Welcome to the Modern Art Autumn Sale at Bruun Rasmussen We are pleased to present three new catalogues of which the first two feature a rich and varied selection of modern pictorial art. The works offered will hopefully be met with enthusiasm by our Danish and international audience. The October sale embraces both the diversity and the established upper end of a vital art market, which in recent years has enjoyed an increased interest and demand. At this auction we are especially excited to be able to offer a number of important international works coming from a prominent Scandinavian private collection. Ed Ruscha, Alex Katz, John Kacere and Gerhard Richter are all artists who have set the agenda in their respective field of work Pop Art, New Realism, Photorealism and Abstract painting and who have all left their imprint on the history of art. Focus articles on the artists can be found inside the catalogue. In continuation of the American Photorealism, the auction features a fine collection of original works by the Danish photorealist par excellence Hans Henrik Lerfeldt and a comprehensive Photography section including works by Hiroshi Sugimoto, Nobuyoshi Araki, Per Bak Jensen, Bert Stern and Ray Schatt. Among the many international highlights at this preview, the monumental painting The Night Guard by the Norwegian artist Odd Nerdrum and also the Chinese artist Chu Teh-Chun s Composition from 1959 should be emphasized. As usual, the preview also offers the possibility of becoming acquainted with a large selection of works by the Danish Classical Modernists. Hans Scherfig is represented with two rich jungle compositions, in a rare large format, from the 1940s. Included are also several fine paintings by Vilhelm Lundstrøm, Oluf Høst and Jens Søndergaard. Among the rarities is an Avant-garde Modernist winter picture from 1918-20 painted by Anton Hansen, usually known for his small-format drawings. The Classical section is concluded by a number of works by North Atlantic artists, including Samuel Joensen-Mikines, Gunnlaugur Blöndal and Jon Stefansson. Leading the Cobra section is Asger Jorn s large colourful painting La colline enchantée from 1957. The painting is accompanied by the early work Maskefigur og Fugl, created by Ejler Bille in 1946. Finally the auction features an impressive array of Contemporary Art, topped by Michael Kvium, Per Kirkeby and Kurt Trampedach. Besides works by Poul Anker Bech, Peter Martensen and the young generation of artists as Tal R, John Kørner and Olafur Eliasson, the very popular and highly sought after Julie Nord will make her auction debut. De udbudte værker vil forhåbentlig imødekomme og begejstre vores danske og internationale publikum. Oktober måneds auktion favner både i højden og bredden et vitalt moderne kunstmarked, der i de seneste år har nydt stadigt stigende interesse og efterspørgsel. Med særlig glæde og stolthed kan vi på denne auktion udbyde en række væsentlige internationale værker fra en betydelig skandinavisk privatsamling. Ed Ruscha, Alex Katz, John Kacere og Gerhard Richter er navne, der inden for henholdsvis popkunsten, ny- og fotorealismen samt det abstrakte maleri har været dagsordenssættende og sat deres tydelige fingeraftryk i kunsthistorien. Der kan læses mere om de enkelte kunstnere længere inde i kataloget. I forlængelse af den amerikanske fotorealisme byder auktionen på en flot samling originalarbejder af den danske fotorealist par excellence, Hans Henrik Lerfeldt og en særdeles velassorteret fotografisektion med værker af bl.a. Hiroshi Sugimoto, Nobuyoshi Araki, Per Bak Jensen, Bert Stern og Ray Schatt. Blandt de helt sjældne ting finder man et avantgarde-modernistisk vintermaleri fra 1918-20 af Anton Hansen, der ellers mest kendes som tegner i det lille format. Det klassiske afsnit rundes af Nordatlanten, idet vi kan fremvise flere værker af Samuel Joensen-Mikines, Gunnlaugur Blöndal og Jon Stefansson. Blandt værkerne af Cobra-bevægelsens kunstnerne skal især Asger Jorns store, stoflige og farvestærke La colline enchantée fra 1957 fremhæves. Dette billede får bl.a. selskab af det tidlige Maskefigur og Fugl, malet af Ejler Bille i 1946. Sluttelig er afsnittet med samtidskunst, med Michael Kvium, Per Kirkeby og Kurt Trampedach i spidsen, stærkt besat. Foruden værker af kendinge som Poul Anker Bech, Peter Martensen og hele den unge generation med Tal R, John Kørner og Olafur Eliasson får bl.a. en yderst populær og efterspurgt kunstner som Julie Nord auktionsdebut. The Crucial Years 1954-1964, no. 1040. 1957 is the year Jorn settles in Italy after having bought a dilapidated house on the hillside near Albisola, and the year he introduces the Situationist International movement together with Guy Debord. At the same time he establishes commercial contacts with the German businessman Otto van de Loo and his gallery in Munich, which was later to play an important role in the international dissemination of Jorn s art. In his paintings from this period, Jorn allows himself to be influenced by the new current, which under the name of Tachism was on the go in European art and which implied a dissolution of the painting s figuration in material elements. The term Tachism was coined by the French critic Michel Tapié, in relation to a style of painting with irregular and spontaneous spots on the canvas (the French word tache meaning spot). The European Tachism is clearly related to the American Abstract Expressionism and especially to Jackson Pollock s Action painting without showing quite the same unrestrained wildness and aggression though. In his Tachism-inspired paintings, Jorn, in fact, kept a clear drawing and figuration despite the pronounced importance to the material. Provenance: Galerie H. Le Gendre, 31 rue Guénégaud, Paris. Born in the province of Jiangsu, China in 1920, Chu Teh-Chun graduated from the National Academy of Arts in Hangzhou in 1941. He was appointed assistant professor at the Hangzhou Academy and later taught painting in Nanjing and in Taiwan, before moving to Paris in 1955. He later obtained French citizenship in 1981. In Paris he became part of the young Parisian art scene, exhibiting widely at salons and galleries, among these the Galerie Le Gendre with whom he signed a six-year contract in 1958. During the late '50s Chu Teh-Chun moved away from the academic realm, rediscovering the spiritual source in Chinese painting and by this created his very own personal idiom. His poetic works and landscapes in particular seem to be springing intuitively from the artist's mind rather than being based on direct observations. Chu Teh-Chun's work has been exhibited internationally in France, the United States, Taiwan and in China. In this depicion of Yan Yu's chosen subject, the smoker, the sensation is curiously positive. The use of gold as background suggests prosperity which the tobacco on the canvas parallels as a kind of currency. The danger of the material wealth leading to disease is known but ignored in favour of living life to the full. In this way the painting becomes a celebration of life and the artist's achievement. It seems to say: "Yes smoking kills, but I am going to enjoy this one right now". Yan Yu lives and works in the artist village of Song Zhuang near Beijing. The yellow skin complexion, the quinced eye which appears to have been touched by smoke and the brightly coloured background which can be associated with Chinese medication. She is however without a cigarette. It is mysteriously missing from the portrait. Even the slightly open lips of the subject is suggesting a dangling cigarette. This painting is from the period when Yan Yu started enjoying success and recognition as an artist. The cigarette, which has become a main identification point, in it's absence on the canvas can be seen as a cheerful take on an art world which expects the cigarette - pointing also to the self confident artist who takes it away. Provenance: Scandinavian Private Collection. Before moving to a realistic style around 1963 John Kacere was an abstract painter. Since then, he concentrated almost solely on the subject of woman and today is regarded one of the major photo-realists or hyper-realists in American art. While enrolled in the army and stationed in California during the World War II years Kacere began studying the work of modern European painters such as Picasso, Miro, Klee and Matisse. Upon leaving the army he studied Fine Arts at the University of Iowa. From the 1950's and onwards he performed as a teacher at several art schools: University of Florida, the Rhode Island School of Design, New York University and the Parsons School of Design in New York City among others. Despite some criticism from feminists, some of whom have labelled his work sexist, Kacere has continued to explore the female body in his paintings. "Woman is the source of all life, the source of regeneration," he has said. "My work praises that aspect of womanhood." During the last 40 years Ed Ruscha has been a prominent figure in American contemporary art. Originally Ruscha was identified with the Pop Art of California where depictions of gas stations and Hollywood logos were the central parts. But parallel to his fascination of pop culture Ruscha had a deep respect for the surrealist artists. The surrealist art developing during the 1920s and 1930s, built upon pure imagination, experiments and phenomena that were disturbing the conventional concept of art. Artists such as Marcel Duchamp and Man Ray were later to become important models for Ed Ruscha: I became aware of Marcel Duchamp s work... and I liked the work of Man Ray. I think those artists had a strong effect on me. Like Man Ray, Ed Ruscha was deeply fascinated by the photographic element. Man Ray constructed surrealistic arrangements, which he documented by means of the photography. He depicted elements from everyday life put together in an obscure context such as an apple placed next to a screw. Like Man Ray s obscure mixing of familiar objects, you see Ed Ruscha working in the same direction. In the three paintings offered for sale: Sheet stained with rose petal ; Suspended paper stained with iodine ; and Four sheets stained with egg white, the inspiration from surrealist art is evident. The unconventional mix of materials like fouling that has been dabbed carefully on to the paper with a cotton puff mixed with rose petals, iodine and egg white, forces the viewer to wonder. Wonder about the mix of materials and the true meaning of that. Likewise you see the sheets floating in the air like in Magritte s surrealistic works containing various flying objects, a compositional dodge adding to the viewer s astonishment. Alex Katz is one of the most prominent American figurative painters in the generation of Pop Artists and Realists immediately following the Abstract Expressionists. Since the late 1950s Katz has developed his own personal imagery often portraits of his friends and family or scenes from everyday life depicted in a way that renders a feeling of presence, that seems artless and straightforward and yet at the same time highly simplified, stylized and superficial. Throughout his career, Alex Katz has especially been inspired by advertising and billboards, and he has deliberately been striving to achieve clarity and a visual impact that would be able to compete with that kind of aesthetics. The artist himself has said that during his career he has been focusing on finding his very own big style in painting, which he considers much more important than the depicted motif in itself: I like the style to be the content. One motif or should we say one person occupies however a very special place in the artist s works: his wife Ada whom he has portrayed consistently for more than 50 years without revealing however anything deeper on her personality. Robert Storr writes on the Ada portraits: "How little we know about her after all. That is her job. To keep us guessing (...). We - the viewers - enter into this compact of infinitely deferred intimacy without hesitation. We are beckoned and respond, only to be stopped tantalizingly short of the threshold of total visual possession by qualities of abstraction that are as difficult to grasp on their own as the person they incompletely constitute. This is not true for the artist who has applied all of his craft to contrive this presence and, while knowing his subject well, tells no more about her than (...) necessary to conjure her into existence". In his artistic work the German artist Gerhard Richter covers a wide field ranging from an early photorealism to abstract paintings and severe minimalist expressions. In his paintings, tense energy exists between the depicted everyday life and the very topicality of the painting. To Richter the process of painting and the painting as a material are two very important factors. The artist s various expressions differ widely in some ways, and yet they are also connected as part of an inevitable pictorial development. His early use of photos, private as well as public, has provided the background for his work and the way he reflects the perceived reality on the canvas. He subsequently blurs the painting either by means of a brush or by his very own technique with a rubber scraper. This blurring of the picture emphasizes both the painting s photographic background and the consciousness of the artist s involvement. In his abstract paintings, Richter continues this way of constructing a picture with several layers and meanings. Richter s development towards the abstract painting really accelerated when he evolved his Colour Charts. Based upon the three primary colours; red, blue and yellow together with black and white, Richter created his Colour Charts containing up to 1024 various hues. The way in which only three colours can grow into a universe of colours is evident in the present painting "Red-Yellow-Blue (no. 38)", created in 1973. The work is part of a series of 100 small works that can each be seen as an individual painting. His use of broad brush strokes emphasizes the picture s tactility and at the same time, layers are ripped from the painting s surface showing the areas behind. This abstract way of painting can thus be regarded as a natural development from the early photorealism. Both the abstract painting and the photorealism want to represent life around us by emphasizing and at the same time blurring the space and by uncovering the layers behind. The underlying motif and the recognizable quality of former times seem, at this point, to completely fade away in non-objects and pictorial gesture. Yet at the same time the paintings always seem to keep a relation to the impression or the motif that made the artist start creating. In 1984 Per Kirkeby said: Paintings never arise from nothing, nor abstract paintings. In 2006-07 Kunsthallen Brandts in Odense, Kunsthalle Zu Kiel and Henie Onstad Kunstsenter in Oslo devoted an exhibition to the examination of the figurative aspect in the production of Per Kirkeby in the 1980s. In the exhibition catalogue Dörte Zbikowski writes: In the paintings that at first seem to be abstract paintings, recognisable motifs can gradually emerge figure, trunk, landscape. They can hardly be disengaged though from the tense interaction with the painting. The colour spots, are they really figures? What the inexperienced viewer will read of the play of colours in this style of painting free of gestures and in the way, in which Kirkeby renders the figure, remains contradictory. (...) The essential thing is that the abstraction of Kirkeby is rooted in the figurative, that he sees content and pictorial realization as one indivisible unity. With his dark toned mysterious paintings depicting animals and human beings, Kurt Trampedach has taken up a central position on the figurative Danish art scene. Trampedach's paintings are realistic and expressive - modern and yet at the same time seemingly referring to the art of primitive tribes. Since the early 1960s and until the 1980s, Trampedach's own portrait was often depicted in the paintings. Subsequently, he changed his subject matter and imagery, introducing children, animals and women. The present painting, "Anette", is Trampedach's depiction of a woman. "Anette" is seen in a reclining position surrounded by a dark space. The dark space, enveloping the woman in her twisted posture, is a way for the artist to define the mental state of the woman. Trampedach's depictions of himself and of others should be seen as psychological and mental depictions rather than typical portraits and self-portraits. The work has not previously been exhibited or offered for sale. In the years after 1984, the idiom of Michael Kvium changed decisively. After having painted motorcycle paintings and depictions of tattooed men and women, often painted in a super-realistic and sometimes pop-inspired style, the artist, by the beginning of 1985, moved towards the idiom that has become his distinctive feature. Confronted with the painting "Portræt af en nyreligiøs" (Portrait of a Neo-religious) in 2007, Michael Kvium writes: It is funny to see it again after so many years. I made quite a few portraits of states of mind at that time, with similar titles, as for example Portrait of a Suicide. It is the year of my graduation from the Academy where I am working in a studio in Vingårdsstræde in Copenhagen. Very simple pictures that are slowly leading me to more complex pictures in the following years, as for example A Kitchen Scene and The Dog Lover. Since the mid 1990s the artist and writer Kaspar Bonnén has concerned himself with the depiction and exploration of spaces and spatialities. In his paintings, often based on his own home and private life, you will find multiple layers of spatialities in the shape of colourful silhouettes overlapping each other. In larger compositions, ordinary articles for everyday use and pieces of furniture are mixed together tending towards pure abstractions. For the artist, a space is not just a physical occurrence, but also and just as much a mental state of mind. In the article "Jeg vil være rum" ("I want to be space") from 2004, Bonnén writes: "Using simple forms, I try to create the illusion of spaces and a multiplicity of ways in which they can manifest themselves. 115 115 In the book "Solo" Peter Martensen describes how the present painting became a turning point in his artistic career: I made my first almost 100 % monochrome picture in 1986. That is to say I used black and white with a touch of ultramarine to tone down the black and a little ochre to warm up the white. It was a large painting in three panels, a painting of a café that was created at the time when all those French-inspired cafés emerged in Copenhagen. When you walked past the cafés, you looked in through the window and at the same time saw the reflection mixed with images from indoors- indoors and outdoors met on the membrane of the window pane. I painted the picture on the strength of the feeling that there is an indoors and an outdoors that give rise to a confusion of opposites and collisions. Efter de nye regler er det kun auktionsomkostninger, der skal tillægges moms, og ikke som tidligere varens fulde pris. I auktionsomkostninger er indregnet ikke fradragsberettiget moms. Fuld moms * anvendes for visse varer som ikke kan handles i brugt moms. Disse er mærket med en stjerne *. Købere skal betale 20% i auktionsomkostninger, hvortil lægges 25% moms af hammerslaget og auktionsomkostningerne. Reducerede auktionsomkostninger 20% betales af købere der opfylder følgende betingelser: 1. Danske momsregistrerede købere kan vælge at betale 20% i auktionsomkostninger + 25% moms af hele (fuldmoms). Momsbeløbet kan køber modregne, og betaler derved 20% i auktionsomkostninger. 2. Under the Auctioneers Margin Scheme the premium only is subject to VAT, i.e. the hammer price is exempted from VAT. k ø b s k o n d i t i o n e r 1. Budgivning Køber er den byder, der får hammerslag. Den, der byder for andre, hæfter som selvskyldnerkautionist for berigtigelsen af købet. På opfordring fra Bruun Rasmussen Kunstauktioner (herefter benævnt Bruun Rasmussen), skal alle bydere, hvadenten de ønsker at afgive et bud ved personligt fremmøde på auktionsstedet eller afgive en kommission pr. brev eller fax eller byde direkte pr. telefon, kunne dokumentere deres betalingsdygtighed samt til enhver tid identificere sig. Bruun Rasmussen er altid berettiget til at nægte at acceptere et bud, hvis på forlangende ikke tilstrækkelig sikkerhed er stillet eller en passende à conto betaling har fundet sted. Bud afgives af byderen ved personligt fremmøde på auktionsstedet eller ved skriftlig kommission. Afgivelse af bud pr. telefon er muligt under visse forudsætninger, der afgøres af Bruun Rasmussen. Hvilke katalognumre der sælges til fuldmoms fremgår af kataloget med stjerne *. Danske momsregistrerede købere skal overfor os oplyse deres SE-/ CVR-nr. (moms-nr.), da dette skal anføres på de fakturaer, hvor varen købes i fuld moms. For visse udenlandske købere gælder der særlige regler for afgiftsfritagelse jvf. 3. Afgiftsfritagelse omfatter ikke EU private købere, som ligestilles med danske købere jvf. gældende dansk lovgivning om handel med brugte varer, kunstgenstande, samlerobjekter og antikviteter. Købesummen forfalder til betaling ved tilslaget. Der kan betales kontant op til DKK 100.000 eller med Dankort, banknoteret check, rejsechecks, Visa-, Master-, Diners Club- eller Eurocard. Personlige udenlandske checks kan kun anvendes efter forudgående aftale. Betaling kan finde sted under eller umiddelbart efter auktionen og under alle omstændigheder skal betaling finde sted senest 8 dage efter fakturadatoen. Betales købesummen ikke rettidigt, skal der svares rente heraf med 1,5% pr. påbegyndt måned. Betales købesum og renter ikke inden 8 dage efter at Bruun Rasmussen har afsendt påkrav herom til køber, er Bruun Rasmussen berettiget til at annullere købet og bortsælge det købte på ny auktion hos Bruun Rasmussen eller underhånden og afkræve køber ethvert herved opstået tab. Et eventuelt overskud tilfalder den, der har indleveret det købte til auktion. Har den misligholdende køber tilgodehavender fra salg af effekter hos Bruun Rasmussen, er Bruun Rasmussen berettiget til at berigtige ethvert tilgodehavende hos køber ved modregning. Har den misligholdende køber indleveret andre effekter til salg, er Bruun Rasmussen berettiget til at bortsælge sådanne effekter på auktion hos Bruun Rasmussen uden at være bundet af en af den misligholdende køber fastsat mindstepris. Den misligholdende køber er ikke berettiget til at kræve udlevering af effekter indleveret til salg, så længe forfalden gæld til Bruun Rasmussen ikke er betalt, uanset om værdien af sådanne effekter må anses at overstige forfalden gæld. Bruun Rasmussen er berettiget til at afvise bud afgivet af en køber, der er i misligholdelse med sine betalingsforpligtelser over for Bruun Rasmussen eller et bud afgivet af en anden på den pågældendes vegne, ligesom Bruun Rasmussen er berettiget til at kræve et depositum som betingelse for accept af fremtidige bud. 3. Afgiftsfritagelse Udenlandske købere, der opfylder nedennævnte betingelser, betaler 20% i auktionsomkostninger af hammerslaget, og bliver ikke belastet af danske afgifter. A. Købere med bopæl i et andet EU-land: Købere, som er momsregistreret i et andet EU-land, fritages for at betale dansk moms, når momsregistreringen dokumenteres over for Bruun Rasmussen, som skal påføre momsnummeret på fakturaen. B. Købere med bopæl uden for EU: 1 Forsendelse gennem speditør: Effekter, der eksporteres gennem en af Bruun Rasmussen godkendt speditør, fritages for afgift. 2 Udførsel som rejsegods: Der kan ske fritagelse for dansk afgift, når køberen selv medtager det købte under forudsætning af, at følgende betingelser er opfyldt: Fakturaen skal være betalt, og den danske afgift på 25% af fakturabeløbet skal være deponeret hos Bruun Rasmussen. a Købere med fast bopæl i Norge vil få den danske moms refunderet, så snart Bruun Rasmussen har modtaget købsfakturaen retur med påtegning om officiel indførsel fra det endelige lands toldmyndighed eller anden på omsætningsafgiftsområdet kompetent myndighed, hvis købet overstiger DKK 1.200. b Købere med fast bopæl andre steder uden for EU vil få den danske moms refunderet, efter at effekterne har været forevist til toldbehandling i forbindelse med køberens udrejse fra EU. Eksportørblanketten returneres til Bruun Rasmussen efter at være forsynet med et toldvæsens attest for udførslen, hvis købet overstiger DKK 300. Dette gælder også for Færøerne og Grønland. 4. Afgiftsbetaling A. Momsregistrerede i andre EU-lande, der ikke ønsker at gøre brug af 3, kan i stedet vælge at handle til brugtmoms/fuldmoms på lige fod med private købere. Dette skal meddeles os inden kl. 10 den følgende auktionsdag. B. Momsregistrerede i Danmark kan vælge at købe til fuldmoms med 25% af både hammerslag og auktionsomkostninger. Dette skal meddeles os inden kl. 10 den følgende auktionsdag. 5. Udlevering Købesummen skal være betalt, inden det købte kan udleveres til køberen. Det købte henligger fra hammerslaget for købers regning og risiko. For varer, der ikke er afhentet 14 dage efter hammerslaget, vil der blive opkrævet opbevaringsgebyr. Købte varer, der er betalt, men ikke afhentet, vil efter 1 år blive videresolgt for købers regning ved auktion eller underhånden. 6. Forsendelse Såfremt Bruun Rasmussen påtager sig at emballere og fremsende købte varer, sker dette på købers regning og risiko. 7. Kunstnerafgift til Copy-Dan CD Ifølge gældende dansk lovgivning om ophavsret skal der opkræves følgeretsvederlag på værker af alle nyere danske og visse udenlandske kunstnere. Følgeretsvederlaget opkræves hos køber af Bruun Rasmussen på vegne af kunstnernes organisation Copy-Dan, for de kunstværker, der er omfattet af loven. Disse værker er mærket CD for Copy-Dan ud for katalognummeret. Følgeretsvederlaget beregnes som følger for det enkelte kunstværk, når hammerslagsprisen overstiger DKK 1.863: 5% af den del af hammerslagsprisen, der ligger mellem DKK 0 og DKK 310.596 med tillæg af auktionsomkostninger på 20% ekskl. afgift 3% af den del af hammerslagsprisen, der ligger mellem DKK 310.567 og DKK 1.242.383 med tillæg af auktionsomkostninger på 20% ekskl. afgift 1% af den del af hammerslagsprisen, der ligger mellem DKK 1.242.267 og DKK 2.174.171 med tillæg af auktionsomkostninger på 20% ekskl. afgift 0,5% af den del af hammerslagsprisen, der ligger mellem DKK 2.173.967 og DKK 3.105.958 med tillæg af auktionsomkostninger på 20% ekskl. afgift 0,25% af den del af hammerslagsprisen, der ligger over DKK 3.105.958 med tillæg af auktionsomkostninger på 20% ekskl. afgift Copy-Dan afgiften kan ikke overstige DKK 93.179 for det enkelte kunstværk. 8. Eksporttilladelse Kulturværdiudvalget er blevet ansøgt om eksporttilladelse, hvor dette kræves iflg. gældende dansk lovgivning om sikring af kulturværdier i Danmark. Foreligger en sådan ikke, vil dette blive meddelt den udenlandske køber umiddelbart efter hammerslaget. Derefter vil Bruun Rasmussen igen ansøge Kulturværdiudvalget på købers vegne, nu hvor prisen kendes. Gives eksporttilladelse ikke, er Kulturværdiudvalget forpligtet til at overtage det købte til den opnåede pris, hvilket betyder at købet bliver hævet for køber. 9. Katalogisering Alt sælges i den stand, hvori det ved hammerslaget er at forefinde og som beskrevet i kataloget med senere offentliggjorte ændringer og modifikationer. Katalogiseringen er foretaget efter bedste overbevisning og under anvendelse af de anførte katalogiseringsprincipper. De solgte effekter er ofte af en alder eller af en art, der bevirker, at de kan være behæftet med fejl, mangler, restaurering eller beskadigelser, der ikke nødvendigvis angives i kataloget. Afbildninger i kataloget er blot til identifikation og kan ikke anvendes til vurdering af effekternes stand. Enhver der ønsker at byde på auktion, bør derfor ved selvsyn på de før auktionen afholdte eftersyn forvisse sig om de ønskede effekters stand. Katalogbeskrivelsen er udtryk for den på tidspunktet for katalogets trykning blandt lærde og eksperter herskende opfattelse. Skulle der efter købet opstå tvivl om det købtes ægthed eller dettes overensstemmelse med katalogbeskrivelsen, skal dette straks meddeles til Bruun Rasmussen. Såfremt det må erkendes, at det købte er en forfalskning, eller såfremt katalogbeskrivelsen har været behæftet med væsentlige fejl, der har medført en væsentlig højere hammerslagspris, end en korrekt katalogbeskrivelse må antages at ville have resulteret i, er køber berettiget til at annullere købet, hvorefter den samlede erlagte købesum, dog højst den i kataloget angivne højeste vurderingspris tillagt auktionsomkostninger og evt. moms, vil blive refunderet køber. Væsentlige fejl i katalogbeskrivelsen relateret til mål eller vægt erstattes kun procentuelt i forhold til differencen. Retten til under de her anførte betingelser at annullere et køb kan kun udøves af den, der købte den pågældende effekt hos Bruun Rasmussen og er betinget af, at krav om annullering fremsættes skriftligt over for Bruun Rasmussen inden 2 år efter købsdagen, og af at det købte inden samme frist returneres til Bruun Rasmussen i den samme stand i enhver henseende, som det købte var i på hammerslagstidspunktet. Køber kan i tilfælde af annullering ikke gøre krav på betaling af renter af købesummen og er ej heller berettiget til at kræve anden udgift eller tab, herunder eventuel mistet videresalgsfortjeneste, dækket. Et køb kan ikke kræves annulleret efter ovenstående bestemmelser, såfremt: a beskrivelsen i kataloget på hammerslagsdagen var i overensstemmelse med den på dette tidspunkt gældende opfattelse blandt lærde og eksperter. b den eneste måde til på katalogets udgivelsestidspunkt at få fastslået et falskneri var iværksættelsen af videnskabelige processer, hvis gyldighed først blev anerkendt efter katalogets udgivelsestidspunkt eller som ville have været uforholdsmæssigt omkostningskrævende eller uigennemførlige uden beskadigelse af den pågældende effekt. KOMMISSIONER Bruun Rasmussen Kunstauktioner Jesper Bruun Rasmussen, Auktionsholder Jørgen Byriel, Auktionsleder Bruun Rasmussen påtager sig at byde i kommission for bydere, der ikke kan være til stede ved auktionen. Det er en forudsætning, at kommissionen er Bruun Rasmussen i hænde 24 timer før auktionens start, så om nødvendigt bydernes kreditværdighed kan undersøges. Bruun Rasmussen påtager sig intet ansvar for eventuelle fejltagelser, der måtte opstå ved brug af denne service. Konditionsrapporter Bruun Rasmussen påtager sig, hvis det er muligt, at orientere nærmere om katalognumrenes kondition og tilstand. Dette er ment som en service for kunder, der ikke selv har mulighed for ved selvsyn at undersøge numrene på eftersynet. FRITAGELSE FOR DANSK FULDMOMS Købere skal ifølge 2 betale fuldmoms af de varer der i kataloget er markeret med stjerne *. Når virksomheder, der er momsregistrerede i andre EU-lande, køber hos Bruun Rasmussen og videresælger til private, skal der ikke betales dansk moms, men moms i henhold til de regler der gælder, hvor den udenlandske virksomhed er momsregistreret. c o n d i t i o n s o f p u r c h a s e 1. Bidding The buyer shall be the highest bidder at the hammer price. Any person bidding on behalf of a third party shall be liable in surety for completion of the sale. At the request of Bruun Rasmussen Kunstauktioner (hereinafter called Bruun Rasmussen), all bidders, whether they wish to make bids in person at the place of auction or commission bids by letter or fax or direct telephone bids, should be able to document their ability to pay and be able to provide proof of identity at any time. Bruun Rasmussen is entitled to refuse to accept a bid if, when requested, adequate security or adequate payment on account has not been rendered. Bids should be made by the bidder in person at the place of auction or by written commission. Telephone bidding is possible within certain conditions made out by Bruun Rasmussen. Bruun Rasmussen is not to be held responsible for any errors that may occur using this service. The auctioneer shall have absolute discretion as to the increment of the bids. The auctioneer will also make decisions in all cases of doubt regarding the bidding. 2. Payment The purchase price is the hammer price plus 25% in buyer s premium, including VAT, for lots sold subject to the special VAT scheme for sales of Works of Art, Collectors items and Antiques, and secondhand goods by Public Auction (hereinafter called Special VAT). Certain lots are sold in accordance with specific rules on normal VAT arrangement (hereinafter called normal VAT), so that the purchase price is the hammer price plus an additional 20% in buyer s premium and VAT of 25% levied on both the hammer price and the buyer s premium. The lots subject to Full VAT are indicated as such in the catalogue with an asterix (*). Danish VAT registered buyers shall provide us with documentation of their SE-/CVR-number (VAT No.) as this has to be quoted on the invoice for goods bought at full VAT. For some foreign buyers, specific VAT-exemption rules apply (cf. Article 3). VAT-exemption does not apply to private buyers from the EU who are considered as Danish buyers (cf. current Danish legislation on Special VAT Scheme for Sales of Works of Art, Collectors items and Antiques by Public Auction). The purchase price falls due for payment when the goods have been knocked down. Payment may be made in cash up to DKK 100,000, by Dankort, banker s cheque, traveller s cheque, Visa-, Master-, Diners Club- or Eurocard. Personal foreign cheques may only be used for payment by prior arrangement. Payment may be made during or immediately after the auction. Under all circumstances payment must be made no later than eight days from the date of the invoice. Should the purchase price not be paid by the due date, interest at 1.5 % per new month will be charged. If the purchase price and interest are not paid within eight days after Bruun Rasmussen has sent its demand to the buyer, Bruun Rasmussen shall be entitled to rescind the sale and resell the goods at a Bruun Rasmussen auction or privately, and to demand reimbursement of any related losses from the defaulting buyer. Any further profit on the sale shall be payable to the person who had deposited the goods for sale by auction. If the defaulting buyer is entitled to proceeds from a sale of goods by Bruun Rasmussen, Bruun Rasmussen shall be entitled to set off its receivables against its payables to the defaulting buyer. If the defaulting buyer has deposited other goods for sale, Bruun Rasmussen shall be entitled to sell such goods at a Bruun Rasmussen auction without being bound by the reserve stipulated by the defaulting buyer. The defautling buyer shall not be entitled to demand the surrender of goods deposited for sale as long as the debt payable to Bruun Rasmussen has not been discharged, regardless of whether the value of such goods may be deemed to exceed the debt payable. Bruun Rasmussen shall be entitled to refuse a bid made by a buyer who is in default in respect to his payment obligations to Bruun Rasmussen, as well as a bid made by a third party on behalf of such a defaulting buyer. Bruun Rasmussen shall further be entitled to demand a deposit as a condition of accepting any future bids from such a purchaser. 3. Exemption from VAT Foreign buyers who fulfil the conditions stated below shall pay 20% of the hammer price in buyer s premium and shall not be subject to Danish taxes and duties: A. Buyers residing in another EU Member State: Buyers are exempt from paying Danish VAT as long as they have provided Bruun Rasmussen with documentation of their VAT registration. The VAT number will then be quoted on Bruun Rasmussen s invoice. B. Buyers residing outside the EU: 1 Dispatch through forwarding agent: Lots exported through a forwarding agent approved by Bruun Rasmussen are exempt from VAT. 2 Export as personal luggage: Goods may be exempt from Danish VAT when the buyer personally takes the goods out of the country as luggage, provided the following conditions have been met: The invoice must have been paid and the Danish duty of 25% of the invoice amount must have been deposited with Bruun Rasmussen. a Buyers residing in Norway will be refunded the Danish VAT as soon as the invoice of sale has been returned to Bruun Rasmussen endorsed by the customs authorities of the country in question or by any other authority with jurisdiction over matters of purchase tax with respect to official imports of goods into the country in question if the purchase price exceeds DKK 1,200. b Buyers residing in other countries outside the EU will be refunded the Danish VAT after the goods have been presented for customs clearance in connection with the departure of the buyer from the EU. The exporter s form should be returned to Bruun Rasmussen after being endorsed with the customs authorities export certificate if the purchase price exceeds DKK 300 This also applies to the Faroe Islands and Greenland. 4. Payment of taxes and duties A. Buyers with VAT-registration in other EU member states who do not wish to make use of Article 3 may instead choose to purchase items subject to Special VAT/Normal VAT in the same manner as private buyers. Bruun Rasmussen must be notified of this before 10 a.m. on the following auction day. B. Buyers with VAT-registration in Denmark may choose to purchase subject to Normal VAT at 25% of the hammer price plus premium. Bruun Rasmussen must be notified of this before 10 a.m. on the following auction day. 5. Collection of purchases The purchase price must be paid in full before the purchased lot can be passed over to the buyer. From the time of the lot being knocked down to the buyer, until its collection, the purchased lot will be held at the buyer s own expense and risk. A storage fee will be charged for lots which have not been collected within 14 days after the time of the lot being knocked down. Goods which have been paid for but not collected within 1 year will be resold at auction or privately at the buyer's expense. 6. own expense and risk. Bruun Rasmussen shall thus not be held liable neither for any damage caused to purchased goods during dispatch nor for any missing consignments. 7. Droit de Suite Pursuant to current Danish legislation on Copyright, an artistic royalty shall be collected on works of modern art by all Danish and some foreign artists. Bruun Rasmussen will from the buyer collect the royalties required on behalf of the artists organisation Copy-Dan for any work of art subject to this law. These works are identified in the catalogue by CD for Copy-Dan, marked beside each relevant lot number. The artistic royalty will be calculated as follows for each work of art, when the hammerprice exceeds DKK 1,863: 5% of the part of the hammerprice ranging from DKK 0 to DKK 310,567 plus the buyer s premium (20% excl. VAT) 3% of the part of the hammerprice ranging from DKK 310,567 to DKK 1,242,267 plus the buyer s premium (20% excl. VAT) 1% of the part of the hammerprice ranging from DKK 1,242,267 to DKK 2,173,967 plus the buyer s premium (20% excl. VAT) 0.5% of the part of the hammerprice ranging from DKK 2,173,967 to DKK 3,105,667 plus the buyer s premium (20% excl. VAT) 0.25% of the part of the hammerprice lying above DKK 3,105,667 plus the buyer s premium (20% excl. VAT) The artistic royalty cannot exceed DKK 93,170 for each work of art. 8. Export licence Applications for an export licence must be made to the Danish Cultural Assets Committee when required in accordance with current Danish legislation on the protection and preservation of cultural assets in Denmark. Where such a licence has not been obtained, the foreign buyer will be informed thereof immediately after the lot has been knocked down to the buyer. Another application will subsequently be sent to the Danish Cultural Assets Committee by Bruun Rasmussen on behalf of the buyer, now that the price is known. Should an export licence not be granted, the Danish Cultural Assets Committee would be obliged to acquire the purchased lot at the purchase price, and the buyer would thus not be bound to the purchase. 9. Cataloguing All lots are sold in the condition in which they are found when knocked down and as described in the catalogue with subsequently published changes and modifications. Cataloguing is done according to the best of Bruun Rasmussen s knowledge and on the cataloguing principles stated. The lots auctioned are often of some age or of a kind which makes it possible that they may contain defects, deficiencies, or may have been subject to restoration or damage not necessarily stated in the catalogue. Catalogue pictures are for identification only and cannot be used for an evaluation of the condition of the goods. Any person who wishes to bid at an auction should therefore sa-tisfy himself of the condition of the lots for which he intends to bid by personal inspection at the preview held prior to the auction. The catalogue description is an indication of the prevailing oppinion of scholars and expert at the time of the printing of the catalogue. If any doubts should arise after the purchase regarding the genuineness of the purchased lot or its conformance with the catalogue description, Bruun Rasmussen should immediately be informed thereof. Should the purchased lot be proved to be a forgery, or if the catalogue description contains material errors which lead to a considerably higher hammer price than that which a correct catalogue description would presumably result in, the buyer shall be entitled to cancel the purchase, after which the buyer shall be reimbursed for the total purchase price paid, up till a maximum amount of the highest estimated price stated in the catalogue plus buyer's premium and VAT, when applicable. For material errors in the catalogue description in respect to measurements or weight, compensation shall only be paid on a percentage basis in proportion to the difference. The right of cancellation of a purchase in pursuance of the present conditions can only be exercised by the party who has bought the lot in question at Bruun Rasmussen and shall be subject to the presentation of a claim for cancellation in writing to Bruun Rasmussen within 2 years of the purchase date and to the purchased lot being returned to Bruun Rasmussen in the same condition in any and all respects which the purchased lot was in at the time of the lot being knocked down to the buyer. In the event of cancellation the buyer shall not be entitled to claim payment of interest on the purchase price nor shall the buyer be entitled to claim compensation for any other expenses or loss incurred, including any possible loss of profit in connection with reselling. It shall not be possible to state cancellation of a purchase in pursuance of the above provisions if: a the catalogue description on the day the lot was knocked down to the buyer was in accordance with the then generally accepted opinion of scholars and experts; b the only way of establishing whether the lot was a forgery at the time of the publication of the catalogue was the implementation of scientific processes, the validity of which was only acknowledged after the time of publication of the catalogue, or which would have required a disproportionate amount of cost, or which would have been impossible to carry out without damaging the lot in question.
