11 Man kan ikke lave noget, der er endeligt! Sådan udtrykte Hans J. Wegner sig ved adskillige lejligheder. For ham var det perfekte møbel en utopi. Opfattelsen gav sig udslag i en særlig arbejdsmetode, som han fulgte livet igennem. Mange af hans møbler fungerede som arketyper, der siden blev videreudviklet i andre variationer. Derfor kan man se reminiscenser af Kinastolen i Y-stolen, ligesom foldemøblet blev et tema, han vendte tilbage til igen og igen. Wegner var således ikke bange for at eksperimentere. Han så hvert enkelt forsøg som et stadie på vejen og fejlskud som en del af den kreative proces. Historien om Wegner handler også om skomagersønnen fra Tønder. Det siges, at han allerede som dreng skar figurer ud af de træklodser, som faren brugte til skoskabeloner. Efter en afsluttet snedkeruddannelse i hjembyen drog han til København, hvor han afsluttede sin arkitekteksamen i Den dobbelte baggrund banede vejen for hans indgående fornemmelse for træets egenskaber og enestående sans for formgivning. Han besad imidlertid ikke alene æstetiske og håndværksmæssige principper møblerne blev også skabt på baggrund af dybdegående analyser af kropsstillinger. Wegner står som historiens største og mest produktive danske formgiver, og han satte tilmed dansk møbelkunst på verdenskortet. I år er det 100 år siden, at Wegner blev født. Det er blevet markeret med publikationer, relanceringer af hans møbler og anmelderroste udstillinger rundt omkring i landet. Designmuseum Danmark åbnede i foråret udstillingen Wegner Bare een god stol, der gav den besøgende mulighed for et berigende helikopterblik på arkitektens møbelproduktion. Og på Kunstmuseet i Tønder kunne man med udstillingen Hans J. Wegner Et nordisk designikon fra Tønder blive klog på Wegners nære forhold til fødebyen. Hos Bruun Rasmussen indgik vi i et samarbejde med begge museer og udlånte en række møbler til udstillingerne. Vi har fornøjelsen af at afslutte Wegner-året med en storstilet auktion. Igennem det seneste år har vi været på udkig efter arkitektens møbler fra de oprindelige producenter. Missionen lykkedes i kraft af vores dygtige eksperter Peter Kjelgaard, Ole Ravn, Peter Tholstrup, Amalie Hansen, Anna Widenborg og Frederik Bruun Rasmussen. Vi blænder nu op for det største udvalg på markedet nogensinde af Wegners mest sjældne og ikoniske møbler lige fra de tidligste og nærmest ukendte møbler fra slutningen af 1930 erne over de mest elskede klassikere til hans allerseneste møbler fra slutningen af 1980 erne. Alle møblerne er præsenteret i dette katalog. Ved en række udvalgte højdepunkter har vi udfoldet tilblivelseshistorien det gælder Kinastolen, Den runde Stol, Bamsestolen, Flaglinestolen, Foldestol JH 512 og Sabelbensbordet. Vi inddrager også forskellige vinkler på Wegners møbelproduktion i artikler skrevet af Christian Holmsted Olesen fra Designmuseum Danmark, den tidligere daglige leder af Wegners Tegnestue Anders Grannov Brun og sidst, men ikke mindst, et interview med den inkarnerede japanske møbelsamler Noritsugu Oda, som besøgte os for to år siden i anledning af en stor Finn Juhl-auktion. 12 Whatever you make, it is never final! This Hans J. Wegner said on more than one occasion. For him, creating the perfect piece of furniture was utopia. This view was reflected in a certain way of working, which he pursued throughout his life. Many of his pieces served as archetypes, which he later further developed into other variations. And so there are echoes of the China Chair in the Y-chair, and the folding furniture was a theme he returned to again and again. Wegner was not afraid to experiment. He saw each experiment as a step along the way and viewed errors of judgement as part and parcel of the creative process. The story of Wegner is also about a shoemaker s son from Tønder. It is said that when he was just a boy, he made figures out of the wooden blocks his father used as shoe templates. Having completed his training as a cabinetmaker in his hometown, he moved to Copenhagen, where he qualified as an architect in This dual background gave him an in-depth feel for the natural character of the wood and a unique sense of design. Not only did he abide by principles of aesthetic and craftsmanship, but his furniture was also made on the basis of thorough analyses of body positions. Wegner goes down in history as the greatest and most prolific Danish designer, and it was he who put Danish furniture design on the world map. This year is the centenary of Wegner s birth. It has been marked with publications, relaunches of his furniture and critically acclaimed exhibitions around the country. In the spring, Designmuseum Danmark opened the exhibition Wegner Just one good chair, giving visitors an enriching overall look at the architect s furniture production, while at Kunstmuseet in Tønder, they could learn all about Wegner s close ties to his native town at the exhibition Hans J. Wegner A Nordic design icon from Tønder. At Bruun Rasmussen, we entered into collaboration with both museums, lending them a number of pieces for their exhibitions. And we have the pleasure of rounding off the Wegner year with a large-scale auction. Over the past year, we have been on the lookout for the architect s furniture from the original manufacturers. Our mission was accomplished thanks to our talented design specialists Peter Kjelgaard, Ole Ravn, Peter Tholstrup, Amalie Hansen, Anna Widenborg and Frederik Bruun Rasmussen. We are now putting the spotlight on the largest selection of Wegner s rarest and most iconic furniture ever on the market from his earliest, almost unknown pieces from the late 1930s, to his most beloved classics and his recent pieces from the late 1980s. All the different pieces of furniture are presented in this catalogue. Through a number of selected highlights, we go into greater detail about how a particular piece came to be the China Chair, the Round Chair, the Papa Bear Chair, the Flag Halyard Chair, the Folding Chair JH 512 and the Sabre Leg Table. We also include different angles on Wegner s furniture production in articles written by Christian Holmsted Olesen from Designmuseum Danmark, a former manager of Wegner s design studio Anders Grannov Brun, and last but not least, an interview with the inveterate Japanese furniture collector Noritsugu Oda, who visited us two years ago on the occasion of our major Finn Juhl sale. 15 The Round Chair/The Chair (1949) There must be room for the rump, Hans J. Wegner supposedly once said. This statement is often linked to the efforts of designing the Round Chair. For the first time, Wegner demonstrated that a properly designed backrest is not only about aesthetic, but also about attaining an ideal sitting position. The chair is a further development of the China Chair, and achieves its lightness and firmness by consisting solely of curved shapes. This is probably also the reason why Wegner always referred to it as the round chair a piece of furniture which is said to contain the essence of Danish cabinetmaking traditions and design philosophy is considered an epoch-making year for Danish furniture design. This was the year when Finn Juhl designed the Chieftain Chair, and Ejnar Larsen and Aksel Bender Madsen created the Metropolitan Chair. They all attracted much attention from abroad, but it was Wegner s chair that led to the actual breakthrough for Danish furniture design. Shortly after the launch of the chair, it was mentioned in the American magazine Interior, where it was named The Chair and referred to as the most beautiful chair in the world. Another milestone in Wegner s career, and for Danish design in general, was when The Chair played a visible part in a historic media event. In 1960, an election debate was broadcasted to viewers for the first time ever the rivals were John F. Kennedy and Richard Nixon and each of them were sitting in The Chair. Even though the name The Chair undoubtedly made the Danish architect proud, he made it clear on several occasions that he actually did not like the appellation. This was hardly due to modesty on his part, but more likely that Wegner maintained that no design is ever final Nothing is ever made that cannot be improved. 14 BRUUN RASMUSSEN BREDGADE AUCTION WEGNER 100 YEARS

21 The Collector Noritsugu Oda is a professor at Tokai University in Japan, and is a veritable connoisseur when it comes to Danish furniture design. Oda has been collecting mid-20th century furniture classics since the 1970s, and has written several publications about Danish furniture designers, including Finn Juhl and Hans J. Wegner. 20

22 A Lifelong Admiration By Jens H. Jensen, Japan Editor for Wallpaper Magazine In 1982, the night before Noritsugu Oda was due to meet Hans. J. Wegner for the first time he couldn t sleep. Since his interest for furniture, chairs in particular, had started when he first saw Le Corbusier s iconic LC4 chaise lounge in the late 1960s, he had been collecting chairs and books and various printed material on the subject and there was no doubt in his mind that Wegner was one of the most important furniture architects of them all. Despite the lack of a good night s sleep, the meeting went well. Wegner was very kind to me and patiently answered all my questions. I didn t need to have been worried about the meeting at all. Oda explains. Oda has been a big fan ever since. He has been collecting furniture for more than four decades, and Wegner has a very large place in his heart and collection. In 2002, he published 100 chairs of Hans. J. Wegner, sadly still only available in Japanese, and later this year he is publishing another book on Wegner in Taiwan, where the interest in the Danish master and furniture in general is at its peak. The book is to coincide with the opening of a Wegner exhibition at the National Taiwan Craft Research and Development Institute that Oda has been helping with too. With about 140 Wegner chairs to choose from, several prototypes and custommade models among them, Oda is never in need of a good chair to sit in, but his favourite is still the first Wegner he bought in the late seventies, namely The Chair (The Round Chair). It is just right. It s everything a good chair should be. His home on Japan s most northern island of Hokkaido is the ultimate testament to his love of Danish and Scandinavian furniture. The 440m 2 house is filled with priceless masterpieces by Finn Juhl, Kaare Klint, Arne Jacobsen, Poul Kjærholm and of course Hans. J. Wegner. With a collection of more than 1300 chairs, Oda changes and re-arranges his living room ever so often. Right now there are in fact very few Wegner pieces in his house, as most of his favourites are exhibited at an exhibition in Asahikawa, Hokkaido, celebrating Wegner s centenary. The last time he met Wegner was also at an exhibition celebrating the architect. Oda was visiting Denmark in 1989 and just managed to visit the exhibition at the Danish Museum of Decorative Art (Now: Designmuseum Danmark) celebrating 75 years of Wegner on the very last day the exhibition ran. The museum was completely empty. We were the only visitors and had the whole museum to ourselves - Oda, visiting with a few Japanese friends, explains. All of the sudden I saw a lady approaching us. It was Wegner s wife Inga and she said: Hans is also here. Oda and his friends were then given a private tour of the exhibition by the architect himself. 28 Folding Chair JH512 (1949) The folding chair was a recurrent theme in the work of Hans J. Wegner. In 1946, he designed his first folding chair a contribution to a design competition about furniture for the man s room, which he took part in together with his colleague and friend Børge Mogensen. Three years later, he reinterpreted the design with the easy chair JH 512, which was created from a social awareness that many people lived in small flats, which in turn required flexible interior designs. The chair was therefore designed to be hung on the wall and taken down when needed. As always, nothing was left to chance a slight indentation in the transverse stretcher ensures that the chair hangs evenly on the wall. The chair was exhibited at the Copenhagen Cabinetmaker s Guild Exhibition, and in 1950 Wegner reused the idea for his poetical Dolphin Chair BRUUN RASMUSSEN BREDGADE AUCTION WEGNER 100 YEARS 27

54 The Flag Halyard Chair (1950) Hans J. Wegner s thoughts no doubt constantly circled around furniture design, and the following situation is easily picturable he is at the beach in Aarhus with his family and makes a hollow in the sand, whereby he can lie down without losing sight of his surroundings. This became a kind of preliminary study and inspired him to design the Flag Halyard Chair, which was presented at the Spring Exhibition of Danish Arts and Crafts in With this chair, Wegner proved that he mastered more than wooden furniture. The frame is made of chromed and white or green lacquered steel, and with the flag halyard, the sheepskin and the headrest Wegner completed the look. But the chair was a bit too much for contemporary furniture designers in Denmark. The grand old man, Kaare Klint, actually argued that it most of all resembled a gynaecological examination bed. That the chair was ahead of its time is also obvious from the fact that only a few years later did the manufacturer Getama suggest putting it into production the managing director believed that production costs would be comparable to that of a bicycle. At the furniture show in Fredericia in 1958, Getama presented a striking arrangement of six Flag Halyard Chairs around an open fireplace. From then onwards, the chair received much attention in Denmark and especially in the US.

76 The Sabre Leg Table (1955) Hans J. Wegner is undoubtedly most famous for his many chairs. But he also designed a gamut of tables and with the same degree of accuracy. To Wegner, the most important part of this type of furniture was not the table top, but rather what was underneath. For the supporting structure of the tables, he was as usual inspired by furniture designs of the past. Cross legs have a long tradition in the history of furniture; they are, for example, known from 17th century Spanish tables. Wegner used these cross legs for the almost graceful Sabre Leg Table from 1955, which was later reproduced in numerous forms. Wegner was focused on ensuring the stability of the pieces that he designed, and in this case he used brass stretchers to provide support but as always in a way that made the result appear effortless and beautiful. In the city of Calicut, South India, where DLH's no. 1 supplier of Indian rosewood resides, a particularly fine veneer log of Indian rosewood had been sent to the sawmill by mistake, and cut into 1" boards. DLH bought two of these boards at a reduced but still very high price of GBP 10 per cubic foot. The boards were stored away until 1986 when it was decided to use the boards to make a conference table for the company. The table was designed by Hans J. 85 The China Chair (1944) The China Chair formed the basis of a large part of Hans J. Wegner s designs. It illustrates his working methods and his mantra that designing a piece of furniture is never final. The chair became the template for a great number of later variations, and one of its descendants is the mass-produced Y-chair from The China Chair bears witness to how Wegner sought inspiration in furniture from previous historical periods. The long established trade routes between Europe and the East meant that Chinese art and craft had become a part of the European consciousness. Wegner became acquainted with Chinese furniture design at Designmuseum Danmark and from architect Ole Wanscher s book Møbeltyper (furniture types), which he studied at the library in Aarhus in What caught Wegner s attention was the organic curve of the light backrests on the Chinese chairs. This led to the development of several models of the China Chair, which he worked on concurrently in To be made by cabinetmaker Johannes Hansen, he designed a Chinese inspired chair and armchair, and for Fritz Hansen, he made four different China Chairs, of which two went into production. When the first China Chair, made by Fritz Hansen, was exhibited at the Spring Exhibition of Danish Arts and Crafts in 1944 in Copenhagen, Wegner asked his good friend, furniture designer Børge Mogensen, to pay the exhibition a visit. The feedback must have been discouraging for a man of the future like Wegner because, according to Mogensen, only a couple of antique dealers had showed an interest in the chair. Maybe this lack of interest was due to its distinct exclusive and conservative elegance. Today, this very elegance has made the chair hugely popular in executive interiors. 84

113 The Cabinetmaker Anders Grannov Brun is a trained cabinetmaker from Rud. Rasmussens Cabinetmakers in For a number of years, he worked as the daily manager of Hans J. Wegner s design studio and thus has an in-depth and broad knowledge of Wegner s furniture.

114 Outstanding Craftsman World-class Designer By Anders Grannov Brun There are numerous stories about the artisanal talents of Hans J. Wegner. It is said, for example, that Wegner used to sit in his pram at his father s shoemaking workshop in Tønder making paper cuts with a pair of shoemaker s scissors. Not very likely! However, one thing we do know for sure is that Wegner mastered the use of tools from an early age. This year s Wegner exhibitions in Tønder and Copenhagen and the books published in connection with them show examples of Wegner s drawings, paintings and carvings from when he was young. Wegner was multi talented, with an early and acute sense of form and texture. This talent was further developed through his apprenticeship at a local cabinetmaker s in Tønder, and later when he was working for Arne Jacobsen and at Erik Møller s design studio in connection with the construction of Aarhus City Hall. The story goes that the workers charged with laying the distinctive bog oak parquet flooring told the site manager that it was not possible to lay the floor using the somewhat sub-standard and delicate pieces of wood. Hearing this, Wegner grabbed their tools to show them how it should be done and the floor is still there some 70 years later. Wegner set extremely high standards for himself and those he worked with. There was no such thing as good enough. It was either good or it was bad. The companies that Wegner worked with, some of which continue to produce his furniture to this day, were required to deliver innovative assembly techniques and perfectly dried and cut wood, and the individual cabinetmakers had to possess a well-developed sense of form in order to make the furniture properly. Wegner s furniture tested the skills of his partners to the limit, but he also took them a step further. They had to innovate and improve to be able to make furniture that lived up to Wegner s demands for quality and design. Wegner was not one to make do with triedand-tested techniques. Something as simple as bending a piece of flat steel required the development of a new bending technique before he was satisfied. Many of Wegner s pieces also possess the same kind of natural beauty as old tools, paddles or household implements, the designs of which have been developed and perfected over generations to serve a specific function based on the capacity of the material. And this was perhaps the very essence of Wegner s work; always with a focus on function, it challenged the craftsmanship and materials with a particular aesthetic nerve into a piece of furniture. For this auction, Bruun Rasmussen has managed to put together a string of rare and beautiful Wegner pieces some of which have been on loan to the major Wegner exhibitions at Designmuseum Danmark and Kunstmuseet in Tønder. The Crocodile Cabinet, for example, has its roots in Wegner s early carvings and was made for the Carvers Guild (Billedskærerlauget) Competition in When you look at the beautiful ornamentation that has given the cabinet its name, you can make out traces of the carver s tool just as in Wegner s early models. In a different genre entirely is Wegner s office chair for Planmøbel. The chair is made of tubular steel, wood and leather a chair I have personally been on the lookout for for five years! Just before the opening of the exhibition in Tønder, Bruun Rasmussen found the chair now up for auction. As a trained cabinetmaker and former daily manager of Hans J. Wegner s design studio, it has been my great pleasure to work with Bruun Rasmussen s experts on the celebration of the centenary of Hans J. 120 The Papa Bear Chair (1951) Many of Hans J. Wegner s chairs have later on been given names with reference to the animal kingdom thus adding a humorous twist to the aesthetic qualities and the remarkable craftsmanship. This also applies to the Papa Bear Chair, which got its name following a review by a journalist, who wrote that sitting in it was like being held in the arms of a teddy bear. Also when designing this chair, Wegner had a look back in time at previous furniture styles. Upholstered furniture emerged in the 18th century, and in general Danish modernist architects rebelled against this kind of furniture with its closed and voluminous appearance. Wegner, on the other hand, dived into the genre and already in 1944 designed a wing chair after English example. He reconsidered it in 1951 and created the Papa Bear Chair, which, in contrast to traditional upholstered wing chairs, has a surprisingly sculptural, light and open appearance. Later relatives include the even lighter counterpart the Mama Bear Chair from 1954 as well as the Ox-chair and the Wingchair from 1960.

In 1935 the two young architects Flemming Lassen and Erik Møller won the architectural competition to build Nyborg Library. They hired the not yet qualified furniture architect Hans J. Wegner in 1938 to design a unique interior for the building. Wegner was actually employed by Arne Jacobsen and Erik Møller's drawing office in Aarhus to design furniture for Aarhus City Hall, but as this project was not yet ready, his first task then was to design the furniture for Nyborg Library. 202 Playful Seriousness Wegner Today By Christian Holmsted Olesen Designmuseum Danmark s WEGNER just one good chair has proved to be one of the most popular exhibitions in the history of the museum. There is immense international interest in Hans J. Wegner, and his furniture is selling like never before. Old Wegner pieces dating back to the last century are some of the most desirable antiques on the market today. Why? Because, as a furniture dealer might say, Wegner s design is timeless. But of course nothing is timeless, and, if anything, Wegner was the man who created the idiom of his day the 1950s. Wegner and his colleague Finn Juhl were the main exponents of the new style known as Danish Modern. The reason for their popularity in the West and in the United States in particular in the post-war period can be attributed to the fact that, for many people, the highly rational design and industrial production of international modernism became synonymous with the horrors of the Second World War. In the US, a movement emerged, heralding the workmanship of times past, and here, non-industrialised Denmark had something special to offer: a fully intact and highly developed culture of craftsmanship. At the same time, modernist art and architecture had moved on from stringent geometric shapes to freer, more organic forms. And this is where Wegner s furniture, inspired by old tools such as axes or paddles, found its mark. Wegner s furniture sculptures could also soften up the stringent, clean-cut glass/concrete/steel architecture of international modernists such as Philip Johnson. But that was then. Is the current interest in Wegner just a part of today s retro wave and the inability to develop a new style? As modernism gave way to post-modernism, the modernists were criticised for being too matter-of-fact and unimaginative. People did not want to settle for anonymous, puritanical, rational and industrial-looking furniture without references to the past. The post-modernist movement tried its hardest to degrade or ridicule the spiritless, monotonous function-oriented international modernism. Humorous symbols and grotesque ornaments were added to the furniture icons, which were produced in brightly coloured, disingenuous and synthetic materials. The post-modernists criticism was justified and something any serious contemporary designer has to relate to. It is here that we find the explanation as to why so many designers study Wegner today, and why so many architects choose Wegner s furniture for their buildings. Wegner s furniture meets the demands of modernism in terms of function and production to justify its construction. Wegner is part of the functional Danish tradition, but his furniture also emanates poetry, energy and imagination. It has the spiritual, sensual dimension sought after by the post-modernists. Wegner summed up his entire design method in the motto: Let s play serious play. He possessed a special ability to combine simplicity and rationality with humour and charm. Most of Wegner s designs are new interpretations of historical types of furniture he studied at Designmuseum Danmark, so everyone can recognise something archetypal in his furniture poetry, consciously or unconsciously. Because Wegner s furniture looks way back in time and unites idealistic thinking with an awareness of the importance of the human dimension, his furniture seems timeless. After struggling for a lifetime to design just one good chair, even Wegner himself said in 1992 that you simply cannot create the perfect chair. Wegner had understood the problem of modernist thinking, which had been the benchmark of everything he had designed. And he gave us the answer as to how to combine seriousness and play. 231 KØBSKONDITIONER 1. BUDGIVNING Køber er den byder, der får hammerslag. Den, der byder for andre, hæfter som selvskyldnerkautionist for berigtigelsen af købet. På opfordring fra Bruun Rasmussen Kunstauktioner (herefter benævnt Bruun Rasmussen), skal alle bydere, hvadenten de ønsker at afgive et bud ved personligt fremmøde på auktionsstedet eller afgive en kommission pr. brev, fax eller hjemmeside eller byde direkte pr. telefon eller hjemmeside, kunne dokumentere deres betalingsdygtighed samt til enhver tid identificere sig. Bruun Rasmussen er altid berettiget til at nægte at acceptere et bud, hvis på forlangende ikke tilstrækkelig sikkerhed er stillet eller en passende à conto betaling har fundet sted. Bud afgives af byderen ved personligt fremmøde på auktionsstedet eller ved skriftlig kommission enten pr. brev, fax eller hjemmeside. På online-auktioner afgives bud direkte fra hjemmesiden. BETALING Ved køb på alle net-auktioner tillægges hammerslagsprisen 25%, der dækker salær på 20% samt moms af salæret. Ved køb på alle traditionelle auktioner tillægges hammerslagsprisen 30% (for vin, mønter og frimærker 25%), der dækker salær på 24% samt moms af salæret. Visse numre handles efter særlige regler til fuldmoms, så udover auktionsomkostninger på 24% (for net-auktioner, vin, mønter og frimærker dog 20%), beregnes moms på 25% af både hammerslag og auktionsomkostninger. Disse numre er mærket med en stjerne (*). Danske momsregistrerede købere skal overfor Bruun Rasmussen oplyse deres SE-/CVR-nr. (moms-nr.), da dette skal anføres på de fakturaer, hvor varen købes i fuld moms. For visse udenlandske købere gælder der særlige regler for afgiftsfritagelse jvf. 4. Afgiftsfritagelse omfatter ikke EU private købere, som ligestilles med danske købere jvf. gældende dansk lovgivning om handel med brugte varer, kunstgenstande, samlerobjekter og antikviteter. Købesummen forfalder til betaling ved tilslaget. Der kan betales kontant op til DKK eller med Dankort, banknoteret check, rejsechecks, Visa-, Master-, Diners Club- eller Eurocard. Personlige udenlandske checks kan kun anvendes efter forudgående aftale. På de traditionelle auktioner i Bredgade skal betaling af købte emner finde sted under eller umiddelbart efter auktionen og under alle omstændigheder senest 8 dage efter fakturadatoen. På net-auktionerne trækkes købesummen automatisk på det af kunden oplyste betalings-/kreditkort i forbindelse med, at det købte emne udtages til transport (ca. 12 timer efter dagens salg). Samtidig tilsendes køber faktura og transportoplysninger. Betales købesummen ikke rettidigt, skal der svares rente heraf med 1,5% pr. påbegyndt måned. Betales købesum og renter ikke inden 8 dage efter at Bruun Rasmussen har afsendt påkrav herom til køber, er Bruun Rasmussen berettiget til at annullere købet og bortsælge det købte på ny auktion hos Bruun Rasmussen eller underhånden og afkræve køber ethvert herved opstået tab. Et eventuelt overskud tilfalder den, der har indleveret det købte til auktion. Har den misligholdende køber tilgodehavender fra salg af effekter hos Bruun Rasmussen, er Bruun Rasmussen berettiget til at berigtige ethvert tilgodehavende hos køber ved modregning. Har den misligholdende køber indleveret andre effekter til salg, er Bruun Rasmussen berettiget til at bortsælge sådanne effekter på auktion hos Bruun Rasmussen uden at være bundet af en af den misligholdende køber fastsat mindstepris. Den misligholdende køber er ikke berettiget til at kræve udlevering af effekter indleveret til salg, så længe forfalden gæld til Bruun Rasmussen ikke er betalt, uanset om værdien af sådanne effekter må anses at overstige forfalden gæld. Bruun Rasmussen er berettiget til at afvise bud afgivet af en køber, der er i misligholdelse med sine betalingsforpligtelser over for Bruun Rasmussen eller et bud afgivet af en anden på den pågældendes vegne, ligesom Bruun Rasmussen er berettiget til at kræve et depositum som betingelse for accept af fremtidige bud. 3. FORTRYDELSESRET For privatkøb af emner på en online-auktion gælder loven om fjernsalg, herunder også 14 dages fortrydelsesret. Eventuelle omkostninger forbundet med transport af købte emner retur fra køber, betales af køber selv. Såfremt køber benytter sig af sin fortrydelsesret, refunderer Bruun Rasmussen betalingen umiddelbart efter, at varen er sendt retur og modtaget af Bruun Rasmussen. Bruun Rasmussen gør opmærksom på, at det herefter er op til bankerne/kreditkortselskaberne, hvornår refusionen indgår på købers konto. 4. AFGIFTSFRITAGELSE Udenlandske købere, der opfylder nedennævnte betingelser, betaler henholdsvis 24% i auktionsomkostninger af hammerslaget på traditional auktion og 20% i auktionsomkostninger af hammerslaget på net-auktion, og bliver ikke belastet af danske afgifter. A. Købere med bopæl i et andet EU-land: Købere, som er momsregistreret i et andet EU-land, fritages for at betale dansk moms, når momsregistreringen dokumenteres over for Bruun Rasmussen, som skal påføre momsnummeret på fakturaen. B. Købere med bopæl uden for EU: 1. Forsendelse gennem speditør: Effekter, der eksporteres gennem en af Bruun Rasmussen godkendt speditør, fritages for afgift. 2. Udførsel som rejsegods: Der kan ske fritagelse for dansk afgift, når køberen selv medtager det købte under forudsætning af, at følgende betingelser er opfyldt: Fakturaen skal være betalt, og den danske afgift på 25% af fakturabeløbet skal være deponeret hos Bruun Rasmussen. a. Købere med fast bopæl i Norge vil få den danske moms refunderet, så snart Bruun Rasmussen har modtaget købsfakturaen retur med påtegning om officiel indførsel fra det endelige lands toldmyndighed eller anden på omsætnings-afgiftsområdet kompetent myndighed, hvis købet overstiger DKK b. Købere med fast bopæl andre steder uden for EU vil få den danske moms refunderet, efter at effekterne har været forevist til toldbehandling i forbindelse med køberens udrejse fra EU. Eksportørblanketten returneres til Bruun Rasmussen efter at være forsynet med et toldvæsens attest for udførslen, hvis købet overstiger DKK 300. Dette gælder også for Færøerne og Grønland. 5. AFGIFTSBETALING A. Momsregistrerede i andre EU-lande, der ikke ønsker at gøre brug af 4, kan i stedet vælge at handle til brugtmoms/fuldmoms på lige fod med private købere. Dette skal meddeles Bruun Rasmussen inden kl. 10 den følgende auktionsdag. B. Momsregistrerede i Danmark kan vælge at købe til fuldmoms med 25% af både hammerslag og auktionsomkostninger. Dette skal meddeles inden kl. 10 den følgende auktionsdag. 230

232 6. UDLEVERING Købesummen skal være betalt, inden det købte kan udleveres til køberen. Det købte henligger fra hammerslaget for købers regning og risiko. For varer, der ikke afhentes ifølge aftale efter hammerslaget, vil blive kørt på fjernlager på købers regning og risiko. Købte varer, der er betalt, men ikke afhentet, vil efter 1 år blive videresolgt for købers regning ved auktion eller underhånden. 7. FORSENDELSE Såfremt Bruun Rasmussen påtager sig at emballere og fremsende købte varer, sker dette på købers regning og risiko. Bruun Rasmussen kan således ikke drages til ansvar for skader forvoldt på købte varer under forsendelse eller for forsvundne forsendelser. 8. KUNSTNERAFGIFT TIL COPY-DAN CD Ifølge gældende dansk lovgivning om ophavsret skal der opkræves følgeretsvederlag for værker af nyere danske og visse udenlandske kunstnere, som enten er nulevende eller ikke har været døde i mere end 70 år. Følgeretsvederlaget opkræves af Bruun Rasmussen på vegne af kunstnernes organisation Copydan. Disse værker er mærket (CD) for Copydan ud for katalognummeret. Den såkaldte Copydan-afgift tillægges hammerslagsprisen inkl. salær, når beløbet overstiger 300. Copydan-afgiften er: 5% af den del af hammerslagsprisen og salæret (ekskl. moms), der udgør indtil % af den del af hammerslagsprisen og salæret (ekskl. moms), der ligger mellem og % af den del af hammerslagsprisen og salæret (ekskl. moms), der ligger mellem og ,5% af den del af hammerslagsslagsprisen (ekskl. moms), der ligger mellem og ,25% af den del af hammerslagsprisen (ekskl. moms), der ligger over Copydan-afgiften kan ikke overstige for det enkelte kunstværk. Euro-kursen er fastsat af Copydan i 2014 til kurs 745,89 pr EKSPORTTILLADELSE Kulturværdiudvalget er blevet ansøgt om eksporttilladelse, hvor dette kræves iflg. gældende dansk lovgivning om sikring af kulturværdier i Danmark. Foreligger en sådan ikke, vil dette blive meddelt den udenlandske køber umiddelbart efter hammerslaget. Derefter vil Bruun Rasmussen igen ansøge Kulturværdiudvalget på købers vegne, nu hvor prisen kendes. Gives eksporttilladelse ikke, er Kulturværdiudvalget forpligtet til at overtage det købte til den opnåede pris, hvilket betyder at købet bliver hævet for køber. 10. BESKRIVELSE AF EMNER Alt sælges i den stand, hvori det ved hammerslaget er at forefinde og som beskrevet i katalog eller hjemmeside med senere offentliggjorte ændringer og modifikationer. Beskrivelsen er foretaget efter bedste overbevisning og under anvendelse af de anførte katalogiseringsprincipper. De solgte effekter er ofte af en alder eller af en art, der bevirker, at de kan være behæftet med fejl, mangler, restaurering eller beskadigelser, der ikke nødvendigvis angives i katalog eller på hjemmesiden. Afbildninger i katalog eller på hjemmesiden er blot til identifikation og kan ikke anvendes til vurdering af effekternes stand. Enhver der ønsker at byde på auktion, bør derfor ved selvsyn på de før auktionen afholdte eftersyn forvisse sig om de ønskede effekters stand. Beskrivelsen er udtryk for den på salgstidspunktet blandt lærde og eksperter herskende opfattelse. Skulle der efter købet opstå tvivl om det købtes ægthed eller dettes overensstemmelse med beskrivelsen, skal dette straks meddeles til Bruun Rasmussen. Såfremt det må erkendes, at det købte er en forfalskning, eller såfremt beskrivelsen har været behæftet med væsentlige fejl, der har medført en væsentlig højere hammerslagspris, end en korrekt beskrivelse må antages at ville have resulteret i, er køber berettiget til at annullere købet, hvorefter den samlede erlagte købesum tillagt auktionsomkostninger og evt. moms, vil blive refunderet køber. Væsentlige fejl i beskrivelsen relateret til mål eller vægt erstattes kun procentuelt i forhold til differencen. Retten til under de her anførte betingelser at annullere et køb kan kun udøves af den, der købte den pågældende effekt hos Bruun Rasmussen og er betinget af, at krav om annullering fremsættes skriftligt over for Bruun Rasmussen inden 2 år efter købsdagen, og af at det købte inden samme frist returneres til Bruun Rasmussen i den samme stand i enhver henseende, som det købte var i på hammerslagstidspunktet. Køber kan i tilfælde af annullering ikke gøre krav på betaling af renter af købesummen og er ej heller berettiget til at kræve anden udgift eller tab, herunder eventuel mistet videresalgsfortjeneste, dækket. Et køb kan ikke kræves annulleret efter ovenstående bestemmelser, såfremt: a. beskrivelsen i katalog eller på hjemmesiden på hammerslagsdagen var i overensstemmelse med den på dette tidspunkt gældende opfattelse blandt lærde og eksperter. b. den eneste måde til på salgstidspunktet at få fastslået et falskneri var iværksættelsen af videnskabelige processer, hvis gyldighed først blev anerkendt efter salgstidspunktet, eller som ville have været uforholdsmæssigt omkostningskrævende eller uigennemførlige uden beskadigelse af den pågældende effekt. I tillæg til ovenstående frist gælder de almindelige forældelsesregler i forældelsesloven, efter hvilke køber ikke under nogen omstændigheder kan gøre noget krav gældende over for Bruun Rasmussen, når der er forløbet mere end 5 år fra købsdagen. KOMMISSIONER Bruun Rasmussen Kunstauktioner Jesper Bruun Rasmussen, Auktionsholder Jørgen Byriel, Auktionsleder Bruun Rasmussen påtager sig at byde i kommission for bydere, der ikke kan være til stede ved auktionen. Det er en forudsætning, at kommissioner indleveret pr. brev eller fax er Bruun Rasmussen i hænde i 24 timer før auktionens start, så om nødvendigt bydernes kreditværdighed kan undersøges. Via hjemmesiden er denne deadline 3 timer. Bruun Rasmussen påtager sig intet ansvar for eventuelle fejltagelser, der måtte opstå ved brug af denne service KONDITIONSRAPPORTER Bruun Rasmussen påtager sig, hvis det er muligt, at orientere nærmere om numrenes kondition og tilstand. Dette er ment som en service for kunder, der ikke selv har mulighed for ved selvsyn at undersøge numrene på eftersynet. FRITAGELSE FOR DANSK FULDMOMS Købere skal ifølge 2 betale fuldmoms af de varer der i katalog eller på hjemmesiden er markeret med stjerne (*). Når virksomheder, der er momsregistrerede i andre EU-lande, køber hos Bruun Rasmussen og videresælger til private, skal der ikke betales dansk moms, men moms i henhold til de regler der gælder, hvor den udenlandske virksomhed er momsregistreret. 233 CONDITIONS OF PURCHASE 1. BIDDING The buyer shall be the highest bidder at the hammer price. Any person bidding on behalf of a third party shall be liable in surety for completion of the sale. At the request of Bruun Rasmussen Kunstauktioner (hereinafter called Bruun Rasmussen), all bidders, whether they wish to make bids in person at the place of auction or commission bids by letter, fax or the homepage direct telephone bids or the homepage, should be able to document their ability to pay and be able to provide proof of identity at any time. Bruun Rasmussen is entitled to refuse to accept a bid if, when requested, adequate security or adequate payment on account has not been rendered. Bids should be made by the bidder in person at the place of auction or by written commission by letter, fax or the homepage. For online auctions alle bids are submitted via the homepage. Telephone bidding is possible within certain conditions made out by Bruun Rasmussen. Bruun Rasmussen is not to be held responsible for any errors that may occur using this service. The auctioneer shall have absolute discretion as to the increment of the bids. The auctioneer will also make decisions in all cases of doubt regarding the bidding. Certain lots are sold in accordance with specific rules on normal VAT arrangement (hereinafter called normal VAT), so that the purchase price is the hammer price plus an additional 24% (for online auctions, wines, coins and stamps 20%) in buyer s premium and VAT of 25% levied on both the hammer price and the buyer s premium. The lots subject to Full VAT are indicated as such in the catalogue and on the homepage with an asterisk (*). Danish VAT registered buyers shall provide Bruun Rasmussen with documentation of their SE-/CVR -number (VAT No.) as this has to be quoted on the invoice for goods bought at full VAT. For some foreign buyers, specific VAT-exemption rules apply (cf. Article 3). VAT-exemption does not apply to private buyers from the EU who are considered as Danish buyers (cf. current Danish legislation on Special VAT Scheme for Sales of Works of Art, Collectors items and Antiques by Public Auction). The purchase price falls due for payment when the goods have been knocked down. Payment may be made in cash up to DKK 50,000, by Dankort, banker s cheque, traveller s cheque, Visa-, Master-, Diners Club- or Eurocard. Personal foreign cheques may only be used for payment by prior arrangement. At traditional auctions payment for purchased items must be made during or immediately after the auction. Under all circumstances payment must be made no later than eight days from the date of the invoice. With online auctions, payment automatically takes place when the items are prepared for dispatch (circa 12 hours after the purchase has been made) using the credit/ debit card details submitted by the purchaser. At the same time an invoice and dispatch information will be sent to the purchaser. Should the purchase price not be paid by the due date, interest at 1.5 % per new month will be charged. If the purchase price and interest are not paid within eight days after Bruun Rasmussen has sent its demand to the buyer, Bruun Rasmussen shall be entitled to rescind the sale and resell the goods at a Bruun Rasmussen auction or privately, and to demand reimbursement of any related losses from the defaulting buyer. Any further profit on the sale shall be payable to the person who had deposited the goods for sale by auction. If the defaulting buyer is entitled to proceeds from a sale of goods by Bruun Rasmussen, Bruun Rasmussen shall be entitled to set off its receivables against its payables to the defaulting buyer. If the defaulting buyer has deposited other goods for sale, Bruun Rasmussen shall be entitled to sell such goods at a Bruun Rasmussen auction without being bound by the reserve stipulated by the defaulting buyer. The defautling buyer shall not be entitled to demand the surrender of goods deposited for sale as long as the debt payable to Bruun Rasmussen has not been discharged, regardless of whether the value of such goods may be deemed to exceed the debt payable. Bruun Rasmussen shall be entitled to refuse a bid made by a buyer who is in default in respect to his payment obligations to Bruun Rasmussen, as well as a bid made by a third party on behalf of such a defaulting buyer. Bruun Rasmussen shall further be entitled to demand a deposit as a condition of accepting any future bids from such a purchaserr. 3. MONEY-BACK GUARANTEE Online purchase of items by private individuals is subject to Danish consumer law, which extends 14 days of money-back guarantee. The purchaser is liable for any costs related to the transport of returned items. Should a purchaser seek to avail himself or herself of the moneyback guarantee, Bruun Rasmussen will refund the payment on receiving the returned items. Please note that the date on which accounts are debited is subject to the policy of the purchaser s bank/credit card company. 4. EXEMPTION FROM VAT International purchasers, who fulfill the conditions stipulated below, must pay a fee of 24% of the auction price at traditional salesroom auctions and a 20% fee of auction prices for items purchased online. They are exempt from the payment of Danish VAT.: A. Buyers residing in another EU Member State: Buyers are exempt from paying Danish VAT as long as they have provided Bruun Rasmussen with documentation of their VAT registration. The VAT number will then be quoted on Bruun Rasmussen s invoice. B. Buyers residing outside the EU: 1 Dispatch through forwarding agent: Lots exported through a forwarding agent approved by Bruun Rasmussen are exempt from VAT. 2 Export as personal luggage: Goods may be exempt from Danish VAT when the buyer personally takes the goods out of the country as luggage, provided the following conditions have been met: The invoice must have been paid and the Danish duty of 25% of the invoice amount must have been deposited with Bruun Rasmussen. a Buyers residing in Norway will be refunded the Danish VAT as soon as the invoice of sale has been returned to Bruun Rasmussen endorsed by the customs authorities of the country in question or by any other authority with jurisdiction over matters of purchase tax with respect to official imports of goods into the country in question if the purchase price exceeds DKK 1,200. b Buyers residing in other countries outside the EU will be refunded the Danish VAT after the goods have been presented for customs clearance in connection with the departure of the buyer from the EU. The exporter s form should be returned to Bruun Rasmussen after being endorsed with the customs authorities export certificate if the purchase price exceeds DKK 300 This also applies to the Faroe Islands and Greenland. 5. PAYMENT OF TAXES AND DUTIES A. Buyers with VAT-registration in other EU member states who do not wish to make use of Article 3 may instead choose to purchase items subject to Special VAT/Normal VAT in the same manner as private buyers. Bruun Rasmussen must be notified of this before 10 a.m. on the following auction day. B. Buyers with VAT-registration in Denmark may choose to purchase subject to Normal VAT at 25% of the hammer price plus premium. 234 6. COLLECTION OF PURCHASES The purchase price must be paid in full before the purchased lot can be passed over to the buyer. From the time of the lot being knocked down to the buyer, until its collection, the purchased lot will be held at the buyer s own expense and risk. A storage fee will be charged for lots which have not been collected according to agreement. Lots which have been paid for but not collected will be storaged at buyers expense. Lots not collected within 1 year will be resold at auction or privately at the buyer s expense. 7. DISPATCH Should Bruun Rasmussen undertake the packaging and forwarding of purchased goods, this shall be done at the buyer s own expense and risk. Bruun Rasmussen shall thus not be held liable neither for any damage caused to purchased goods during dispatch nor for any missing consignments. 8. DROIT DE SUITE In accordance with Danish copyright law, an additional royalty fee is to be paid for the purchase of works by contemporary Danish artist and some international artists who are either still alive or who have been dead for less than 70 years. The additional royalty fee will be collected by Bruun Rasmussen on behalf of Copydan, which is a Danish-based joint collecting society. Such works are marked with (CD) for Copydan next to the lot number. The Copydan royalty fee is added to the auction price including the buyer s premium when the total exceeds 300. Copydan royalty fees: 5% of the auction price and buyer s premium (excluding VAT) totalling up to 50,000. 3% of the auction price and buyer s premium (excluding VAT) of totals between 50,000 and 200,000. 1% of the auction price and buyer s premium (excluding VAT) of totals between 200,000 and 350, % of the auction price and buyer s premium (excluding VAT) of totals between 350,000 and 500, % of the auction price and buyer s premium (excluding VAT) of totals above 500,000. Copydan royalties must not exceed 12,500 for an individual artwork. The euro exchange rate has been set by Copydan for 2014 at DKK 745,89 per EXPORT LICENCE Applications for an export licence must be made to the Danish Cultural Assets Committee when required in accordance with current Danish legislation on the protection and preservation of cultural assets in Denmark. Where such a licence has not been obtained, the foreign buyer will be informed thereof immediately after the lot has been knocked down to the buyer. Another application will subsequently be sent to the Danish Cultural Assets Committee by Bruun Rasmussen on behalf of the buyer, now that the price is known. Should an export licence not be granted, the Danish Cultural Assets Committee would be obliged to acquire the purchased lot at the purchase price, and the buyer would thus not be bound to the purchase. 10. DESCRIPTION OF LOTS All lots are sold in the condition in which they are found when knocked down and as described in the catalogue and on the homepage with subsequently published changes and modifications. Description is done according to the best of Bruun Rasmussen s knowledge and on the cataloguing principles stated. The lots auctioned are often of some age or of a kind which makes it possible that they may contain defects, deficiencies, or may have been subject to restoration or damage not necessarily stated in the catalogue and on the homepage. Pictures are for identification only and cannot be used for an evaluation of the condition of the goods. Any person who wishes to bid at an auction should therefore satisfy himself of the condition of the lots for which he intends to bid by personal inspection at the preview held prior to the auction. The description is an indication of the prevailing opinion of scholars and expert at the time of the sale. If any doubts should arise after the purchase regarding the genuineness of the purchased lot or its conformance with the description, Bruun Rasmussen should immediately be informed thereof. Should the purchased lot be proved to be a forgery, or if the description contains material errors which lead to a considerably higher hammer price than that which a correct description would presumably result in, the buyer shall be entitled to cancel the purchase, after which the buyer shall be reimbursed for the total purchase price paid plus buyer s premium and VAT, when applicable. For material errors in the description in respect to measurements or weight, compensation shall only be paid on a percentage basis in proportion to the difference. The right of cancellation of a purchase in pursuance of the present conditions can only be exercised by the party who has bought the lot in question at Bruun Rasmussen and shall be subject to the presentation of a claim for cancellation in writing to Bruun Rasmussen within 2 years of the purchase date and to the purchased lot being returned to Bruun Rasmussen in the same condition in any and all respects which the purchased lot was in at the time of the lot being knocked down to the buyer. In the event of cancellation the buyer shall not be entitled to claim payment of interest on the purchase price nor shall the buyer be entitled to claim compensation for any other expenses or loss incurred, including any possible loss of profit in connection with reselling. It shall not be possible to state cancellation of a purchase in pursuance of the above provisions if: a the description on the day the lot was knocked down to the buyer was in accordance with the then generally accepted opinion of scholars and experts; b the only way of establishing whether the lot was a forgery at the time of the sale was the implementation of scientific processes, the validity of which was only acknowledged after the time of the sale, or which would have required a disproportionate amount of cost, or which would have been impossible to carry out without damaging the lot in question. In addition to the time-limits stated above, all purchases are subject to the Statute of Limitations stipulated by danish law by which Bruun Rasmussen is under no circumstance liable for purchases after 5 years from the date of purchase.
