nr. 27 KLIP fra BBC: ENGLAND giver elever mulighed for at klage til en ombudsmand: Pupil complaints service revised Pupils who are upset by something their head teacher does will be able to complain to a new service in England. Previously if they were not satisfied with the outcome of a complaint to the school governors, they had to take it the Children's Secretary Ed Balls. But the Apprenticeship, Skills, Children and Learning Act sets up a new service via the local Ombudsman. Teachers' unions do not like the idea that young people themselves should be able to pursue a complaint. But the government has said parents and pupils have always had to right to raise concerns with their schools if they are unhappy. The Act extends the remit of the Local Government Ombudsman to investigating complaints from parents and pupils about individual matters in schools and in pupil referral units. The changes will be piloted in three or four local authorities from April with a view to being made national by September 2011. Vexatious A pupil or parent can turn to the new complaints service where they feel they have sustained "injustice" as a result of something a head teacher or governing body of a school did or failed to do. A spokeswoman for the Department for Children, Schools and Families said "injustice" may include: hurt feelings, distress, worry or inconvenience; time and trouble in pursuing a justified complaint with the school; and a detrimental effect on the pupil's education and/or general well being. A local commissioner (ombudsman) may decide not to investigate if satisfied with the action the governing body has taken or feels that the complaint is vexatious. The DCSF spokeswoman said: "The new service will help resolve disputes between schools and parents. "It will provide redress to parents where schools have clearly been at fault, and also support schools against vexatious appeals." It would not impose additional burdens on schools, she said. Guarantees But complaints may grow as a result of another Bill being considered by MPs. This provides "guarantees" of what pupils can expect schools to provide: good behaviour, strong discipline, order and safety a broad, balanced and flexible curriculum including skills for learning and life to be taught in a way that meets their needs, where progress is regularly checked, and where additional needs are spotted early and quickly addressed sport and cultural activities that their health and wellbeing are promoted. If schools fail to act in accordance with these principles a complaint can be made either by parent or pupil - even after they have left the school. The National Association of Head Teachers is worried that the provisions might undermine the authority of the school and particularly the head teacher. "Parents can already complain to Ofsted, the governing body and the secretary of state and some parents frankly make a hobby of it," said general secretary Mick Brookes. When the ideas were first proposed last summer, Mr Balls said parents would also have the right to complain about other parents who did not make sure their children behaved in school.
