The auction secretariat is found at Dansk Varmblod s show office in arena M and is open on Saturday. The Auction Committee will be available for contact in the Auction Secretariat Saturday from 11am to 1pm. Outside opening hours please do not hesitate to call one of the contact persons (please see p. 6-7 for names and mobile numbers). Payment must be carried out right after the end of the auction. Payment is made in the auction secretariat office in arena M. Please bring your part of the signed purchase agreement when paying. The succession of the horses will be published Saturday in Dansk Varmblod s show office. If you want to have some of the riding horses shown and tested, this can be arranged with the auction committee. Personal arrangements have to be made with one of the contact persons at the latest on Saturday at 11pm. Thursday in Arena E: The selection of showjumping stallions are presented in lunge line and Friday in Arena M in free-jumping Friday in Arena M: The selection of dressage stallions are presented in lunge line. See further information in the time schedule Auction horses will be presented Friday and Saturday in Arena Boxen at 11.30. All horses for auction are classified in group 1 or 2. Veterinarian Hans Schougaard will go through x-rays in the auction secretariat in arena M on Saturday at 11am 1pm. Horses sold without VAT will be mentioned before the auction starts. When bidding, please mark clearly with the catalogue. When buying a horse, the purchase agreement is filled in and signed immediately after. Please complete with your name, address, VAT no (if you have such) in clear writing along with your signature. On Sunday, contact data on buyer and seller can be handed over in Dansk Varmblod s secretariat in arena M. Horses purchased at the auction are insured by Dansk Hesteforsikring. Forsikring af auktionsheste Insurance of auction horses Heste købt på Dansk Varmblods auktion under hingstekåringen i Herning d. 10. marts 2018 er livsforsikret for købesummen inkl. salær og evt. moms til 31. marts 2018 inden for Danmarks grænser. Forsikringen dækker op til 125.000 euro, og dækker hvis hesten dør eller må aflives som følge af sygdom i henhold til lov om værn af dyr. Forsikringen er i henhold til certifikat med tilhørende forsikringsbetingelser der udleveres ved afregning for hesten. Horses purchased at Dansk Varmblod s Auction on March 10th 2018 in Herning during the stallion licensing are covered by life insurance which includes buyer s premium and value added tax. This coverage expires on March 31st 2018 and is limited to the Kingdom of Denmark only. Maximum sum insured is 125,000 and covers in case of the animal s death or if it has to be destroyed following illness in accordance with Animal s Protection Act. The purchaser will receive the certificate of insurance which details the coverage afforded once the payment has been completed. REGLER for Dansk Varmblods Forårsauktion 1. På auktionen bortauktioneres heste, der er registreret eller kåret i Dansk Varmblod. Hestene udbydes til salg i euro. Heste, købt på Forårsauktion vil blive tilføjet DWB efter deres navn. Suffikset er navnebeskyttet af Dansk Varmblod. Dansk Varmblod betaler for tilføjelsen. Såfremt tilføjelsen gør at hestens navn fylder mere en 2 15 tegn, forbeholder Dansk Varmblods sig ret til at ændre hestens oprindelige navn. 2. For dyrenes sundhed og kvalitet samt afgivne oplysninger, påtager Dansk Varmblod sig intet ansvar, idet Dansk Varmblod alene er tilrettelægger af auktionen og ikke indestår for de afgivne oplysninger f.eks. konkurrenceresultater, avlspræstationer o.l. Dansk Varmblod er ikke part i forbindelse med handlen. Hestene er forsikret hos Dansk Hesteforsikring for hammerslagsprisen frem til 31. marts i året for auktionen. Køber kan overfor sælger alene påberåbe sig mangelsbeføjelser ved den solgte hest, såfremt hesten ikke svarer til den betegnelse, hvorunder den er solgt med hensyn til alder, køn og afstamning samt de eventuelt til brug for købers bedømmelse af hesten i auktionsmaterialet afgivne væsentlige oplysninger om hestens resultater og avlspræstationer m.v. Denne ansvarsbegrænsning gælder alene, hvor sælger ikke har handlet svigagtigt eller i strid med almindelig hæderlighed. Særligt for kårede hingste gælder at hingstens sædkvalitet skal opfylde standarden til brug for anvendelse i avlen. Uanset ovenstående ansvarsbegrænsning er køber berettiget til overfor sælger at påberåbe sig at hesten lider af staldfejl, såsom vævning og krybbebidning, forudsat dokumenteret reklamation kommer frem til sælger senest 14 dage fra hammerslag. Eventuelle krav fra køber, der baserer sig på veterinære forhold, der burde have været omtalt i de kliniske og/eller røntgenologiske dyrlægemæssige undersøgelse(r) af hesten med henblik på auktionen, er sælger uvedkommende og alene et mellemværende mellem køber og undersøgende dyrlæge. Køber kan alene ophæve købet, såfremt hesten af køber dokumenteres at lide af mangler, der ikke er uvæsentlige for hestens anvendelse eller handelsværdi. I tilfælde af berettiget ophævelse af handlen overfor sælger, kan køber alene, foruden købesummen og auktionssalærets returnering mod udlevering af hesten, kræve sine følgeomkostninger til hestens røgt og pleje, dyrlæge, beslagsmed, forsikring m.v. erstattet med et takseret beløb på dkr. 100,00/ dag, regnet fra købers reklamation indtil handlens faktiske ophævelse. Yderligere erstatning for følgeomkostninger kan alene fordres, hvis det godtgøres, at sælger har handlet svigagtigt eller i strid med almindelig hæderlighed. 5. Risikoen for den solgte hests hændelige undergang overgår til køber på hammerslagstidspunktet og samtidig overgår pligten til at sørge for og afholde udgiften til hestens røgt og pleje og opstaldning til køber. 6. Den, der byder for en anden, forpligter sig som selvskyldner-kautionist (se endvidere afsnit 6 angående ejendomsret). Køber flere i forening, hæfter de solidarisk. Mindste bud og overbuds størrelse beror på den, der foretager opråbet. Opstår der, efter at hammerslag er givet, tvivl om, hvem der er højestbydende, eller såfremt flere byder samtidig, foretages nyt opråb. Alle tvistigheder under auktionen afgøres af auktionarius eller af en eventuelt tilsynsførende auktionsleder. Den tilsynsførende auktionsleder kan beslutte at indsætte hesten til auktionen igen i tilfælde, hvor køber ikke opfylder auktionsbetingelserne. Den første køber er forpligtet over for Dansk Varmblod og over for sælger for mulig reduktion i salgsprisen, men har ikke krav på et muligt overskud. 7. Budsummen + 10% i auktionsomkostninger samt moms af købesum og auktions omkostninger betales kontant ved hammerslaget. Betales købesummen og omkostninger ikke i rette tid, forrentes beløbet fra auktionstidspunktet med en årlig rente, svarende til den til enhver tid af Danmarks Nationalbank officielle diskonto med tillæg af 6%, til betaling sker. Danske heste solgt til udlandet (alle ikke EU-lande) vil blive faktureret med dansk moms, da Dansk Varmblod ikke kan være sikre på, at hesten vil være ude af landet i løbet af en uge. Køber skal selv sørge for at få moms tilbage hos SKAT. Betalingen skal falde på forbundets kontor med godkendt betalingsmiddel, såsom kontanter, Visakort, MasterCard eller andet anerkendt betalingsmiddel. Eventuelle gebyrer der udløses af betalingsmidlet tillægges købers auktionsomkostninger.
Betaling via bankoverførsel kan alene ske i henhold til særskilt aftale med Dansk Varmblod. Dansk Varmblod indestår ikke over for sælger for købesummens betaling. Dansk Varmblod videresender alene den modtagne betaling til sælger efter fradrag af sælgers auktionsomkostninger. 8. Ejendomsretten over det solgte overgår først til køberen, når købesummen og auk tionsomkostninger er betalt. 9. Enhver anden form for handel med tilmeldte heste til auktion før eller efter opråb, er ikke tilladt under hele arrangementet, uanset dette holdes over flere dage. Foregår der alligevel salg, skal der af sælger til Dansk Varmblod betales fuldt salær. 10. Enhver tvist mellem køber og sælger, køber og Dansk Varmblod eller sælger og Dansk Varmblod, der måtte udspringe af salget på auktionen, skal afgøres efter dansk ret og i henhold til disse auktionsregler ved voldgiften ved Videncentret for Landbrug, SEGES, Udkærsvej 15, 8200 Aarhus N, Danmark, efter Videncentrets al mindelige regler for voldgift om heste, medmindre parterne aftaler at reglerne for udvidet voldgift om heste skal finde anvendelse. 11. Dansk Varmblod forbeholder sig ret til at ændre arrangementet. Eventuelle ændringer vil blive offentliggjort hurtigst muligt gennem opslag. Dansk Varmblod MOMSREGLER v/dansk Varmblods auktioner (Opdateret 2012) Da momsreglerne i Danmark og EU er vældig indviklede, vil vi efterfølgende prøve at sammen skrive dem meget forenklet. Såfremt SÆLGER er en privatperson, dvs. ikke er momsregistreret med sit hestehold (hvilket skal bekræftes skriftligt over for DV s sekretariat) kan hestene sælges UDEN MOMS uanset, hvilket land, person eller virksomhed hesten sælges til. Det skal heller ikke dokumenteres, hvornår den forlader landet. CONDITIONS OF SALE Spring Auction 1. The horses put up for auction must be registered or judged by The Danish Warmblood Society. All bids shall be made in euro. Horses bought at the Spring Auction shall have DWB added to their name. The suffix is a proprietary name of The Danish Warmblood Society. The Danish Warmblood Society shall pay for the addition of the suffix. The Danish Warmblood Society reserves the right to change the original name of the horse, in the event that the added suffix means that the horse s name will take up more than 2 15 letters. 2. The Danish Warmblood Society shall not be liable for the health and quality of the animals nor for the information submitted, as The Danish Warmblood Society merely organises the auction and does not vouch for the information submitted, such as show rankings, breeding performance, etc. The Danish Warmblood Society shall not be deemed to be party to the transaction. The horses shall be insured with Dansk Heste forsikring ( Danish Equine Insurers ) in the sum of the auction price until 31 March of the year of auction. The buyer is encouraged to familiarise himself with the terms of the insurance which are available at the offices of the auction house. 3. With a view to the auction and according to the rules of The Danish Warmblood Society for premium stallions, the x-rays of the horse must have been taken by an authorised veterinary however with the addition of neck and back, as specified below which shall have been taken after the 1 September of the year prior to the auction, of: All four feet (in lateral-medial projection). The navicular bone of both front feet. In the event that the veterinary taking the X-rays suspects that there may be a change in the navicular bones, skyline X-rays (without shoes) shall also be produced. Three images of the hock of both hind legs: 1. Latero-medial aspect (LM 45 degrees) 2. Dorso-planetar aspect (DP 115 degrees) 3. Planetarolateral-dorsomedial oblique (PIL-DMO) The stifle joints of both hind legs from latero-medial aspect (LM-projection) The neck: Including the neck in its entirety, in such a manner that the external occipital crest and the facet joint between the 7th 54 varmblod.dk cervical vertebra and the 1st thoracic vertebra are included in the image. The overlaps between images shall be easily identifiable. The back: The spinous process from (and including) the 4th thoracic vertebra to (and including) the 3rd lumbar vertebra shall be included. The images shall be labelled in such a manner that any overlaps between individual images are easily identifiable. The horse shall have been inspected with a view to auction in accordance with the standards of The Danish Veterinary Association, no earlier than 14 days prior to the auction. Prior to bidding at the auction and with the assistance of his own veterinary advisor, the buyer is encouraged to familiarise himself with the contents of the clinical and radiological veterinary inspection which is available at the offices of the auction house. 4. The buyer may only rely on a claim against the seller based on a defect in the sold horse in the event that the horse does not correspond to the description by which it is sold in respect of age, gender and decent and any essential information on its rankings and breeding performance, etc., provided in the auction documentation for the purposes of the buyer s assessment of the horse. This limitation of liability shall only apply in such cases where the seller has not acted fraudulently or immorally. In particular, the sperm quality of premium stallions must fulfil the requirements of sperm used for breeding. Notwithstanding the above limitation of liability, the buyer shall be entitled to rely on a claim against the seller that the horse is suffering from stable vices such as weaving, cribbing or wind-sucking, provided a documented complaint is made to the seller no later than 14 days from the fall of the hammer. Any claims on the part of the buyer based on veterinary circumstances, which ought to have been described in the clinical and/ or radiological veterinary inspections of the horse with a view to auction shall be of no consequence to the seller and solely a matter between the buyer and the veterinary carrying out the inspection. The buyer may only rescind the purchase in the event that the buyer is able to document that the horse is subject to defects that are not insignificant to the use or trade value of the horse. In the event that the transaction is legitimately rescinded, in addition to demanding the return of the purchase price and the auctioneer s commission for the return of the horse, the buyer shall only be entitled to make a claim for the costs of the care of the horse, veterinary consultations, farrier, insurance, etc., to be compensated by an assessed sum of DKK 100.00/day, calculated from the date of the complaint until the actual termination of the contract Any additional compensation for costs may only be claimed if evidence is provided that the seller has acted fraudulently or immorally. 5. The risk of the accidental destruction of the horse transfers to the buyer at the time the hammer falls and the duty to undertake and pay for the care and stabling of the horse transfers to buyer at the same time. 6. The individual bidding on behalf of another shall become liable as guarantor (cf. Moreover paragraph 6 on title). Several individuals bidding in concert become jointly liable. The size of the lowest bid and advance bid is fixed by the auctioneer. In the event that, on the fall of the hammer, there is any doubt as to whom is the highest bidder, or in the event that several individuals make simultaneous bids, a new announcement shall be made. Any disputes arising from the auction are settled by the auctioneer or by the auction manager in charge. In the event that the buyer does not comply with the conditions of sale at auction, the auction manager in charge may decide to put up the horse for auction again. The first buyer shall then be liable to The Danish Warmblood Society and to the seller for any reduction in the auction price, however is not entitled to a potential excess price. 7. The bid plus the auction fee of 10 percent, as well as Danish VAT of the purchase price and the costs shall be paid in cash on the fall of the hammer. In the event that the purchase price and the costs are not paid in a timely manner, interest shall be calculated and added to the sum due at a yearly rate equivalent to Danmarks Nationalbank s official rate of discount plus 6 percent, until such time that payment is made. The sale of Danish horses abroad (to non- EU countries) shall be invoiced inclusive of
Danish VAT, as The Danish Warmblood Society cannot be certain that the horse will leave the country within a week. The buyer shall be responsible for applying for a VAT refund from the Danish tax authorities ( SKAT ). Payment shall be made at the offices of the Society in legal and approved tender, such as cash, Visa, MasterCard or other approved means of payment. Any fees arising from the means of payment shall be added to the buyer s costs of auction. Payment by means of bank transfer will only be accepted by prior agreement with The Danish Warmblood Society. The Danish Warmblood Society shall not be liable to the seller for the payment of the purchase price. The Danish Warmblood Society shall merely forward the payment received to the seller, deducted the auction costs of the seller. 8. Ownership of the horse only passes to the buyer when payment has been made for the purchase price and the costs of auction. 9. Any other form of trade in horses put up for auction prior to or after announcement shall not be permitted in the course of the event in its entirety, notwithstanding the fact that the event may last several days. In the event that a sale does take place, the seller shall be liable to pay the full fee of The Danish Warmblood Society. 10. Any dispute arising between the buyer and the seller, the buyer and The Danish Warmblood Society or the seller and The Danish Warmblood Society shall be settled pursuant to Danish law and in accordance with these conditions of sale at auction before the arbitration tribunal of Videncentret for Landbrug, SEGES, Udkærsvej 15, 8200 Aarhus N, Denmark, according to Videncentret s general rules on equine arbitration, unless the parties specifically agree that the rules on extended equine arbitration apply. 11. The Danish Warmblood Society reserves the right to make changes to the event. Any such changes shall be published as early as possible through notices. Dansk Varmblod / The Danish Warmblood Society RULES REGARDING VAT at Dansk Varmblod s auctions (updated 2012) Since Danish and EU rules regarding VAT are very complicated we have tried to simplify them in the following. For further details or the rules in full please refer to the main office of Dansk Varmblod or your own accountant. If seller is a private person, i.e. not VAT registered with his keeping of horses (which must be confirmed in writing to the main office of Dansk Varmblod prior to the auction) the horses can be sold without VAT no matter which country, person or company the horse is sold to. Furthermore it needs not be proved when it leaves Denmark. Since it is Dansk Varmblod who issues the invoice for buyer on behalf of seller in the first place, it has been decided that ALL invoices are charged with VAT even though they should be zero-rated in accordance with the EU rules. This VAT should be regarded as a kind of deposit to be returned to customer when it has been substantiated that the sold horse has left the country.
