Soulages sorte abstraktioner, dansk samtidskunst og YSL s modestreger Hovedværket på efterårets auktion er maleriet Peinture af Pierre Soulages, der regnes for Frankrigs største nulevende kunstner. Han går under betegnelsen The painter of black, og vi får syn for sagen med det udbudte værk, der domineres af brede sorte penselstrøg iblandet strejf af okker. Det blev til i 1963 og hører dermed til Soulages mest frugtbare periode. Den stadig udøvende kunstner er i dag 95 år, og hans værker er repræsenteret på museer verden over. Som en hyldest til hans betydning for den abstrakt-ekspressive kunst, blev der for et par år siden opført Musée Soulages i hans fødeby Rodez i den sydlige del af Frankrig. Det udbudte maleri blev erhvervet af en dansk kunstsamler hos Galerie de France i Paris i 1973 og har været i samme families eje lige siden (kat.nr. 610). Soulages blev tidligt kendt i Danmark i kraft af vennen og kunstnerkollegaen Mogens Andersen, der i efterkrigsårene promoverede den franske abstrakte kunst med udstillinger på museer og gallerier i København. De samtidige danske og franske kunstnere påvirkede indbyrdes hinanden, som man ser det i Andersens udbudte værk Composition fra 1958, hvis formsprog har visse ligheder med Soulages. Det stammer da også fra den samme danske kunstsamling som maleriet Peinture (kat.nr. 611). Vi sætter også fokus på dansk samtidskunst med en række stærke navne heriblandt Allan Otte, hvis værker ofte bevæger sig i spændingsfeltet mellem ulykke og oprydning. Maleriet To fra 2006 skildrer en forulykket traktor og møder beskueren med den for kunstneren karakteristiske og provokerende vekselvirkning mellem skarphed og uskarphed (kat.nr. 656). Udstillingsaktuelle Eske Kath er mere optaget af eksplosioner, brand, vulkanudbrud og andre naturkatastrofer i et stærkt farvemættet univers, og han er repræsenteret med maleriet Disintegration-Volcano fra 2003 (kat.nr. 663). Med på holdet er også den vietnamesisk fødte kunstner Danh Vo, der ynder at indlejre sin personlige historie set i forhold til verdenshistorien i sine værker. Det bliver aldrig det samme fra 2000-01 hører til kunstnerens tidligste værker fra tiden på kunstakademiet i København, inden han bevægede sig mod en mere konceptuel genre (kat.nr. 678). Bemærk, at man på eftersynets åbningsdag den 10. september kl. 16 kan opleve foredraget At samle på samtidskunst med kunstsamler Jens-Peter Brask. Mode forgår, stil varer evigt få har haft så stor betydning for modeverdenen som Yves Saint Laurent, der fra 1960 erne revolutionerede opfattelsen af mode med sine nytænkende kreationer og introduktionen af jakkesættet til kvinder. Karrieren indledte han som helt ung hos Christian Dior, men grundlagde i 1966 sit eget imperium i modens metropol Paris. Som noget helt ekstraordinært udbyder vi en række af Yves Saint Laurents egne skitser, collager, signerede bøger, fotografier og smykker. Samlingen viser mangfoldigheden af designerens kreative talent og stammer fra en tidligere model, der var nær ven af modeskaberen (fx kat.nr. 811). Det øvrige udbud på auktionen tæller bl.a. et surrealistisk maleri af Wilhelm Freddie med titlen Pro Patria fra 1941, Asger Jorns Happy pigs og Røde trolde for ikke at tale om Per Kirkebys koloristiske malerier (kat.nr. 622, 583 og 635). Soulages Black Abstractions, Danish Contemporary Art and Drawings from the Fashion Icon YSL The centrepiece at this autumn s auction is the painting Peinture by Pierre Soulages, who is considered France s greatest living artist. He is known as the painter of black, which the painting up for auction is also a true testament to, with its broad black brushstrokes mixed with touches of ochre. It was painted in 1963 and belongs to Soulages most productive period. The still active artist is today 95, and his work is exhibited in museums all over the world. As a tribute to his importance to abstract expressionism, the Musée Soulages was established in his native town of Rodez in southern France. The painting up for auction was acquired by a Danish art collector at Galerie de France in Paris in 1973 and has been in the same family ever since (cat. no. 610). Soulages became a well-known name in Denmark early on, due to his friend and fellow artist Mogens Andersen, who after the Second World War promoted French abstract art with exhibitions in museums and galleries in Copenhagen. The contemporary Danish and French artists influenced each other mutually, as can be seen in Andersen s painting Composition from 1958, which is also up for auction. Its idiom has certain similarities with Soulages, and it also comes from the same Danish art collection as Peinture (cat. no. 611). We also focus on Danish contemporary art with a number of strong names - including Allan Otte, whose paintings often move between accident and clean-up. The painting To (Two) from 2006 depicts a crashed tractor and meets the viewer with the artist s distinctive and provocative interplay between sharpness and blurriness (cat. no. 656). The currently exhibited Eske Kath is more concerned with explosions, fires, volcanic eruptions and other natural disasters in a strong colour saturated universe. He is represented by the painting Disintegration-Volcano from 2003 (cat. no. 663). Included in the auction is also the Vietnamese-born artist Danh Vo, who likes to embed his personal history in relation to world history in his works. Det bliver aldrig det samme ( It will never be the same ) from 2000-01 belongs to the artist s earliest work, from the time at the Royal Academy of the Fine Arts in Copenhagen, before he moved in a more conceptual direction (cat. no. 678). Note that you at the opening day of the preview on 10 September at 4 pm can experience the lecture Collecting Contemporary Art with art collector Jens-Peter Brask. Fashions fade, style is eternal - few have had a similar impact on the fashion world as Yves Saint Laurent, who from the 1960s revolutionized the perception of fashion with his innovative creations and the use of suits for women. He began his career as a young man at Christian Dior, but in 1966 he founded his own empire in the fashion metropolis of Paris. As something quite extraordinary we are auctioning off a variety of Yves Saint Laurent s own sketches, collages, signed books, photographs and jewellery. The collection shows the diversity of the designer s creative talent and comes from a former model who was a close friend of the fashion designer (cat. no. 811). The rest of the auction includes a surreal painting by Wilhelm Freddie entitled Pro Patria from 1941, Asger Jorn s Happy pigs and Røde trolde (Red trolls) as well as Per Kirkeby s colouristic paintings (cat. no. 622, 583 and 635). The sculpture "The First Love" is Axel Poulsen's breakthrough piece, and it was a large part of the reason why Poulsen was awarded the Royal Danish Academy of Fine Arts' Eckersberg Medal in 1914. The work was created in Rome and the figures' slender limbs are clearly inspired by the early Italian renaissance and especially Donatello (1386-1466), whom Axel Poulsen felt artistically akin to. Axel Poulsen shared his interest for the early renaissance with his contemporary colleague Einar Utzon-Frank (1888-1955), who, however, to a greater degree was focused on the formal inspiration, while Axel Poulsen was interested in the universal human themes. A version of the motif - created in 1916 - can be found in Copenhagen in the collection at the National Gallery of Denmark, and a version in plaster can be found in the collection at BRANDTS - Museum for Art and Visual Culture in Odense. Just as Asger Jorn, Swedish artist Nils Adolf Wedel (1897-1967) was early in his career oriented towards Modernism within French art. From 1921-22 he studied under Othon Friesz at Académie Moderne in Paris, a period in which he met Fernand Léger. The encounter with the marked simplicity of Léger's art became a turning point in the development of Wedel's own idiom and he later described his introduction to Cubism as the most seminal experience in his life. Years later, 17-year-old Asger Jorn followed in the same track when in 1936 he travelled to Paris where he defined the future of his artistic career as a student at Léger's Académie Contemporaine. Jorn and Wedel's road crossed in Copenhagen when in November 1945 Jorn was planning an exhibition of Danish art in Sweden and Niels Wedel exhibited at the autumn exhibition Høstudstillingen. In the summer of 1946, Jorn travelled to Sweden and visited, among others, Niels Wedel in Orust north of Gothenburg on his way to Saxnäs in Lapland. The three paintings currently on auction all originate from Niels Wedel's collection and presumably came into his possession during their joint preparations for exhibitions or in connection with Jorn's trips to Sweden and his stays there in 1945-46. In continuation of the celebration of Asger Jorn's 100th anniversary in 2014, which included major exhibitions and publications, a movement has begun with the stated goal of nuancing Jorn's multifaceted efforts in relation to the - in Denmark - confidential CoBrA-narrative. Asger Jorn is widely regarded as a beacon within European post-war expressionism, but he was, due to his energy and his dedication and commitment to artistic development, much more than this: author, organizer, situationist, activist and avant-gardist. In the book "The Art and Politics of Asger Jorn - the Avant-Garde Won t Give Up" (2014), the American art historian Karen Kurczynski is concerned with the complexity and contradictions of Jorn. For instance that "he is completely marginalized in the United States (...)" (Tom Hermansen: "Asger Jorn: wild, political and manic" in "SMK#7", the National Gallery of Denmark, Copenhagen 2014). Kurczynski s book places Jorn in an overlapping area between the European Art Informel, tachisme and lyrical abstraction AND The New Yorker School s abstract expressionism from the 1950s and 1960s: "Like the Informal artists, Jorn has been overshadowed by the New York School, with which he shares common ground (...) Not only did Cobra predate the widespread recognition of Abstract Expressionism in Europe, but it's techniques of spontaneous composition, grotesque semi-figuration, and a primitivist approach to gestural painting - all elements shared with the New York School developed directly out of the explorations of the earlier Helhesten group in Denmark during the war "(Kurczynski p. 10). In the catalogue for Asger Jorn's first solo exhibition at the Lefebre Gallery in New York in 1962 where the piece "Happy pigs" was exhibited - the art historian Werner Haftmann highlights Jorn in "the general panorama of Western art. Haftmann also directly highlights the simultaneousness and similarity in the European and American trends regarding the spontaneous expressive method. Jorn s "Happy pigs" is with its energetic, vibrant brushstrokes a highly distinctive piece from the period in which layers upon layers of colours can at once be seen as a figuration as well as witnessing the pure physical energy of the act of painting. Everything significant occurs within this creative 'meanwhile' (which is one of the mysteries of art) Before is irrelevant... And after we stand in front of a fait accompli, a definite result, definitely locked in its own moment in time, and which we call a painting. (Pierre Alechinsky in "Interview with Michael Gibson" in Pierre Alechinsky: Margin and Centre, exhibition catalogue, New York, 1987, s. 15) In the mid-1960s Pierre Alechinsky paints a number of large canvases where a myriad of small figures grow out of a surface dominated by a diversity in colour and arabesque-like, meandering lines. The painting is made with great intensity and spontaneity, but also with sublime mastery of the method. In the catalogue for an exhibition in 1969 at Louisiana Museum of Modern Art, Humlebæk, the artist describes - in line with the above quote - his painting process as an internal and open dialogue between the eyes and the hand, contemplation and movement. A self-forgetfulness or a straightforward trance in which the eyes and the hand in joyous moments meet up in surprising and unexpected connections (Pierre Alechinsky: "Notes" in "Alechinsky" Louisiana Museum of Modern Art, Humlebæk; Palais des Beaux-Arts, Brussels, and more. 1969, p. 15). The painting "Mongolfier" from 1966 is an excellent work from the period, which since its acquisition by Galerie Birch - around 1970 - has been in the same family s possession. Will be sold with a copy of the original invoice from the gallery. Pierre Soulages (b. 1919) is - literally and figuratively - the grand old man of French abstract painting. At the age of 95 he is recognized as the greatest living painter in France. His beginnings in post-war Paris, his international breakthrough in the mid-1950s and most recently the inauguration of the Musée Soulages in Rodez in southern France, all rest on a highly rigorous artistic effort. Therefore, it is a particular pleasure to be able to present an excellent painting from the crucial period in the early 1960s, where Pierre Soulages established himself as a European equivalent to the New York School of abstract and gestural expressionism included names such as Willem de Kooning (1904-1997) and Mark Rothko (1903-1970). Only at a first glance is it paradoxical that the painter known as "The Painter of Black" and "Le Maître de l'outrenoir" also deals extensively with light. In the artist's all-black "Outrenoir" paintings from 1979 and onwards the light becomes an external effect on the viewer's encounter with the artwork. In "Peinture, 16 novembre 1963" the resolute, black strokes step forward from a background of a white canvas with deep tones of glazed burnt and luminous ochre. Pierre Soulages' relation to Denmark was from early on a strong one - not least because of the friend and fellow painter Mogens Andersen (1916-2003), who in the postwar years worked diligently to promote French lyrical abstraction in Denmark. Pierre Soulages had his first exhibition in Denmark in 1950 as part of the "Levende Farver" (Living Colours) exhibition at Charlottenborg organized by the Society of French Art, individually Soulages exhibited at Galerie Birch in 1951, and he had one of his first retrospective exhibitions at the Ny Carlsberg Glyptotek in Copenhagen in 1963 - the year where the painting currently up for auction was made. Mogens Andersen was from the end of WW2 the truly great bridge builder between French and Danish contemporary art, and the curiosity in the Danish exhibition circles towards French art was in general great. From the mid-1940s the Society of French Art' organized numerous exhibitions of French art at Ny Carlsberg Glyptotek, The National Gallery of Denmark and Charlottenborg among other places. The suggestion of writing the book "French Modern Painting" (1948) became the pretext for Mogens Andersen to visit the many artists in Paris whom he admired - and with whom he established lifelong friendships, when he later settled in France. The two French artists whom Mogens Andersen held dearest were André Marfaing (1925-1987) and Pierre Soulages (b. 1919). Peter Michael Hornung writes about these two significant reference points in his monograph on Mogens Andersen (1991): "The connection between Mogens Andersen and Marfaing was more than a shared affinity for material moderation. It was a friendship (...) That Soulages had to become the second reference point, artistically as well as socially, for Mogens Andersen in his self-chosen expatriate-life seems inevitable for anyone who has seen Soulages' paintings or experienced the man behind the artwork. The two, the Frenchman and 'the Frenchiest of the Danes' (as Ole Sarvig once described Mogens Andersen), first met in 1951 at a Soulages-vernissage at Birch. Strikingly few guests showed up, perhaps not by Danish standards, but at least according to French custom. The absence of other people was presumably the banal reason the two painters struck up a conversation. And they cannot have exchanged many thoughts, before they realized how much they had in common, in their present lives as well as in their past."(hornung, p. 109-110). The painting up for sale has for decades been in the same collection as the painting by Pierre Soulages - "Peinture" of 1963 which is also up for sale at the current auction. Raymond Hains belongs - along with artists such as Yves Klein, Arman, Daniel Spoerri, Jean Tinguely, César and Mimmo Rotella - among the founders of the "Nouveau Réalisme" (New Realism) grouping. From 1960-61 they rallied around the art critic Pierre Restany s thoughts about a "poetic recycling of urban, industrial and advertising reality". The name "Nouveau Réalisme" borrows from the historic style of 'realism' a representation of reality without idealization with the addition of "New", partly because the artwork now arises out of the consumer society and partly because the artist no longer reflects or represents an external reality but chooses or points to something that already exists. "Nouveau Réalisme" can to a great extent be seen as the European counterpart of American pop art, which developed during the same period. (Pierre Restany: "60/90 - trente ans de Nouveau Réalisme", Paris 1990, p. 76). The work up for auction is from 1961, and it is a great example of the artist's production in precisely the years around the establishment of "Nouveau Réalisme". The works made on metal plates are at once readymades taken out of a reality context and "reverse painting" where the artist removes paper material to promote an already underlying composition. Ill. in colours on the front cover. Wilhelm Freddie paid a very high price for his defence of artistic freedom of expression: ridicule, prison and exile. Freddie took an early stand against Nazism, an opposition which culminated in the in many ways amazing painting "Meditation on anti-nazi Love" from 1936 (now at KUNSTEN - Museum of Modern Art Aalborg) where Freddie - as Charlie Chaplin did in "The Dictator" - uses humour to effectively make fun of Hitler, while the artist also warns of the looming danger. The exhibition of this painting resulted in Freddie being banned from entering into Germany. During the German occupation of Denmark, the artist was increasingly under greater and greater threat and finally had to flee to Sweden, where he settled in Stockholm and quickly made contact with a number of other refugees from different European locations. In "Pro Patria" it is, among other aspects, the celebration of the national symbol of the Danish flag, Dannebrog, which Freddie uses to show his resistance against the German occupation. When André Breton in 1947 invited Freddie to participate in an international surrealist exhibition in Paris, Freddie sent three paintings. The first was "The intervals and signatures of the light and shadows," 1946, which was both on display and included in the exhibition catalogue, number 42, but not depicted. The second painting was "Arabian pralines, 1946 (now at KUNSTEN - Museum of Modern Art Aalborg), which was neither exhibited nor depicted. The third painting was "Psycho-Photographic Phenomenon: Sabotage", 1944 (now at KUNSTEN - Museum of Modern Art Aalborg), which was also not depicted in the catalogue, though it was exhibited. This has not been mentioned previously, but it has now been documented in photographs. Furthermore, Freddie sent three sketches (now at KUNSTEN - Museum of Modern Art Aalborg) to serve as models for display cabinets, which were not used, as well as written material and photos of artwork including "Pro Patria", which was not shipped, yet it was depicted in the catalogue. Most well known - internationally as well as in Denmark - is the judicial persecution of Freddie because of his alleged "pornographic works of art". A trial in 1937 resulted in imprisonment and confiscation of three of Freddie s paintings. These paintings were subsequently stored at the Prison Museum until 1963, where they after a two-year retrial, caused by Freddie having exhibited replicas of the three works, were finally handed over to Freddie, and he himself was acquitted. The French art historian and critic José Pierre wrote essays for the retrospective Wilhelm Freddie exhibition at the National Gallery of Denmark in 1989. These essays were later placed on display at Liljevalchs Konsthall in Stockholm and at ARKEN Museum of Modern Art during an exhibition of the later work from 1996 to 1997. They were also shown at the former Nordjyllands Kunstmuseum (North Jutland Art Museum). As José Pierre noticed, while he was in Denmark in 1988 to view the artwork he was writing about, Freddie's legendary reputation had, due to the persecution and trials, to some extent overshadowed the overall artistic oeuvre s quality and significance. The importance of this, particularly in its erotic dimension, was clearly expressed in José Pierre's conclusion, during his opening address at ARKEN 16 November 1996: "En ce qui concerne notre XXe siècle, il me semble, mais cela n'engage que moi, que ce ne sont ni des écrivains ni des savants mais des artistes qui auront le mieux contribué à èclairer cet "infracassable noyau de nuit" que André Breton avait décelé au coeur de notre vie amoureuse. The works up for auction are therefore a crossover and a game played with the categories of sculpture, painting and graphics, since the surface of the reliefs resemble enlarged copper printing plates. The underlying motif and the recognizable quality of former times seem, at this point, to completely fade away in non-objects and pictorial gesture. Yet at the same time the paintings always seem to keep a relation to the impression or the motif that made the artist start creating. In 1984 Per Kirkeby said: "Paintings never arise from nothing, nor abstract paintings". In 2006-07 Kunsthallen Brandts in Odense, Kunsthalle Zu Kiel and Henie Onstad Kunstsenter in Oslo devoted an exhibition to the examination of the figurative aspect in the production of Per Kirkeby in the 1980s. In the exhibition catalogue Dörte Zbikowski writes: "In the paintings that at first seem to be abstract paintings, recognisable motifs can gradually emerge - figure, trunk, landscape. They can hardly be disengaged though from the tense interaction with the painting. The colour spots, are they really figures? What the inexperienced viewer will read of the play of colours in this style of painting free of gestures and in the way, in which Kirkeby renders the figure, remains contradictory. (...) The essential thing is that the abstraction of Kirkeby is rooted in the figurative, that he sees content and pictorial realization as one indivisible unity". Allan Stone - noted art dealer and collector Allan Stone was a vital and respected New York art collector and dealer who ignored art world fashion and embraced artists whose work stirred him perso nally. He became active in the art world in the late 1950s while working as a lawyer on Wall Street. He dispensed free legal advice to artists. By 1960, Mr. Stone wanted to open a gallery, but was only able to do so after about 30 of his co-workers at his law firm raised $5,000 for him to begin his gallery. During the gallery s first year the law firm s head steno grapher did its typing, while her husband, a flower trucker, transported its art. He was legendary in the New York art world for his obsessive collecting. His gallery and his home teemed with primitive and folk art. At one point he owned a multitude of de Koonings and nearly 30 Bugatti automobiles. He gave first or early New York shows to the sculptors César and Robert Mallory and to the painters Richard Estes and Wayne Thiebaud. He owned numerous works by John Chamberlain. He made impressive exhibitions, often accompanied by catalogs for which he wrote essays filled with personal reminiscences and unusual insights. The photograph depicts John Lennon and Yoko Ono in bed surrounded by flowers during their famous "Bed-In" at the Queen Elizabeth Hotel s suite 1742 in Montreal, Canada, in June 1969. During the weeklong happening the walls of the hotel room were decorated with John Lennon's drawings and slogans of peace. In the photograph a drawing with a similar motif is seen hanging on the wall behind the couple, above Yoko Ono. This drawing cannot be identified as the exact same drawing based on the photograph. In the movie "BED PEACE starring John Lennon & Yoko Ono" (available at http://imaginepeace.com/ archives/15702), however, it is apparent from several sequences that it must be the very same drawing. During the happening in Montreal the couple recorded the song "Give Peace a Chance", which became a worldwide hit and a symbol of the peace movement throughout the 1970s. In the song there is a direct reference to the concept of "Bagism", which was part of the couple's showdown with prejudice and stereotypical attitudes between people. Bagism involved literally wearing a bag over one's entire body. According to John and Yoko, by living in a bag, a person could not be judged by others on the basis of skin color, gender, hair length, attire, age, or any other such attributes. D. 180 cm. 1986 became a high point in Robert Jacobsen's Asian adventure with the unveiling of the monumental iron sculpture "Venskab" (Friendship) in the People's Republic of China, "I, who do not write, I looked at the Chinese writing... I saw them sculpturally," says Robert Jacobsen. From his studio near Egtved the artist worked with Chinese calligraphy in his later career. The simple beauty of the characters appealed to Jacobsen and resulted in a range of sculptural abstractions related to China, whereof none, however, have the format to match the magnificent "Venskab". The story begins many years earlier, all the way back to Egtved-pigen (the Egtved girl) and her burial place in the undulating countryside around Vejle. Here Jacobsen constructs, in the years 1986-1991, a series of landscape sculptures in a dialogue with the area's history, materials and the sun's movement across the sky. While the day moves from light towards darkness, and the year moves from winter to summer, the appearance of the sculptures change. "Happiness" from 1981 is a small wooden model of "Venskab". The sculpture gazes both ahead and back into history, timeless yet subject to the present, as a primordial form preceding both Jacobsen's work with the nature of Jutland and the Chinese culture. The sculpture exists in several different versions. A bronze version of the sculpture is situated in Kongens Have, while the large iron sculpture has been resold to the Sammlung Würth, Künzelsau, Germany. Provenance: Galleri Christina Wilson, Copenhagen. Explosions, fire, volcanic eruptions and other natural disasters are the focal point in Eske Kath's imagery. The artistic idiom is simple and expressed through a strong colour universe, a universe, which almost blows the viewer away in the encounter with the artwork. A Baroque piece dressed in new clothing one could say. The artwork captures and envelops the viewer as in the Baroque style, and Eske Kath manages in this way to create an interesting clash between previous periods style and the natural disasters of contemporary times. Eske Kath has for a longer period made his mark on the Danish contemporary scene, and he has, among other things, decorated a ceiling in Frederik 8's palace at Amalienborg. At first glance, Bjarne Melgaard's works seem confusing and messy, but to Melgaard himself, the works are a form of signature: "Well, the words on my drawings and paintings also function as a kind of 'signature' or a 'tag'. As for 'self-revelations' sometimes I do want to appear as 'nothing more to lose' but just as much as 'nothing can ever be lost'. People always think you 'tell it all' because they have no imagination of their own, that it can be much more than they ever imagine behind a word or an action. I will never reveal my secrets because I believe that a person without any secrets is like a poster and I don't think art is a place either to do this or articulate things in such way. Graffiti, street art and punk meet each other in an elegant way in Jan S. Hansen s artwork. The young artist graduated from the Royal Danish Academy of Fine Arts in 2010 and is already a household name in contemporary art circles. He works with everything from painting, graphics and photography to assemblage, ceramics and bleach on cotton. Hansen s artwork is to some extent superficial, but he actually uses the surface as a syndicator for what is going on inside. The artwork is filled with rituals, necklaces, teeth and pocket knife-ornaments. No paintings are given a title and no paintings are forced to have a meaning. The paint, the frame and the canvas interaction personifies and stages the artwork. In his blinds paintings Morten Lund Skrøder does not touch the front of the canvas. Instead he applies the paint on the back of the canvas and pulls on the cord! Disse numre er mærket med en stjerne (*). Danske momsregistrerede købere skal overfor Bruun Rasmussen oplyse deres SE-/CVR-nr. (moms-nr.), da dette skal anføres på de fakturaer, hvor varen købes i fuld moms. For visse udenlandske købere gælder der særlige regler for afgiftsfritagelse jvf. 4. Afgiftsfritagelse omfatter ikke EU private købere, som ligestilles med danske købere jvf. gældende dansk lovgivning om handel med brugte varer, kunstgenstande, samlerobjekter og antikviteter. Købesummen forfalder til betaling ved tilslaget. Der kan betales kontant op til DKK 50.000 eller med Dankort, banknoteret check, rejsechecks, Visa-, Master-, Diners Club- eller Eurocard. Personlige udenlandske checks kan kun anvendes efter forudgående aftale. På de traditionelle auktioner i Bredgade skal betaling af købte emner finde sted under eller umiddelbart efter auktionen og under alle omstændigheder senest 8 dage efter fakturadatoen. På net-auktionerne trækkes købesummen automatisk på det af kunden oplyste betalings-/kreditkort i forbindelse med, at det købte emne udtages til transport (ca. 12 timer efter dagens salg). Samtidig tilsendes køber faktura og transportoplysninger. Betales købesummen ikke rettidigt, skal der svares rente heraf med 1,5% pr. påbegyndt måned. Betales købesum og renter ikke inden 8 dage efter at Bruun Rasmussen har afsendt påkrav herom til køber, er Bruun Rasmussen berettiget til at annullere købet og bortsælge det købte på ny auktion hos Bruun Rasmussen eller underhånden og afkræve køber ethvert herved opstået tab. Et eventuelt overskud tilfalder den, der har indleveret det købte til auktion. Har den misligholdende køber tilgodehavender fra salg af effekter hos Bruun Rasmussen, er Bruun Rasmussen berettiget til at berigtige ethvert tilgodehavende hos køber ved modregning. Har den misligholdende køber indleveret andre effekter til salg, er Bruun Rasmussen berettiget til at bortsælge sådanne effekter på auktion hos Bruun Rasmussen uden at være bundet af en af den misligholdende køber fastsat mindstepris. Den misligholdende køber er ikke berettiget til at kræve udlevering af effekter indleveret til salg, så længe forfalden gæld til Bruun Rasmussen ikke er betalt, uanset om værdien af sådanne effekter må anses at overstige forfalden gæld. Bruun Rasmussen er berettiget til at afvise bud afgivet af en køber, der er i misligholdelse med sine betalingsforpligtelser over for Bruun Rasmussen eller et bud afgivet af en anden på den pågældendes vegne, ligesom Bruun Rasmussen er berettiget til at kræve et depositum som betingelse for accept af fremtidige bud. 3. FORTRYDELSESRET A. Ved køb på alle traditionelle auktioner er der ikke fortrydelsesret. Køb kan derfor ikke fortrydes, uanset om budafgivning er via web-kommissionsbud, live-bidding eller på anden vis. B. For privatkøb af emner på en online-auktion gælder loven om fjernsalg, herunder også 14 dages fortrydelsesret. Eventuelle omkostninger forbundet med transport af købte emner retur fra køber, betales af køber selv. Såfremt køber benytter sig af sin fortrydelsesret, refunderer Bruun Rasmussen betalingen umiddelbart efter, at varen er sendt retur og modtaget af Bruun Rasmussen. Bruun Rasmussen gør opmærksom på, at det herefter er op til bankerne/kreditkortselskaberne, hvornår refusionen indgår på købers konto. 4. AFGIFTSFRITAGELSE Udenlandske købere, der opfylder nedennævnte betingelser, betaler henholdsvis 24% i auktionsomkostninger af hammerslaget på traditional auktion og 20% i auktionsomkostninger af hammerslaget på net-auktion, og bliver ikke belastet af danske afgifter. A. Købere med bopæl i et andet EU-land: Købere, som er momsregistreret i et andet EU-land, fritages for at betale dansk moms, når momsregistreringen dokumenteres over for Bruun Rasmussen, som skal påføre momsnummeret på fakturaen. B. Købere med bopæl uden for EU: 1. Forsendelse gennem speditør: Effekter, der eksporteres gennem en af Bruun Rasmussen godkendt speditør, fritages for afgift. 2. Udførsel som rejsegods: Der kan ske fritagelse for dansk afgift, når køberen selv medtager det købte under forudsætning af, at følgende betingelser er opfyldt: Fakturaen skal være betalt, og den danske afgift på 25% af fakturabeløbet skal være deponeret hos Bruun Rasmussen. a. Købere med fast bopæl i Norge vil få den danske moms refunderet, så snart Bruun Rasmussen har modtaget købsfakturaen retur med påtegning om officiel indførsel fra det endelige lands toldmyndighed eller anden på omsætnings-afgiftsområdet kompetent myndighed, hvis købet overstiger DKK 1.200. b. Købere med fast bopæl andre steder uden for EU vil få den danske moms refunderet, efter at effekterne har været forevist til toldbehandling i forbindelse med køberens udrejse fra EU. Eksportørblanketten returneres til Bruun Rasmussen efter at være forsynet med et toldvæsens attest for udførslen, hvis købet overstiger DKK 300. Dette gælder også for Færøerne og Grønland. 5. AFGIFTSBETALING A. Momsregistrerede i andre EU-lande, der ikke ønsker at gøre brug af 4, kan i stedet vælge at handle til brugtmoms/fuldmoms på lige fod med private købere. Dette skal meddeles Bruun Rasmussen inden kl. 10 den følgende auktionsdag. B. Momsregistrerede i Danmark kan vælge at købe til fuldmoms med 25% af både hammerslag og auktionsomkostninger. 6. UDLEVERING Købesummen skal være betalt, inden det købte kan udleveres til køberen. Det købte henligger fra hammerslaget for købers regning og risiko. For varer, der ikke afhentes ifølge aftale efter hammerslaget, vil blive kørt på fjernlager på købers regning og risiko. Købte varer, der er betalt, men ikke afhentet, vil efter 1 år blive videresolgt for købers regning ved auktion eller underhånden. 7. FORSENDELSE Såfremt Bruun Rasmussen påtager sig at emballere og fremsende købte varer, sker dette på købers regning og risiko. Bruun Rasmussen kan således ikke drages til ansvar for skader forvoldt på købte varer under forsendelse eller for forsvundne forsendelser. 8. KUNSTNERAFGIFT TIL COPY-DAN CD Ifølge gældende dansk lovgivning om ophavsret skal der opkræves følgeretsvederlag for værker af nyere danske og visse udenlandske kunstnere, som enten er nulevende eller ikke har været døde i mere end 70 år. Følgeretsvederlaget opkræves af Bruun Rasmussen på vegne af kunstnernes organisation Copydan. Disse værker er mærket (CD) for Copydan ud for katalognummeret. Den såkaldte Copydan-afgift tillægges hammerslagsprisen inkl. salær, når beløbet overstiger 300. Copydan-afgiften er: 5% af den del af hammerslagsprisen og salæret (ekskl. moms), der udgør indtil 50.000. 3% af den del af hammerslagsprisen og salæret (ekskl. moms), der ligger mellem 50.000 og 200.000. 1% af den del af hammerslagsprisen og salæret (ekskl. moms), der ligger mellem 200.000 og 350.000. 0,5% af den del af hammerslagsslagsprisen (ekskl. moms), der ligger mellem 350.000 og 500.000. 0,25% af den del af hammerslagsprisen (ekskl. moms), der ligger over 500.000. Copydan-afgiften kan ikke overstige 12.500 for det enkelte kunstværk. Euro-kursen er fastsat af Copydan i 2015 til kurs 744,01 pr. 100. 9. EKSPORTTILLADELSE Kulturværdiudvalget er blevet ansøgt om eksporttilladelse, hvor dette kræves iflg. gældende dansk lovgivning om sikring af kulturværdier i Danmark. Foreligger en sådan ikke, vil dette blive meddelt den udenlandske køber umiddelbart efter hammerslaget. Derefter vil Bruun Rasmussen igen ansøge Kulturværdiudvalget på købers vegne, nu hvor prisen kendes. Gives eksporttilladelse ikke, er Kulturværdiudvalget forpligtet til at overtage det købte til den opnåede pris, hvilket betyder at købet bliver hævet for køber. 10. BESKRIVELSE AF EMNER Alt sælges i den stand, hvori det ved hammerslaget er at forefinde og som beskrevet i katalog eller hjemmeside med senere offentliggjorte ændringer og modifikationer. Beskrivelsen er foretaget efter bedste overbevisning og under anvendelse af de anførte katalogiseringsprincipper. De solgte effekter er ofte af en alder eller af en art, der bevirker, at de kan være behæftet med fejl, mangler, restaurering eller beskadigelser, der ikke nødvendigvis angives i katalog eller på hjemmesiden. Afbildninger i katalog eller på hjemmesiden er blot til identifikation og kan ikke anvendes til vurdering af effekternes stand. Enhver der ønsker at byde på auktion, bør derfor ved selvsyn på de før auktionen afholdte eftersyn forvisse sig om de ønskede effekters stand. Beskrivelsen er udtryk for den på salgstidspunktet blandt lærde og eksperter herskende opfattelse. Skulle der efter købet opstå tvivl om det købtes ægthed eller dettes overensstemmelse med beskrivelsen, skal dette straks meddeles til Bruun Rasmussen. Såfremt det må erkendes, at det købte er en forfalskning, eller såfremt beskrivelsen har været behæftet med væsentlige fejl, der har medført en væsentlig højere hammerslagspris, end en korrekt beskrivelse må antages at ville have resulteret i, er køber berettiget til at annullere købet, hvorefter den samlede erlagte købesum tillagt auktionsomkostninger og evt. moms, vil blive refunderet køber. Væsentlige fejl i beskrivelsen relateret til mål eller vægt erstattes kun procentuelt i forhold til differencen. Retten til under de her anførte betingelser at annullere et køb kan kun udøves af den, der købte den pågældende effekt hos Bruun Rasmussen og er betinget af, at krav om annullering fremsættes skriftligt over for Bruun Rasmussen inden 2 år efter købsdagen, og af at det købte inden samme frist returneres til Bruun Rasmussen i den samme stand i enhver henseende, som det købte var i på hammerslagstidspunktet. Køber kan i tilfælde af annullering ikke gøre krav på betaling af renter af købesummen og er ej heller berettiget til at kræve anden udgift eller tab, herunder eventuel mistet videresalgsfortjeneste, dækket. Et køb kan ikke kræves annulleret efter ovenstående bestemmelser, såfremt: a. beskrivelsen i katalog eller på hjemmesiden på hammerslagsdagen var i overensstemmelse med den på dette tidspunkt gældende opfattelse blandt lærde og eksperter. b. den eneste måde til på salgstidspunktet at få fastslået et falskneri var iværksættelsen af videnskabelige processer, hvis gyldighed først blev anerkendt efter salgstidspunktet, eller som ville have været uforholdsmæssigt omkostningskrævende eller uigennemførlige uden beskadigelse af den pågældende effekt. I tillæg til ovenstående frist gælder de almindelige forældelsesregler i forældelsesloven, efter hvilke køber ikke under nogen omstændigheder kan gøre noget krav gældende over for Bruun Rasmussen, når der er forløbet mere end 5 år fra købsdagen. KOMMISSIONER Bruun Rasmussen Kunstauktioner Jesper Bruun Rasmussen, Auktionsholder Jørgen Byriel, Auktionsleder Bruun Rasmussen påtager sig at byde i kommission for bydere, der ikke kan være til stede ved auktionen. Det er en forudsætning, at kommissioner indleveret pr. brev eller fax er Bruun Rasmussen i hænde i 24 timer før auktionens start, så om nødvendigt bydernes kreditværdighed kan undersøges. Via hjemmesiden er denne deadline 3 timer. Bruun Rasmussen påtager sig intet ansvar for eventuelle fejltagelser, der måtte opstå ved brug af denne service KONDITIONSRAPPORTER Bruun Rasmussen påtager sig, hvis det er muligt, at orientere nærmere om numrenes kondition og tilstand. CONDITIONS OF PURCHASE 1. BIDDING The buyer shall be the highest bidder at the hammer price. Any person bidding on behalf of a third party shall be liable in surety for completion of the sale. At the request of Bruun Rasmussen Kunstauktioner (hereinafter called Bruun Rasmussen), all bidders, whether they wish to make bids in person at the place of auction or commission bids by letter, fax or the homepage direct telephone bids or the homepage, should be able to document their ability to pay and be able to provide proof of identity at any time. Bruun Rasmussen is entitled to refuse to accept a bid if, when requested, adequate security or adequate payment on account has not been rendered. Bids should be made by the bidder in person at the place of auction or by written commission by letter, fax or the homepage. For online auctions alle bids are submitted via the homepage. Telephone bidding is possible within certain conditions made out by Bruun Rasmussen. Bruun Rasmussen is not to be held responsible for any errors that may occur using this service. The auctioneer shall have absolute discretion as to the increment of the bids. The auctioneer will also make decisions in all cases of doubt regarding the bidding. Credit/debit card information must be registered with Bruun Rasmussen before bids can be submitted. 2. PAYMENT Purchases made at all Bruun Rasmussen traditional salesroom auctions are subject to a 30% fee (for wines, coins and stamps 25%), which covers 24% buyer s premium plus VAT of the premium. Purchases made at all Bruun Rasmussen online auctions are subject to a 25% fee, which covers 20% buyer s premium and VAT of the premium. Certain lots are sold in accordance with specific rules on normal VAT arrangement (hereinafter called normal VAT), so that the purchase price is the hammer price plus an additional 24% (for online auctions, wines, coins and stamps 20%) in buyer s premium and VAT of 25% levied on both the hammer price and the buyer s premium. The lots subject to Full VAT are indicated as such in the catalogue and on the homepage with an asterisk (*). Danish VAT registered buyers shall provide Bruun Rasmussen with documentation of their SE-/CVR -number (VAT No.) as this has to be quoted on the invoice for goods bought at full VAT. For some foreign buyers, specific VAT-exemption rules apply (cf. Article 3). VAT-exemption does not apply to private buyers from the EU who are considered as Danish buyers (cf. current Danish legislation on Special VAT Scheme for Sales of Works of Art, Collectors items and Antiques by Public Auction). The purchase price falls due for payment when the goods have been knocked down. Payment may be made in cash up to DKK 50,000, by Dankort, banker s cheque, traveller s cheque, Visa-, Master-, Diners Club- or Eurocard. Personal foreign cheques may only be used for payment by prior arrangement. At traditional auctions payment for purchased items must be made during or immediately after the auction. Under all circumstances payment must be made no later than eight days from the date of the invoice. With online auctions, payment automatically takes place when the items are prepared for dispatch (circa 12 hours after the purchase has been made) using the credit/ debit card details submitted by the purchaser. At the same time an invoice and dispatch information will be sent to the purchaser. Should the purchase price not be paid by the due date, interest at 1.5 % per new month will be charged. If the purchase price and interest are not paid within eight days after Bruun Rasmussen has sent its demand to the buyer, Bruun Rasmussen shall be entitled to rescind the sale and resell the goods at a Bruun Rasmussen auction or privately, and to demand reimbursement of any related losses from the defaulting buyer. Any further profit on the sale shall be payable to the person who had deposited the goods for sale by auction. If the defaulting buyer is entitled to proceeds from a sale of goods by Bruun Rasmussen, Bruun Rasmussen shall be entitled to set off its receivables against its payables to the defaulting buyer. If the defaulting buyer has deposited other goods for sale, Bruun Rasmussen shall be entitled to sell such goods at a Bruun Rasmussen auction without being bound by the reserve stipulated by the defaulting buyer. The defautling buyer shall not be entitled to demand the surrender of goods deposited for sale as long as the debt payable to Bruun Rasmussen has not been discharged, regardless of whether the value of such goods may be deemed to exceed the debt payable. Bruun Rasmussen shall be entitled to refuse a bid made by a buyer who is in default in respect to his payment obligations to Bruun Rasmussen, as well as a bid made by a third party on behalf of such a defaulting buyer. Bruun Rasmussen shall further be entitled to demand a deposit as a condition of accepting any future bids from such a purchaserr. 3. MONEY-BACK GUARANTEE A. Purchases made on all traditional salesroom auctions are uncoditional and can not be cancelled regardless of the type of bid such as absentee web bid, live-bidding or otherwise. B. Online purchase of items by private individuals is subject to Danish consumer law, which extends 14 days of money-back guarantee. The purchaser is liable for any costs related to the transport of returned items. Should a purchaser seek to avail himself or herself of the money-back guarantee, Bruun Rasmussen will refund the payment on receiving the returned items. Please note that the date on which accounts are debited is subject to the policy of the purchaser s bank/credit card company. 4. EXEMPTION FROM VAT International purchasers, who fulfill the conditions stipulated below, must pay a fee of 24% of the auction price at traditional salesroom auctions and a 20% fee of auction prices for items purchased online. They are exempt from the payment of Danish VAT.: A. Buyers residing in another EU Member State: Buyers are exempt from paying Danish VAT as long as they have provided Bruun Rasmussen with documentation of their VAT registration. The VAT number will then be quoted on Bruun Rasmussen s invoice. B. Buyers residing outside the EU: 1 Dispatch through forwarding agent: Lots exported through a forwarding agent approved by Bruun Rasmussen are exempt from VAT. 2 Export as personal luggage: Goods may be exempt from Danish VAT when the buyer personally takes the goods out of the country as luggage, provided the following conditions have been met: The invoice must have been paid and the Danish duty of 25% of the invoice amount must have been deposited with Bruun Rasmussen. a Buyers residing in Norway will be refunded the Danish VAT as soon as the invoice of sale has been returned to Bruun Rasmussen endorsed by the customs authorities of the country in question or by any other authority with jurisdiction over matters of purchase tax with respect to official imports of goods into the country in question if the purchase price exceeds DKK 1,200. b Buyers residing in other countries outside the EU will be refunded the Danish VAT after the goods have been presented for customs clearance in connection with the departure of the buyer from the EU. The exporter s form should be returned to Bruun Rasmussen after being endorsed with the customs authorities export certificate if the purchase price exceeds DKK 300 This also applies to the Faroe Islands and Greenland. 5. PAYMENT OF TAXES AND DUTIES A. Buyers with VAT-registration in other EU member states who do not wish to make use of Article 3 may instead choose to purchase items subject to Special VAT/Normal VAT in the same manner as private buyers. Bruun Rasmussen must be notified of this before 10 a.m. on the following auction day. B. Buyers with VAT-registration in Denmark may choose to purchase subject to Normal VAT at 25% of the hammer price plus premium. 6. COLLECTION OF PURCHASES The purchase price must be paid in full before the purchased lot can be passed over to the buyer. From the time of the lot being knocked down to the buyer, until its collection, the purchased lot will be held at the buyer s own expense and risk. A storage fee will be charged for lots which have not been collected according to agreement. Lots which have been paid for but not collected will be storaged at buyers expense. Lots not collected within 1 year will be resold at auction or privately at the buyer s expense. 7. DISPATCH Should Bruun Rasmussen undertake the packaging and forwarding of purchased goods, this shall be done at the buyer s own expense and risk. Bruun Rasmussen shall thus not be held liable neither for any damage caused to purchased goods during dispatch nor for any missing consignments. 8. DROIT DE SUITE In accordance with Danish copyright law, an additional royalty fee is to be paid for the purchase of works by contemporary Danish artist and some international artists who are either still alive or who have been dead for less than 70 years. The additional royalty fee will be collected by Bruun Rasmussen on behalf of Copydan, which is a Danish-based joint collecting society. Such works are marked with (CD) for Copydan next to the lot number. The Copydan royalty fee is added to the auction price including the buyer s premium when the total exceeds 300. Copydan royalty fees: 5% of the auction price and buyer s premium (excluding VAT) totalling up to 50,000. 3% of the auction price and buyer s premium (excluding VAT) of totals between 50,000 and 200,000. 1% of the auction price and buyer s premium (excluding VAT) of totals between 200,000 and 350,000. 0.5% of the auction price and buyer s premium (excluding VAT) of totals between 350,000 and 500,000. 0.25% of the auction price and buyer s premium (excluding VAT) of totals above 500,000. Copydan royalties must not exceed 12,500 for an individual artwork. The euro exchange rate has been set by Copydan for 2015 at DKK 744,01 per 100. 9. EXPORT LICENCE Applications for an export licence must be made to the Danish Cultural Assets Committee when required in accordance with current Danish legislation on the protection and preservation of cultural assets in Denmark. Where such a licence has not been obtained, the foreign buyer will be informed thereof immediately after the lot has been knocked down to the buyer. Another application will subsequently be sent to the Danish Cultural Assets Committee by Bruun Rasmussen on behalf of the buyer, now that the price is known. Should an export licence not be granted, the Danish Cultural Assets Committee would be obliged to acquire the purchased lot at the purchase price, and the buyer would thus not be bound to the purchase. 10. DESCRIPTION OF LOTS All lots are sold in the condition in which they are found when knocked down and as described in the catalogue and on the homepage with subsequently published changes and modifications. Description is done according to the best of Bruun Rasmussen s knowledge and on the cataloguing principles stated. The lots auctioned are often of some age or of a kind which makes it possible that they may contain defects, deficiencies, or may have been subject to restoration or damage not necessarily stated in the catalogue and on the homepage. Pictures are for identification only and cannot be used for an evaluation of the condition of the goods. Any person who wishes to bid at an auction should therefore satisfy himself of the condition of the lots for which he intends to bid by personal inspection at the preview held prior to the auction. The description is an indication of the prevailing opinion of scholars and expert at the time of the sale. If any doubts should arise after the purchase regarding the genuineness of the purchased lot or its conformance with the description, Bruun Rasmussen should immediately be informed thereof. Should the purchased lot be proved to be a forgery, or if the description contains material errors which lead to a considerably higher hammer price than that which a correct description would presumably result in, the buyer shall be entitled to cancel the purchase, after which the buyer shall be reimbursed for the total purchase price paid plus buyer s premium and VAT, when applicable. For material errors in the description in respect to measurements or weight, compensation shall only be paid on a percentage basis in proportion to the difference. The right of cancellation of a purchase in pursuance of the present conditions can only be exercised by the party who has bought the lot in question at Bruun Rasmussen and shall be subject to the presentation of a claim for cancellation in writing to Bruun Rasmussen within 2 years of the purchase date and to the purchased lot being returned to Bruun Rasmussen in the same condition in any and all respects which the purchased lot was in at the time of the lot being knocked down to the buyer. In the event of cancellation the buyer shall not be entitled to claim payment of interest on the purchase price nor shall the buyer be entitled to claim compensation for any other expenses or loss incurred, including any possible loss of profit in connection with reselling. It shall not be possible to state cancellation of a purchase in pursuance of the above provisions if: a the description on the day the lot was knocked down to the buyer was in accordance with the then generally accepted opinion of scholars and experts; b the only way of establishing whether the lot was a forgery at the time of the sale was the implementation of scientific processes, the validity of which was only acknowledged after the time of the sale, or which would have required a disproportionate amount of cost, or which would have been impossible to carry out without damaging the lot in question. In addition to the time-limits stated above, all purchases are subject to the Statute of Limitations stipulated by danish law by which Bruun Rasmussen is under no circumstance liable for purchases after 5 years from the date of purchase. COMMISSION Bruun Rasmussen Auctioneers Jesper Bruun Rasmussen, auctioneer Jørgen Byriel, officially appointed external supervisor Bruun Rasmussen undertakes to execute commission bids for bidders who are unable to be present at the auction. It is a prerequisite that Bruun Rasmussen receives the commissions by letter, fax or telephone 24 hours before the start of the auction for the bidders credit to be checked, if necessary.
