren og det pågældende besætningsmedlem og udleveres til dette.
Hvis skibet har tilladelse fra Søfartsstyrelsen til at føre hviletidsskemaerne elektronisk, skal tilladelsen fremvises ved PSC kontrollen. Skemaerne udskrives, underskrives og udleveres mindst en gang om måneden. Alle elektroniske hviletidssystemer skal være godkendt af Søfartsstyrelsen
Hviletidsskemaerne skal udfyldes korrekt og i overensstemmelse med den faktiske hviletid. Der skal være overensstemmelse mellem registreringerne i hviletidsskemaerne og registreringerne i skibets forskellige logbøger, samt overtidsregnskab. Man skal være særlig opmærksom på, at ankomst/afgang, modtagelse af lods, øvelser, tilkaldelse af personer på standby, runderinger i maskinrummet mv. registreres korrekt.
Udover kravet om daglig hviletid, skal man være opmærksom på kravet til hviletid de seneste 7 dage.
Ved planlægningen af sejladsen, skal man sikre, at hviletiden vil blive opfyldt på de første vagter efter afgang. Ved PSC kontrol skal dette kunne dokumenteres. Det kan fx gøres ved at fremvise en sejladsplanlægning, hvor afgangstidspunktet er lagt således, at hviletiden på de efterfølgende vagter overholdes. Hvis skibet ikke sikrer dette, vil skibet blive tilbageholdt indtil den vagtgående besætning har fået tilstrækkelig hvile.
Det skal kunne dokumenteres, at besætningsmedlemmer på tilkaldevagt, modtager kompenserende hviletid, hvis de har været tilkaldt på en vagt.
Det skal fremgå af hviletidsskemaer og skibsdagbogen, at der har været en dedikeret udkig på vagt iht. bestemmelserne i STCW-konventionen, dvs. om natten, under nedsat sigt, ved tæt trafik osv. Danmark accepterer, at der ikke er dedikeret udkig i mindre fiskeskibe og i andre mindre fartøjer, hvor det ikke er muligt at have dedikeret udkig fx enmandsbetjente fartøjer. Der er ingen garanti for, at andre lande vil acceptere denne danske undtagelse.
Der skal være en procedure for, hvad der skal gøres, hvis hviletiden overtrædes. Ved overtrædelser skal rederiet underrettes. Rederiet skal derefter træffe forholdsregler til at undgå kommende overtrædelser. Proceduren, rapporteringen til rederiet og rederiets opfølgning skal kunne fremlægges ved PSC-kontrollen. Hvis dette ikke gøres, risikerer skibet tilbageholdelse eller ISMfejl (som tæller som 5 fejl).
DMA PSC Task Force Søfartsstyrelsen har oplyst, at der i perioden 1. september til 30. november 2014 etableres en særlig DMA PSC Task Force, der kan assistere skibe og rederier, hvis der under en PSC kontrol er optræk til en uberettiget tilbageholdelse.
